Will of Daniel WAKELIN, 1877

 

This is the Last Will and Testament of one DANIEL WAKELIN of Eckington in the County of Derby Miner I bequeath all the personal of which I shall die possessed to my Wife PHOEBE WAKELIN absolutely I devise all the real estate of which I shall die possessed unto my friend CHARLES LEVICK of Eckington aforesaid Butler upon trust to receive the rents and annual proceeds to arise therefrom, and after payment of all necessary expenses and keeping the buildings in a good state of repair Upon further trust to pay the net income to my said Wife during her life and from and immediately after her death Upon further trust to sell the same by public auction or private contract and to divide the moneys to arise from such sale amongst my children living at the time of the decease of my said wife in equal shares I devise all Estates vested in me as Trustee or Mortgagee to the said Charles Levick subject to the equities affecting the same respectively I appoint my said Wife and the said Charles Levick Executors of my Will  In Witness whereof I have hereunder set my hand this fifteenth day of April 1877 ------------Daniel his X mark Wakelin ----------------- Signed by the said Testator in his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as witnesses the words appointing trustees being first interlined. --------ROBERT FANSHAWE------ FREDERICK  HARDWICK-------

Proved at Derby the 30th day of April 1877 by the Oath of Charles Levick one of the Executors to whom Administration was granted; power reserved to Phoebe Wakelin, Widow, the Relict the other Executor.

 

The Testator Daniel Wakelin was late of Eckington in the County of Derby, Miner, and died on the 16th day of April 1877 at Eckington aforesaid.
