Dugdale though he might be gran dson of Hugh le Despenser who occurs as a sheriff and custodian of castles betw een 1224 and 1237. The future justiciary is first mentioned in 1256, when Hare stan Castle in Derbyshire was entrusted to him. In 1257 he accompanied Richard, the newly elected king of the Romans, to Germany. Returning to England the fo llowing year, he was one of the twelve representatives elected by the barons in the parliament of Oxford (June 1258) to the council of twenty-four. He was al so, by the same 'Provisions of Oxford,' named as one of the twelve commissioner s for the barons parliament. and confirmed in his canstableship of the royal ca stle of Harestan. In 1260 he acted as a justice of Harestan. In 1260 he acted as a justice itinerant in three counties, and in October 1260 succeeded Hugh B igod (d 1266), the original justiciary of the barons, in his office. He appear s in the Fine Rolls, as justiciary, March and June 1261. On the king regaining power, to some extent, Hugh's father-in-law, Sir Philip Basset, a royalist, was appointed justiciary 24 April 121. But the two appear to have acted concurrent ly for about a year, when Basset, with the growing strength of the king, obtain ed sole power. But a reaction in the spring of 1263 lead to a fresh submission of the king and the reappointment of Hugh as justiciary 15 July 1263, the Towe r being also placed in his charge. He appears on the rolls in that capacity 1 O ct 1263. On 16 Dec 1263 he became one of the sureties ex parte baronum for the observance of the Mise of Amiens. Heartily joining the baronial party on the outbreak of hostilities, he allied forth from the Tower, and at the head of a m ob of citizens burnt and sacked the residence of the king of the Romans at Isle worth, and on the arrival of the barons he was one of their sixteen leaders who signed a convention with the mayor of London before the advance of Lewes. At the battle (13 May 1264) he fought in the foremost ranks, capturing Marmaduke T hwenge and forcing his own father-in-law to surrender to him, sorely wounded. He was then made governor by the victorious party of six castles, including Oxf ord, Nottingham, and the Devizes. On 13 Sept (1264) he was named one of the ar bitrators agreed on by the king and barons for arranging terms of peace, and at once crossed with them to France; in the same month he received a thousand mar ks for his support as justiciary, and on 14 Dec (1264) he was summoned to Simon de Montfort's parliament. In the following year, 'between Easter and Witsunti de,' he was appointed one of the four arbitrators to mediate between the Earls of Leicester and Gloucester. Some difficulty is caused by the occasional adopt ion by Simon de Montfort, from January 1254 to his death, of the style of justi ciary. Undue stress has been laid on this by some writer, as Professor Shirley , Pauli, &c., who assume that it implies the deposition of Hugh. But it is cer tain that Hugh remained in office, for Simon's proclamation prohibiting the tou rnament was addressed to him (16 Feb 1265) as 'Hugo le Dispenser, Justic' Angli ae;' he witnessed, as justiciary, a grant to the chancellor in March; was again so designated in the first week in May; tested, as justiciary, a document (unp rinted) issued at Hereford on 19 June; and fell at Evesham (4 Aug) as 'Hugo le Despenser, Justitiarius Angliae' - Sir Hue le fer, ly Despenser Tres nobl e Justice (Wright, 'Political Songs, p 126) after being in vain entreated by Simon to seek safety in flight. Moreover, a passage in the 'Coram Rege Rol ls' (50 Hen III) reveals to us an emissary sent to rouse the county of Essex, i n support of Simon, for the campaign of Evesham, 'cum litteris Hugonis le Despe ncer, tunc Justiciarii Anglie.' He served with Edmund, earl of Cornwall, in the Welsh war, and soon afterwards was fined two thousand marks fo r marrying Isabel, daughter of William Beauchamp, earl of Warwick, and wido of Patrick of Chaworth, without the king's license. In 1294 he was with the king in Gascony, and the next year received a summons to parliament. he marched wit h Edward into Scotland, was present at the battle of Dunbar, took part in the e xpedition to Flanders in 1297, and was employed to treat for peace between Edwa rd and the king of the Romans and the king of France. The next year he again s erved in Scotland, and was sent on an embassy to Boniface VIII. He took part i n other Scotch campaigns, and in the negotiations with France which preceded th e peace of 1303. In 1305 he was sent to Clement V at Lyons, and botained a bul l absolving theking from the oaths which he had taken to his people. At the co ronation of Edward II he carried part of the royal insignia. When in 1308 the barons leagued themselved together against Gaveston, he stood alone upholding t he king's favourite. His conduct was put dow to avarice, he was regarded as a deserter from the common cause, and the parliament which met at Northampton pro cured his dismissal from the council. His disgrace was not of long duration; h e received the castles of Devizes and Marlborough, and became the chief adviser of the king. In 1312 he was sent with Aymer de Valence, earl of Pembroke, and others to endeavour to secure London for the king. The commissioners arrested some of the citizens, a tumult was raised, and they were forced to leave the c ity. On the death of Gaveston, Despenser became the chief man of the court par ty, and encouraged the king to form plans of revenge against the barons. He was bitterly hated by the Earl of Lancaster, and was excluded from the general pac ification of 1313. He accompanied the king on his unfortunate expedition into Scotland in 1314, and when the defeat of Bannockburn placed Edward at the mercy of Lancaster, was forced to withdraw from the court and the council. In 1318 the king seemed on the point of making a vigorous effort to overthrow the power of Lancaster, and Despenser, with the other lords of the same party, attended the parliament of Northampton armed, and at the head of his retainers. A pacif ication followed, greatly to the king's disadvantage, and he stood alone in ref using to bend to the earl's will. About this time his son, Sir Hugh le Despense r, joined the king's side. Both the Despensers received many large grants from the crown; they were generally hated, and were accused of many acts of oppress ion and wrongful dealing. Although both, and especially the son, succeeded Gav eston in the royal favour, they had little in common with him. Unlike Gaveston , they were of noble family, and were connected with many great baronial houses . They held the most prominent place in the party opposed to the unscrupulous designe of Lancaster, and sought their own advancement through alliance with th e crown, while the earl carried on an equally selfish policy by thwarting and l imiting the royal power. Greedy and ambitious, they used the influence they ga ined over the king for their own aggrandisement. The wealth and honours he sho wered upon them strengthened the hatred in which they were held. In the cast o f Gaveston, the hatred of the barons was mixed with contempt for the upstart fo reigner; in the case of the Despensers, it was near akin to fear. It appears i mpossible to decide whether the father or the son was the more to blame.
