Saint Mary's Church- Wherstead

It is interesting that St. Mary's has a bell in its tower that was cast at Norwich in 1469 so our ancestors would have heard the same bell rung on Sunday mornings, for weddings and funerals, as we can hear today.

On some of the web sites I have seen a Thomas Merrill as the father of John who died in 1529, however, I have yet to see any evidence for this. Besides, with this family's devotion to the name "John", one would expect that his name would have been John and not Thomas!

With having two sons named John this usually implies that they had two different mothers. The question is: is the John who made his will in 1551 John I or II? John I is appointed one of the executors and had a daughter Joan so this implies that he was of age and married at the time of his father's will. With only one grandchild named I would guess that John I was newly married. If we look at the discussion below we can assume that John I was born probably before 1505. So, I would bet that our ancestor is John I.

Looks like this John also had a John I and John II! Where the oldest son John was given his bequests at the time of his father's death and that the testator's sons William and Michael were supervisors of the will, this implies that they were all of age. I think we have to avoid making the assumption that his daughters were unmarried because he didn't list their last names. No grandchildren were named which may or may not be significant. So, his eldest son John was probably born before 1526, however, he could have been born a considerable time before then and had a family, we just don't know. Looking at the grandchildren named in the will of John the testator of 1600 and their dates of marriage we can state that the eldest grandson, John, was born probably before 1567. This would make John the testator of 1600, the son of John the testator of 1551, born probably before 1546. My guess would be that our ancestor is John II, the younger son of John the testator of 1551. OR... we are missing a generation and the testator of 1600 is actually a grandchild of John I who died intestate. But, these folks seem to have been people of some means and I doubt that given the estate involved that there wouldn't have been an estate going through probate if this were the case... so I'll still put money on John who died in 1600 being John "the younger", son of John who died in 1551. Of course this all implies the assumptions of men not marrying before the age of 21 and assuming two years between children and that the listing of children in a will is by order of birth... and that a possible "missing" generation didn't live outside the area (hence no probate records in Suffolk or the PCC)... and you know what they say about the word "assume".

I John Merrell the elder of whersteade in the Countie of Suff: Yeoman being sicke in bodie and yet of pfect memorie praised be almightie god remembring that all mankind is mortall and the time of death is uncertaine for the satisfaccon of my mind and the quiet of my wife and children & a remembraunce of some other have and doe hereby make and declare my last will & testament in manner & fforme as hereafter ensueth that is to say ffirst and most principallie in most humble manner I comend my Soule into the hands of almightie god my maker redeemer and Sanctifier trusting by and through the merrits and obedyence of my lord and Saviour Jesus Christ that my soul shall possesse and enioy eternall life & salvacon And as for my bodie I bequeath to the earth to be buried by the discretion of my executors.

The "Merrill Memorial" states that Nathaniel and John settled in Newbury in 1635 after having moved from Ipswich and that Nathaniel became one of the proprietors in 1638. However, this is all conjecture as there is no evidence that Nathaniel arrived in America before 1639 or lived anywhere other than Newbury. John, however, did arrive earlier and had been living in Newbury for some time prior to Nathaniel's arrival. He was granted a lot on the Neck on the south bank of the Parker River in Dec. 1646: "the necke men have consented to hold to the removeing of the towne, and accordingly have received satisfaction at the new towne in land, for their land on the necke, and therefore have yelded up their land in the necke to the Towne."(1) Consequently the town was moved to the shore of the Merrimack River.

John and Susanna were probably married in England. Although their son John was the executor of the estate of Gregory Wolterton of Hartford, CT, Susanna was probably not his sister.

The "Merrill Memorial" states that John and Nathaniel bore the arms "Argent, a bar Azure, between three peacocks' heads erased Proper", however, I have not seen any evidence for their right to these arms.

Witness by those psents that I Nathaniell Merrill of Newbury in the Countie of Essex being sicke of body but through gods mercy of perfect memory do here make my last will and testament.

I first bequeath my soule into the hands of my blessed Redeemer with an assured hope of a joyfull resurection, and my body when it shall please the lord to take me out of this fraile life to bee buryed in the burying place of Newbury, and for my worldly goods I give and dispose of as followeth

Impr I give and bequeath unto Susanna my wife five akers of plowable land lying next my Brother John land and halfe the marsh dureing her naturall life and a cow and three heifers and all my household goods,

And out of this estat so given to my wife I give and bequeath unto my daughter Susanna five pounds when she shalbe at the age of twenty yeares

Then I give and bequeath unto my son Nathaniell (whom I appoint as my true and lawfull heire) all my land and freehold after my wives decease, and all the working tooles & Implements of husbandry and all the cattell and stocke besids And out of this stocke I appoint that my son Nathaniell shall pay theise legacyes as followeth, that is

I give unto my son John when he shalbee of the age of two and twenty yeers the summe of five pounds,

Nathaniel is listed as one of those who took the oath of allegiance at Newbury in 1678.(1)

On 19 Apr. 1678 Nathaniel Merrill of Nubery purchased an acre of meadow in Haverhill from Daniel Lad for "£3 & a flitch of Bacon." He also purchased 50 acres from Thomas Duston in Haverhill on 15 Mar. 1677/8 which was the property appraised in 1682 for £120.(2)

I Nathanuel Marrill of newbury in masathusith: newingland: being sensabel of my owne mortallity and haveing att this time my Rationall undarstanding and memory dou make this as my last will and testament: commiting my sole to god and my body to the dust: in hopes of a Joyfull Resarection: and as for my worldly goods I despose of them as folloeth:

I give to my belovid wife gone [Joan]: all my dwelling howsing and barne with all my upland and meddow: and marshlands that I have with in the township of newbury/ and my fre howld: and privilidgis in all commans et: as allso all my stok of cattell and shep: and swine: and howssald goods: with all: other mowfabels: all which to be for the benefet of my wife duoring her widdohowd: but if my wife marry again: then: she shall have no Right to all above said gieven her: but onely har thards as the law douth a low: or thre pound ayear to be peaid har as by this my will appoyentid:

The total of the inventory was £520.7s. The debts chargeable to the estate amounted to £46.9s.8d.

The Newbury tax list of 1688 shows that John owned one house, five acres of plowable land, three acres of meadow, one horse, one yoke of oxen, one cow, and eight sheep.(1)

John was a house carpenter. He moved to Bradford in 1697 and then to the west parish of Haverhill about 1700.

His estate was valued at £152/7 with debts of £158/12.
