    It appears that James' son John was the first of the family to arrive in the New World and was involved in the cod fishery in New England as well as Newfoundland:

    "This Indenture made the 5th of May Anno Domi 1636 witnesseth that I Thomas Bradbury Gent now Agent for Sr Ferdinando Gorges Knight in these Parts of New England doe... confirme unto Edward Johnson Gent for the proper Use of John Treworgye of Darthmouth Merchant... 500 Accors of Land bordering upon the North East Side of Pascataquacke River... from the South East Coave of Phillip Swaddens now Wigwam unto the Cricke which turns up to brave Boat Harbour... he is to pay annually 100 of Merchandable Codde dride & well conditioned as Acknowledgmt to the Royaltie of Sr Ferdinando Gorges Knight... to be payd... uppon the Feast of St Michaell ye Arch Angell. Moreover if hereafter there shall be any Profitt to be raised for Keeping a ferre within the sd Limmetts yt then Sir Ferdinando Gorges Knight... is to have One Halfe of the Benefit & Mr John Treworgy... the other Halfe... Tho : Bradbory... in the Presence of us Tho : Wannerton... Bartholomew X Barnett"(3)

    James was summonsed for the grand jury at Saco in 1640, accused of divulging its secrets to John Winter which was found unacceptable.

    His exact relationship with his father in law cannot be known, but on 2 Apr. 1641, residing in New England, he sold all fishing trade belongings and all estate, real and personal, for £1,500 to Nicholas Shapleigh, livery being given to Mr. Godfrey in behalf of Shapleigh 22 Apr. 1641:

    "James Treworgy now Resident in New England... for & in Consideration of One Thousand & Five Hundred Pounds lawfull Money of England... payd by Nicholas Shapleigh of Kingsweare in the County of Deavon Marchant... doe... sell... all my Lands, Houses, Goods, Chattals, Fish, Fishing Craft, Botes, & all other Things to the Fishing Trade belonging... together with all my whole Estate boeth Reall & Personall wch I now have... in New England in America... the 22th Day of Aprill 1641 Livery & Seisen... delivered by the within named James Treworgy to Mr Edw : Godfrey in the Behalfe of the within named Nicholas Shapleigh of all the Lands Goods & Chattals... of the abovenamed Nicholas Shapleigh... Witness hereunto Edw : Godfrey Roger Garde."(2)

    A similar deed from his father-in-law to himself is dated 26 May 1642. This probably represents a mortgage deed:

    "Alexander Shapleigh of Pascattaquacke in the Province of Mayne Marchant... for & in consideracon that James Treworgy my sonne in law standeth bound to me to severall psons in England for the sume of seaven Hundred pounds and hath taken Upon him selfe to satisfie the same... doe... sell... all that my lands, houses, goods, Chattalls, ffish, ffishing craft, botes & all other things to the ffishing trade belonging... together wth all my whole estate boeth reall and psonall wch I now have... in New England in America... the 26th Day of May Ano : Domi 1642- Alexsander Shapleigh... in the prsence of Roger Garde, Mighaell Taynter, Nicholas Treworgy... the within named Alex : Shapleigh did deliver to the wthin named Roger Garde for the Use of the wthin named James Treworgy one silver cupp in pte of the posession of all the prmises within granted"(1)

    His daughter Lucy's deposition in 1704 sets the year of her arrival here as 1646. By court records it seems like he was here about 1647, but, like other males of the family, he vanished early and without record.

    He was certainly dead by 2 July 1650 when Mrs. Treworgye agreed to turn the estate in her hands over to her brother:

    "Mrs Katheren Treworgy being sumoned to appeare at a Courte houlden for this Province of Mayne in Accomenticu the 5th of July 1650 to shew what Cause she had to challenge or Claim and Interest or Propriety in the Estate of Mr Alexsander Shapleigh deceasd then it was made appear by a Deed bearing Date the 26th of May 1642 from Mr Alexsander Shapleigh to Mr James Treworgy of the alienating all the Estate for sarten Sums of Money... So it appeared to the Court that the Estate of Mr Alexsander Shapleigh was of no Consequence... soe it was determined that the Estate was Mr Nicholas Shapleigh's & Mrs Katheren Treworgy to renounce all Interest therein... 6th of July 1650. p me Edw : Godfrey Governr, Basill Parker Re : Cor : "(4)

    Catherine had an Indian deed of Thompson's Point on 3 Oct. 1651:

    "I Mr Rowles Indean, Sagamore Resident In Pischataqua, have given & granted unto Katterine Trueworgy, my Poynt of Land Commanly known by the name of Tomsons Poynt, An ould Corne ground which I the sayd Mr. Rowls have formerly made uss of, & Improved

    And by these Prsents doe... grant... unto Mis Katterine Trueworgy... In Consideration of two bottles of Lyquor to mee In hand payd; The Poynt of Land with the Improved ground there on... 3d of Octobr 1651 : The marke of Maister Sagamore Rowles X... In the Prsence of Nic : Shapleigh, Humphrey Chadbourne" [recorded 16 Jan. 1676/7](5)

    "I Katterne Hilton of Ecceter, In the County of Norfocke, Widdow... in consideration of my motherly loveing affections wch I beare unto my Loveing sonn Samll : Trueworgye, of Portsmouth in Pischataqua River Marriner, doe... grant... all that my necke or Tract of Land, scituate above Sturgeon Cricke... formerly Called Tomsons Poynt, now Called... Treworgys poynt... I bought of Mr Rowles the Indean... Dated in Ecceter... this secund day of Novembr... one thousand six hundred seaventy & foure... Kattrein Hilton KH... in the Prsence of John Gillman, Moses Mavericke" [recorded 16 Jan. 1676/7](5)

    "I Samell Treworgye of Portsmouth, IN Pischataqua River Mariner, for... forty five pounds... payd... by Richard Rich of Dover In Pischataqua River, Mariner... do... sell... all that my Necke or Tract of Land, scituate above Sturgeon Cricke In the Town shipp of Kittery in Pischataqua River... fformerly Called Tomsoms poynt... Contayneing... fivety Acers... wch Necke or Tract of Land my Mother Mis Katterin Hilton, bought of Mr. Rowls the Indean while shee was my fathers Mr James Treworgys Widdow... this sixth day of Novebr... one thousand six hundred seaventy foure... Samell Trueworgy, The marke of X Darcas Treworgy... In ye psence of Phillip Cromewell, Joseph Hodgsden". [recorded 16 Jan. 1676/7](5)

    "28 June 1671 presentments given in by ye grand Jury... Upon the motion of mrs Katherin Hilton to have her thirds of her deceased Husbands mr Edw: Hilton his estate Sett out for her This Court nomynates & appoynts mr Jno Gilman mr Samll Dolton & mr Edward Hilton or any two of them to be a Com'itte to Lay out the same according to Law unless ye sd Katherin, heires & Administrs shall other wise agree".(8)

    At the same court was this entry:

    "It appearing that Jer: Tibbett prison Keeper Opened ye prison dore & Lett ye prisoners have light & had like to have burned downe the prison the Court sentence him to repaire the prison at his owne cost as good as it was before by ye 15th July next..." Oops.

    At another court in June 1674 we find evidence that Catherine worked as a midwife:

    Mrs Katherin Hilton testifieth in Court that being at ye Labour of Katherin Curcuet, & examyning who was ye father of her child & that in her extremyty she replied she had tould already & that it was Hugh Latimor & that noe other had to doe with her"(9)

    It was thought that a woman in the pain of labor would only name the true father of a child.

    "The will & Testament of mrs Katheraine Hilten as Followeth:

    mrs Katharaine Hilton, being of her pfect senses and understanding doeth order and dispose of her goods and effects as followeth

    Impus: shee doth comit and commend her soule to god that gave it her, shee doth comit her body to the dust from whence it was framed with a decent burial of the same.

    For her estate and goods as followeth.

    To James Tryworthy the son of Sam : Tryworthy a silver beaker to be kept in the hands of her Daughter Elizabeth Gilman, till he come to age.

    To James Triworth the son of John Triworthy a silver cup with a fork

    To Edward Hilton jnior, a silver cup with two ears.

    To Sam: Gilman her Grandchild a silver spoone.

    To mr Sam: Dudly towards his ministry to be paid out of her Estate to the valew of money, to the sume of forty shillings.

    To her Daughter mrs meridith named by Joanna, one yron great Kettle, and a cloth gowne, and a cloth petticoat, and a greene apron.

    To mrs Luch wells, one stone ring, one mor Hayre petticoate

    To her Daughter Elizabeth Gilman, her wedding ring, her serge gowne, her serge petticoat, and her stuffe petticoat, and alsoe her hat.

    To Johann Meridith, her grandchilde a paire of holland sheets

    To mary Gilman her Grand childe, a table cloth and napkins and a Holland pillow beare and a towel, and a great pewter platter

    To Betty Gilman, one Holland sheet & a paire of stockings.

    To Abigail Gilman the wife of Edward Gilman one feather pillow and wistead rug, and pillion and pillion cloth, and hood and safeguard.

    To Katharine Paul, her best skarth, and serge petticoat, being of a gray colour.

    To Katharine Gilman, a black handkerchief and a black sk [ ]

    To Sarah Gilman, a black hood,

    To Lydye Gilman a black hood

    To Abigail Gilman, her white mantle.

    To goodwife Robinson, her cloth petticoat, & her cloth waiscoate, and a paire of bodyes & a paire of stockings, and a suite of linnen.

    To Remainder of her linnen, what is not disposed of above wrytten to be divided among all her grand Daughters.

    To Jane Hilton her silver bodkin, and a new shift

    To all thise prmisses above wrytten mrs Katharaine Hilton, hath given, her ful consent and approbation, as appears verefied by these witnesses have subscribed

    memoranda: This the will of the said Kathairine Hilton that when all her debts are discharged, in reference to her son in law Capt. John Gilman, & mrs wells, & what shalbe layd out and expended about her funerall, the remained to be divided among her Grand children.

    And furthermore, that all the prmisses abovesaid, may be put in act and exequetion I doe choose and appoint my son John Gilman, Capt: for my Executor

    To the prmisses abovesaid in testeffication of the truth of the same. I doe subscribe my name.

    Proved 30 May 1676, inventory of the estate of Mrs. Catherine Hilton of Exeter taken by John Folsom and Robert Wadleigh, 6 Oct. 1676 amounted to �78/10/6. (6)

  • I. John- bpt.30 Sept. 1616 Kingsweare, m. 15 Jan. 1646 Newbury, MA, Penelope Spencer, Commissioner of Newfoundland in 1651 and subsequently served as Governor. In 1663 he appears in a petition concerning land in Virginia.(10)
