White County Tennessee Deed Book N, 1842-1844 Pages 427-429 Robert C. Pirtle | to | Jacob L. Pirtle | This Indenture made and entered into this 19th day of March A.D. 1844 between Robert C. Pirtle of the County of White and State of Tennessee of the one part and Jacob L. Pirtle of the same County and State. Witnesseth that whereas the said Robert C. Pirtle is justly indebted to the said Jacob L. Pirtle in the sum of about fifty dollars due some time in the month of March 1844 evidenced by note of hand and also in the sum of Forty three dollars and forty four cents due by account and whereas the said Robert C. Pirtle is willing and desirous to indemnify and secure the said Jacob L. Pirtle in said debts hereby conveys and sells to the said Jacob L. Pirtle and his heirs a certain Stud Colt four years old this Spring named Ben Franklin, but it is the expressed understanding and agreement by and between the parties that if the said Robert C. Pirtle shall well and truly pay off the above described indebtedness to the said Jacob L. Pirtle on or before the 25th day of December next then and that case this Indenture to be void and the right to said Stud Colt to revest in said Robert C. Pirtle and the said Robert C. Pirtle is to be and remain in the possession and use of said Stud Colt subject however to the provisions and conditions of this deed - but should said Robert C. Pirtle fail to pay over to the said Jacob L. Pirtle his executors or administrators the above indebtedness on or before the 25th day of December next it shall be the duty of said Jacob L. Pirtle his executors or administrators to advertise said Stud Colt at three public places in White County one of which shall be at the court house door in Sparta for at least ten days before the day appointed by him for said sale. And if on the day appointed for said sale the said Robert C. Pirtle shall not have paid off said debts with all legal interest and costs thereon said Jacob L. Pirtle shall proceed to sell said Stud Colt at the Court house door in Sparta to the highest bidder for ready money and apply the proceeds first to pay himself a reasonable compensation for attending and carrying out this trust, And in the next place pay off and satisfy the debts herein intended to be secured and should there then be a surplus remaining said Jacob L. Pirtle is to pay the Same over to the said Robert C. Pirtle his heirs executors or administrators. Pirtle the within named conveyors that they acknowledged the due execution of the within deed for the purposes therein contained which is recorded. Smith Register of White County Robert C. Pirtle | to | Deed for 356 acres of Land Samuel D. Arnold | This Indenture made and entered into this nineteenth day of March in the year of our Lord one thousand eight hundred and forty four between Robert C. Pirtle of the County of White and State of Tennessee of the one part and Samuel D. Arnold of the Same County and State of the other part. Witnesseth that the said Robert C. Pirtle for and in consideration of the sum of Two hundred and six dollars and fifty cents to him in hand paid by the said Samuel D. Arnold, the receipt whereof is hereby acknowledged hath and doth by these presents bargain sell alien and convey to the said Samuel D. Arnold and his heirs and assigns forever two certain tracts or parcels of Land situate lying and being in the County of White and State of Tennessee on the waters of Cedar Creek and Townsends Creek, first tract containing by estimation One hundred and Sixty acres more or less being all that part of the Lands sold as part of the Lands of George Pirtle deceased under a decree of the Circuit Court of White County lying on the west side of the road. Beginning on the south boundary line where the road crosses said line and running north with the line of the other parcel sold to Elijah Pirtle to the mouth of the Spring branch & to include one half of the Spring. The other tract lying on the waters of Cedar Creek containing one hundred and ninety six acres all being the two tracts of Land described in the petition and pleadings and decree of the Sale of the Lands of said George Pirtle decreed in the Circuit Court of White County and purchased at commissioners Sale by the said Robert C. Pirtle. To have and to hold to the only proper use and behoof of him the said Samuel D. Arnold and his heirs and assigns forever and the said Robert C. Pirtle hereby covenants and agrees to and with the said Samuel D. Arnold his heirs and assigns to warrant and forever defend the right and title of in and to the foregoing conveyed Land and premises together with the hereditaments and appurtenances to the Said Samuel D. Arnold and his heirs forever. In testimony where of I the said Robert C. Pirtle have hereunto Subscribed my name and affixed my seal the date above written.
