McWhorter buys land in Virginia from Alexander Henderson,1
July 30, 1752
This Indenture made this thirtieth day of July one thousand Seven
hundred & fifty two Between Alexander Henderson of the County
of Augusta Planter & John McWhorter in the Parish of St Annes
in the County of Albemarle of the other part Witnesseth that the
said Alexander Henderson for and in Consideration of the sum of
Seventy Pounds current money of Virginia to him in hand Paid before
the Sealing & Delivery of these Presents the receipt whereof
he doth hereby acknowledge & therewith to be fully Satisfied
& paid Hath Bargained Sold aliened Enfeoffed & confirmed
& by these presents Doth Bargain Sell Alien Enfeoff & Confirm
unto the said John McWhorter his heirs & assigns forever one
certain tract or parcel of land containing two hundred & thirty
Seven Acres lying and being in the County of Albemarle on both sides
of Rockfish River North Branch near the blue Mountains & bounded
as followeth (to Wit)
Beginning at Pointers upon Pounders Branch upon James Martins
Line thence North 80 Degrees East forty four poles to a red oak
thence North ten Degrees west one hundred & ninety four Poles
to a red oak Saplin thence South Seventy two West one hundred &
ninety eight Poles to a Hiccory Saplin thence South one hundred
& Seventy Seven Poles to a white Oak thence North eighty Degrees
East one hundred & eighty two Poles to the first station
To have & to hold the said tract of land with all Houses
Edifices Buildings Enclosures ways waters profits & emoluments
whatsoever & the reversion and diversions remains & remainders
thereof and of every part & parcel thereof and all the Estate
right title & interest whatsoever of him the said Alexander
Henderson of in & to the said bargained premises & every
part and parcel thereof to possess & enjoy the said tract of
Land & all & singular the premises with the appurtenances
unto the said John McWhorter & to his heirs & assigns to
the only proper use and behoof of him John McWhorter his heirs &
assigns forever & the said Alexander Henderson2 & his heirs
& assigns said tract of Land & all & Singular the premises
with appurtenances unto the said John McWhorter his heirs &
assigns shall & will Warrant & forever Defend by these Presents
against any person or Persons whatsoever [having] or lawfully Claiming
any Estate Right Title or [interest in &] to the same or any
part & parcel thereof & the said Alexander Henderson for
himself his heirs assigns & administrators Doth Covenant Grant
& agree [to and with] the said John McWhorter his heirs &
assigns in manner & form following (that is to say)
that he the said Alexander Henderson at the time of the sealing
& Delivery of these Presents is & [Stands?] Seized of an
Indefeasable Estate of Inheritance in fee Simple in the said Land
& premises [and hath] full Power & authority to Sell &
Convey the same in manner & form aforesaid & that he the
said John McWhorter his heirs & Assigns Shall & may forever
hereafter peaceably hereby have hold possess & Enjoy all &
Singular the premises with the appurtenances without the [or molestation]
of any person or persons whatsoever having or lawfully Claiming
any Estate right Title or Interest in or to the same or any part
thereof and that the said tract of Land & premises with the
appurtenances [shall] [forever] hereafter remain unto the said John
McWhorter his heirs & assigns free & discharged of &
from all [former] and other Estate rights Titles Dowers Debts [Judgments]
[Executions] & other Incumbrances whatsoever and lastly that
the said Alexander Henderson & his heirs shall & will at
any time within twenty years next after the Date of these Presents
to execute any other act or acts or Conveyance or Conveyances necessary
in the law for the further [a--ing] & Conveying the said Land
& premises with appurtenances unto the said John McWhorter his
heirs & assigns as by the said John McWhorter his heirs &
assigns or his Counsel Learned in the Law shall be advised or required.
In Witness whereof the said Alexander Henderson hath hereunto
set his hand & affixed this Seal the Day & year above written.
