Will of John Kirk, Decd.
In the name of God Amen I John Kirk of Donegall Township in Washington County & State of Pennsylvania being sick and weak in body but of sound mind memory and understanding praised be God for it; and considering the certainty of death and the uncertainty of the time thereof and to the end I may be better prepared to leave this world whenever it shall pleas (sic) God to call me hence do therefore make and declare this my last will and Testament in manner following that is to say first and principally I commend my soul into the hands of Almighty God my Creator hoping for a free pardon & remission of all my sins and to enjoy everlasting hapiness (sic) in the heavenly Kingdom through Jesus Christ my saviour my body I commit to the earth at the discretion of my after named executor. And I order that immediately after my decease all my personal property be sold, out of the proceeds of which I direct that my funeral expences (sic) & just debts be paid my real property consisting of about fifty five acres of land I leave to my son Isaac and his heirs to be for his or their entire use & disposal under or subject to the following provisions viz. Within three months after my decease my heirs Isaac William Alexander Jesse Thoams Samuel and John my sons and John Mill the husband of my daughter Sarah or their representatives or a majority of them all having notice given them for the purpose shall choose three or five judicious citizens of the vicinity to value or appraise my said real estate (if my said heirs cannot agree on the price amongst themselves) the value set upon the said land shall be final and conclusive, and be divided as follows. I direct the if, there be any balance of my debts unpaid from the sale of my personal property that my son Isaac pay the same and the sum of fifteen dollars be paid Elisabeth McNeal who is by Indenture bound to me, then all the ballance (sic) from my real & personal estate shall be equally divided amongst my heirs and to be paid by my son Isaac to his brothers and sister he returning the one eighth to himselfe I hereby appoint and constitute my said son Isaac Kirk to be the sole Executor of this my last will and Testament. And do hereby revoke all former wills by me heretofore made and declare this and this only to be my last will and Testament. In Witness whereof I John Kirk Have hereto set my hand and seal this twenty sixth day of June in the year of our Lord One thousand eighth hundred and thirty seven.

I John Kirk, the Testator and subscriber to the above Instrument of writing declared by me to be my last will and Testament, do add the following thereto as a Codicil and is to be concidered as a part of the same will & testament and in pursuance of which I order and direct that my son Samuel of my personal property be entitled to the bright bay colt three years old last spring the bed and beding (sic) which he is in the habit of sleeping upon One hieffer moiley (sic) calf six or seven months old, and also one third of the spring grains also the third of all that has been seeded on my place this fall and is to have a sufficiency of the present corp (sic) of hay to winter his said colt, upon and further he shall be entitled to his choice of three best hogs from amongst the whole of my hogs.
In testimony of which being a part of my will preceeding this codicil I hereto set my hand and seal this seventeenth day of October in the year of our Lord One thousand eight hundred and thirty seven.

Washington County ss. Be it remembered that on the 3rd day of October A. D. 1837 Before me Saml. Cunningham, Register for the probate of Will and granting letters of Administration in and for said County came David Frazier Esq. and Samuel Flack the subscribing witnesses to the within last will and Testament of John Kirk deceased with a Codicil annexed thereto who being duly sworn as the law directs doth dispose and say that they were personally present and did see the Testator therein named execute this will & codicil that they heard him publish pronounce and declare the same as and for his last will and testament at the same time he did so he was of sound and disposing mind memory and understanding to the best of their knowledge observation and belief.
