2. NOTES ON THOMAS ROSE’S WILL.

When Thomas Rose died in 1837 he bequeathed all his household goods and all his furniture to his wife Sarah. To Joseph Perkins, son of Sarah Perkins, the widow of Richard Perkins, he left his farm on the Nepean River, consisting of several grants from Governor Macquarie. One of eighty acres originally made to John Burgess on 1.1.1810 and the other to Richard Perkins on 8.10. 1816. Plus a farm at Curryjong of fifty acres, granted by Governor

Macquarie to Patricia Clarke on 1.1.1810, purchased by Thomas Rose from Thomas Baker on 13.6.1803. Also his dwelling house at Windsor with the land purchased from Robert Thurston, and also his dwelling house at Richmond with land, purchased from George Morley to HOLD these several farms for the use of Joseph Perkins forever. To Ann Perkins, daughter of Sarah Perkins, Thomas bequeathed his farm in the district of Airds of sixty three acres, granted by Governor Macquarie to William Mortimer on 20.6.1816, purchased by Thomas Rose from W. Mortimer, and also other farm adjoining there in the district of Airds of one hundred acres, granted by Governor Macquarie to James Fletcher on 20.6.1816, purchased by Thomas Rose from representatives of John Boodle to hold to Ann Perkins forever. To Mary Perkins, daughter of Sarah, Thomas Rose bequeathed the farm in the district of Airds of twenty eight acres, granted by Governor Macquarie to Francis McDonald on 13.6.1823, purchased from F. McDonald and also a farm in Airds of thirty acres by Governor Macquarie to Bernard ?oran on 17.8.1819, plus a farm in Airds of thirty acres by Governor Macquarie to Peter Lillas on 8.10.1816, plus a farm in Airds of forty acres granted by Governor Macquarie to Thomas Acres Senior on 8.10.1816, purchased from Joseph Inch. Plus a farm in Airds of thirty acres by Governor Macquarie to Thomas Macquarie on8.10.1816, purchased from James Osman.

To Jane Perkins, daughter of Sarah Perkins, Thomas Rose bequeathed his farm at Richmond on the Hawkesbury River, commonly called Cropley's Farm, otherwise Fulham Park of one hundred and thirty acres by Govemor William Paterson Esq. on 7.9.1795.29

To James Hannibal Rose, son of Thomas Rose, he bequeathed six hundred and sixty acres of land in County Murray, granted to him by Governor Bourke on 7.3.1832. Plus Estate and interest of eighty acres in County Murray, granted by Governor Bourke. Plus six hundred acres in County Murray (Thomas Rose's Stock Station) called Mandoon. Plus one third part or share of horses, cattle, sheep and livestock. Plus dwelling house in Castlereagh Street, Sydney, then used as Public Inn of Rose and Crown. Plus the land and farm in district of Botany Bay of one hundred and twenty acres.

To John Henderson, Thomas Rose's son in law, he bequeathed one third share of livestock. Plus one third share of livestock to Kezia Jane Rose, his daughter. To Thomas Rose's Trustees, James Hannibal Rose and John Henderson, he bequeathed his farm of three hundred acres in the district of Airds by Governor Brisbane. To his daughter Kezia Jane, fifty acres, forty acres, fifty acres plus all of Mount Gilead. The trustees were to pay his wife, Sarah Rose (nee Pye), one thousand pounds per annum, so long as she retained the possession of the house he then resided in. Thomas Rose's will was made on November 5, 1833. Trustees were James Hannibal Rose and John Henderson. On March 2, 1837, Thomas Rose then appointed new executors of his will, being James

WILL OF SARAH ROSE

I Sarah rose of Campbelltown in the Colony of new south Wales, widow, Revoke all wills by henceforth made and declare this only to be my Last Will and Testament. I give and devise unto my son Ruben Uther Bartlett Rose all those my two farms situate in the Parish of Saint Peters in the County of Cumberland in the said Colony. Being lots one and two of the Eagle Vale Estate, containing eighty two acres and three roods, and eighty two acres, respectively; and conveyed to me by my said son by Indenture dated the twenty seventh day of June One Thousand Eight Hundred and Sixty. To hold the same unto my said son Reuben Uther Bartlett Rose and to his heirs for his and for their use and benefit, on condition, that he and they accept the same in full satisfaction and discharge of all claims, for in respect of the annuity and all arrears thereof charged upon the lands by the above mentioned indenture, and also in satisfaction and discharge of all claims and demands he or they may have upon me at the time of my death, howsoever arising. I charge the personal estate and effects herein bequest to my son Alfred Marson Nash Rose with the payment of my funeral expenses and subject thereto, I give and bequeath to the said Alfred Marson Nash Rose all my furniture, plate glass, linen, books and pictures and articles of food or consumption, and also all my cattle, horses, harness, corn, grain, hay, straw, farming instruments and utensils; which may be in and about my residence at the time of my death. I give and bequeath all the residue of my real and personal estate (except estates vested in me as Trustee or Mortgagee) whatever and wheresoever situate unto my sons Charles Henry Jacob Rose, and the said Rueben Uther bartlett Rose and my Daughters, Hannah Rebecca Pye Payton and Sarah Elizabeth Jane Payten, their heirs, executors and administrators, to be divided amongst them in equal shares. I appoint Richard Yeomons of Sydney, Solicitor, Executor of my will and I give and devise to him and his heirs all estates vested in me as Trustee or Mortgagee. To hold subject to the several trusts equities of redemption or other equities affecting the same. I declare that the receipts of the said Richard Yeomons or other, the person asking for the time being in the Execution of the Trusts hereof shall effectually ??????? All persons paying or transferring money or securities for money to him from all responsibility in respect of the application of the moneys so received. This day upon Petition Probate of the last Will and Testament of Sarah Rose deceased was granted to Richard Yeoman’s the sole benefactor in the said will named. Testator died the 20^th Day of June 1869. Goods sworn at 200 pounds. Probate dated the same day as granted.
