Between Jane Hodsoll of Ash Next Ridley in the County of Kent Spinster one of the sisters and coheirs of John Hodsoll late of Saint Mary Cray in the said County of Kent Gentleman Deceased of the first part, Thomas Copland of Meopham in the said county Gentleman and Edward Holt Of Dover in the said county Gent of the second part and Samuel Atwood of Ash next Ridley aforesaid Clerk of the third part WITNESSETH That as well for and in Consideration of a Marriage Intended shortly (by the favour of Almighty God) to be had and solemnised by and between the said Samuel Atwood and Jane Hodsoll as also for and in consideration that the said Samuel Atwood by Articles of Agreement Tripartite indented bearing even date with these presents and made between the said Samuel Atwood of the first part and the said Thomas Copland and Edward Holt of the second part and the said Jane Hodsoll of the third part HATH covenanted to lay out and expend within the space of three years after the solemnisation of the said marriage the sum of Two Thousand pounds in the purchase of fee Simple messuages lands tenements and hereditaments in the said County of Kent or some other county within thirty miles of London and to convey settle and assure the same in such manner and for such uses intents and purposes as therein are mentioned and limited and also for and in consideration to the intent and purpose that the undivided quarter or fourth part of and in the several messuages or tenements lands reversions hereditaments and appurtenances hereinafter mentioned may be conveyed settled and assured to and for the several uses intents and purposes as are hereinafter mentioned limited and declared and for diverse other good and valuable causes and considerations her the said Jane Hodsoll hereunto moveing she the said Jane Hodsoll (or and with the knowledge and consent of the said Samuel Atwood testified by his being a party hereto and sealing and delivery hereof) HATH granted bargained sold remised released quitt claimed and confirmed and by these presents DOTH grant bargain sell remise release quitt claim and confirm unto the said Thomas Copland and Edward Holt ^their heirs and assigns^ (they the said Thomas Copland and Edward Holt in the actual possession now being by force and virtue of one Indenture of Bargain and sale to them thereof made by the said Jane Hodsoll bearing date the day next before the day of the date hereof for one whole year commencing at Michaelmas now last past and by force of the statute for transferring of uses into possession) and to their heirs and assigns forever. ALL That her undivided quarter or fourth part the whole in four equal parts to be divided and all other her part share and purpart (?) whatsoever xxxxxxxxxxx of and in all that Capital messuage or mansion house with the Barne Yard Garden and appurtenances thereunto belonging as the same are inclosed with a brick wall next the street and church yard of Saint Mary Cray aforesaid now or late in the tenure or occupation of (blank) and bounding on the river Cray on the west and of and in all those two tenements or cottages with the garden plots thereunto belonging situate and being on the bankside of the barn belonging to the aforesaid Capital messuage and lying between the ^said?^ river and the street of Saint Mary Cray aforesaid now in the several tenures of Richard Inkpin and John Sehns(?) all which capital messuages tenements and premises are situate lying and being in Saint Mary Cray aforesaid and also of and in all those two closes or parcels of land commonly called or known by the several names of Letts Mead and Letts Field containing together by estimation twelve acres more or less now in the several tenures of (blank) and are situate and being in the parish of Pauls Cray in the said county of Kent and also of and in all that messuage or tenement with the wheelwrights shop yards stables outhouses and buildings bankside and garden with the appurtenances situate in Pauls Cray aforesaid now in the tenure of Jonathan Furlonger and of and in all those two peices or parcels of arable land lying above the said last mentioned messuage and heretofore therewith used and now in the tenure of (blank) AND ALSO of and in all that messuage or tenement commonly called or known by the name of the Blew Anchor with the barn stable and yard on or near which formerly stood a malthouse with the appurtenances situate and being in Pauls Cray aforesaid now in the occupation of Edward Everest the Elder and of and in one messuage or tenement to the said last mentioned messuage adjoining on the north side thereof and now in the tenure of Edward Stone and also of and in all that peice or parcel of arable land situate and being at the foot of Lissons Hill in Pauls Cray aforesaid and now in the occupation of the said Edward Everest or his assigns and also of and in all those eight severall peices or parcels of arable land with the appurtenances containing together by estimation twenty six acres more or less and known by the several names of Martyns Field Tyth Bushy Croft the Grove Upfield Burn Ash and Burnecroft lying together on Lissons Hill next the roadway leading from Saint Mary Cray to London on the North side thereof And in the parish of Pauls Cray aforesaid and now are in the tenure of the said Edward Everest his assignee or assigns and also of and in all that messuage or tenement commonly called or known by the name of the Pheasant House with the barne Stable Yard Garden and Orchard thereunto belonging and of and in all those two several Closes of arable land formerly divided into three parcels and lying near the said messuage now in the occupation of George Wybourne or his assigns and are lying and being in Pauls Cray aforesaid and also of and in all that messuage or tenement two orchards and two peices of arable land containing together by estimation six acres more or less lying and adjoining to Pauls Cray Heath and in the parish of Pauls Cray and now in the occupation of John Mock or his assigns and also of and in the revertion in fee expectant from and after the death of Elizabeth Hodsoll mother of the said Jane Hodsoll of and in ^all that^ the moiety or halfe part of all that capital messuage or tenement with the barns stables coachouse dovehouse outhouses and appurtenances and of and in the moiety or half part of all the orchards lands meadow and pasture grounds thereunto belonging containing about (blank) acres more or less as the same were in the occupation of Edmund Hodsoll the late deceased father of the said Jane Hodsoll and now of the said Elizabeth Hodsoll and situate lying and being in Saint Mary Cray aforesaid and also of and in the revertion in fee expectant from and after the death of the said Elizabeth Hodsoll of and in all that messuage or tenement with the orchards lands and appurtenances thereunto belonging as the same late were in the occupation of Thomas Carrier since of Daniel Killick and now of Sarah Killick widdow or her assigns containing about fifty acres more or less and called or known by the several names of Great Banden the forestall Burfields and Leckendens or by whatsoever other name or names soever the same called or known situate lying and being in Saint Mary Cray aforesaid AND ALSO of and in all those two peices or parcells of land called Lyntens [Lyntons] lying in Saint Mary Cray aforesaid containing ten acres more or less as the same late were in the occupation of the said Thomas Carrier and now of the said Sarah Killick or her assigns all which last mentioned moiety messuages lands and premises were given and revised by the said Edmund Hodsoll deceased in and by his last will and testament to the said Elizabeth Hodsoll for her life AND ALSO all that her quarter or fourth part the whole in four equal parts to be divided and all other her part share and purpart whatsoever of and in all that other moiety or half part of and in all that the aforesaid last mentioned capital messuage or tenement with the barns stables coachhouse dovehouse outhouses land and appurtenances before mentioned to be in the occupation of the said Elizabeth Hodsoll and situate in Saint Mary Cray aforesaid AND ALSO of and in all those several parcels of land arable pasture and wood commonly called or known by the several names of Leadhills Riddons Sheepcoates and MENTIONED to be in the occupation of the said Sarah Killick usually occupied and enjoyed AND ALSO of all and in all that piece or parcel of land called Seale Banks now divided into three parts containing by estimation twelve acres more or less and also of and in one piece or parcel of land adjoining to the said Seale Banks on the east side and containing by estimation nine acres more or less which last mentioned parcels of land were in the tenure of the said John Hodsoll deceased and now of Thomas Chapman or his assigns and are situate in Saint Mary Cray aforesaid AND ALSO of and in all that Tylehouse Tilekiln with the appurtenances and of and in all those several pieces or parcels of land arable pasture and woodland with the appurtenances therewith used and enjoyed containing together in the whole by estimation eighty and five acres more or less situate lying and being in Saint Mary Cray aforesaid and now in the several tenures of John Miller and Thomas Mosyer or their several assigns AND ALSO of and in all that messuage or tenement called or known by the name of Spicers ats frog poole with the outhouses barns stables orchards gardens lands and appurtenances containing together by estimation six acres more or less situate lying and being in Saint Mary Cray aforesaid and were lately purchased by the said Jane Hodsoll deceowed of John Abbott and now in the occupation of (blank) (except one little piece of land containing about half an acre parcel of the same premises soe purchased and since sold by the said John Hodsoll deceased to Stephen Parker Esquire AND ALSO of and in all those several peices or parcells of land arable pasture and wood lately purchased by the said John Hodsoll deceased of George Start and others situate in Saint Mary Cray aforesaid and doe contain together by estimation seventeen acres more or less AND ALSO of and in all that capitall messuage or tenement commonly called Crowers [Farme] with the barne stable outhouses Edificies and buildings yards gardens and orchards and all those several pieces or parcells of land arable meadow pasture and wood with the appurtenances as the same now are in the tenure or occupation of Thomas Stevens and do contain together by estimation one hundred acres more or les and are situate lying and being in the parish of Kingsdowne [Kinsdowne] in the said county of Kent AND of and in all those several pieces or parcells of woodland with the appurtenances to the said Farme called Crowers adjoining and belonging as the same late were in the tenure of the said John Hodsoll in the parish of Stansted aforesaid and now in the occupation of Robert French his assignee or assigns AND also of and in all and singular other the messuages lands tenements revertions and hereditaments with their appurtenances whatsoever and wheresoever within the said county of Kent or elsewhere whereof the said John Hodsoll died seized and not hereinbefore particularly mentioned and described and the revertion and revertions remainder and remainders of all and singular the premises aforesaid with the appurtenances and also of and in all houses outhouses edifices buildings yards gardens orchards ways easements ponds profitts commodityes woods underwoods hedges hedgerows pastures feedings commons common of pasture rents hereditaments privileges and appurtenances whatsoever to the aforesaid several messuages or tenements revertions lands and hereditaments with the appurtenances whatsoever belonging or in any wise appertaining TO HAVE AND TO HOLD the said quarter or fourth part of and in all and singular the aforesaid messuages or tenements revertions lands hereditaments and appurtenances whatsoever into the aforesaid Thomas Copland and Edward Holt their heirs and assigns to and for the several uses intents trusts and purposes hereinafter mentioned limited and declared (That is to say) to the use and behoote of her the said Jane Hodsoll and her heirs untill the said intended marriage between the aforesaid Samuel Atwood and Jane his intended wife and of the survivor of them for and during the term of their two natural lives and the natural life of the longer liver of them without impeachment of waste and from and immediately after the decease of the survivor of them the said Samuel Atwood and Jane his intended wife to the use and behoote of the heirs of the body of the said Jane Hodsoll by the body of the said Samuel Atwood lawfully begotten and to be begotten and for and in default of such issue to the sole and only proper use and behoote of the survivor of them the said Samuel Atwood and Jane his intended wife and of the heirs and assigns of such survivor forever and to and for no other use or uses intents or purposes whatsoever AND THE SAID Jane Hodsoll for herself her heirs executors and administrators doth covenant promise and grant to and with the said Thomas Copland and Edward Holt their heirs executors administrators and assigns by these presents in manner following (That is to say) that she the said Jane Hodsoll at the time of the insealing and delivery of these presents hath of and in herself good rightful power and lawful and absolute authority to convey settle and assign the said quarter or fourth part of and in the said several messuages lands tenements revertions and hereditaments with the appurtenances to and for the several uses aforesaid and in manner aforesaid according to the true intent and meaning before expressed AND ALSO that the same premises with the appurtenances whatsoever shall from time to time and at all times hereafter remain continue and be to and for the several uses intents and purposes hereinbefore mentioned specified and declared AND LASTLY the she the said Jane Hodsoll and her heirs and all and every other person or persons lawfully claiming or to claim any estate right title or interest in or to the premises aforesaid with the appurtenances or any part thereof by from or under the said Jane Hodsoll her heirs or assigns shall and will from time to time and at all times hereafter upon the reasonable request of the said Thomas Copland and Edward Holt their heirs or assigns make do acknowledge levy execute and suffer or cause and procure to be made done acknowledged levied executed and suffered all and every such father and other lawful and reasonable act and acts thing and things devices assurances and conveyances in the law whatsoever which shall or may be for the further better surer and most perfect settling assigning and confirming of the premises aforesaid with their appurtenances to and for such several uses intents and purposes as are hereinbefore mentioned limited specified and declared be it by fine recovery deed or deeds inrolled release confirmation livery of seizin deed of partition or by any other lawful ways or means whatsoever as by the councell of them the said Thomas Copland and Edward Holt their heirs or assigns learned in the law shall be reasonably revised advised or required which said further assurance and assurances to be had and levied of the premises aforesaid or any part thereof with the appurtenances whatsoever if or they shall be and ennure and shall be adjudged deemed construed and taken to be and enure is and are hereby hereinbefore mentioned limited specified and declared concerning the same and to & for none other use or uses intents or purposes whatsoever IN WITNESS whereof all the said parties for every part of these presents indentures their hands and seals have set the day and year written ---------------
