This is the last Will and Testament of me Edward Nepecker of Pluckley in the County of Kent Gent[leman] made ordained published and declared this Tenth day of July in the Ninth Year of the reign of our sovereign Lady Anne by the grace of God of Great Britain, France and Ireland, Queen Defender of the Faith etc. Anno dini 1710

Impr[im]is I give devise and bequeath unto Susan my dear and loving wife all my messuages Tenements Farmes Lands Woodlands Marshlands and all and their and every of their rights members and appurtenances whatsoever And also all my household Goods, husbandry, Tackling, Cattle, Hogs, Corn in the ground and otherwise and all other my Goods, Chattells, Cattle, ready money, Debts and all other my Estate whatsoever and wheresoever as well reall as personall upon the trusts and to the uses intents and purposes hereinafter particularly mentioned and expressed (that is to say)

Upon trust and confidence that she my said wife with all convenient speed after my decease sell and dispose of such part or parts parcell or parcells of my said Messuages Tenements Lands and Hereditaments as she shall see convenient and with the moneys arising by such Sale or Sales do pay and discharge all my just debts whatsoever

And as to the Residue of the money arising by such Sale or Sales and all other my Lands, Tenements, Hereditaments, Goods, Chattells and Estate as aforesaid my will and mind is the same shall remain and continue in the hands of my said wife for and during the term of her naturall life if she shall so long continue a widow (She maintaining, educating and bringing up my Children till they severally & respectively attain their severall and respective ages of three and Twenty Years)

And my will and mind is and I do hereby give unto my said wife full power and Authority as long as she shall continue a widow as aforesaid to give & dispose of my said Estate both reall and personall unto and amongst my Children either in her lifetime or by her last Will and Testament in writing or by any Instrument in writing purporting her last Will Signed Sealed and Published in the presence of three or more Credible Witnesses in such parts and proportions at such time and in such manner and form as to her shall seem meet and convenient
And in case my said wife shall not dispose of my Estate in her life time or by her last Will and Testament in writing as aforesaid then my Will and mind is that my said Estate of sufficient thereof as shall remain and disposed of shall be equally divided between all such of my children as shall belong at the decease of my said wife

Provided nevertheless and it is the true intent and meaning of this my Will that if my said wife do intermarry again after my decease that then and in such case she my said wife shall and do within one Month next after her intermarriage surrender and deliver up all such part of my Estate as shall then remain in her hands unto Thomas Godfrey of Ebony in the Isle of Oxney in the County abovesaid in trust for and to and for the equall benefit of all my Children

And I do hereby desire authorize and impower the said Thomas Godfrey by any lawfull and reasonable ways and means to compell my said wife in case she shall intermarry again as aforesaid to surrender and deliver up to him all such part of my Estate as well reall as personall as shall then remain in her hands
And the same when reseaved [received] and obtained to distribute and divide amongst all my Children as aforesaid in equall parts and proportions (by first paying and deducting to himself thereout for all such reasonable trouble costs charges and expences he shall sustain expend or be put unto in and about the execution of the trusts hereby in him reposed)

And I do hereby nominate constitute & appoint the said Susan my wife to be sole Executrix of this my last Will and Testament
And the said Thomas Godfrey to be Overseer thereof who I desire to aid and assist my said Executrix in the due execution of this my Will
And Lastly I do hereby revoake all former and other Wills by me heretofore made and declare this only to be my last Will and Testament
