This is the last Will and Testament of me Daniel Noakes of Deal in the County of Kent and a Lieutenant of and on board his Majesty�s Ship Alligator whereby considering the dangers of the Sea and the uncertainty of this life and for avoiding controversies after my decease I recommend my Soul to God and dispose of my Worldly Estate and Effects in manner following that is to say

First and Principally I do subject and charge the whole of my Real and Personal Estate and Effects hereinafter given devised and bequeathed with the Payment of all singular my debts Funeral Expences and the Costs and Charges attending the Probate and execution of this my Will

I give and devise all and singular my Freehold Messuages Land Tenements and Hereditaments situate lying and being at Walmer in the County of Kent or elsewhere in the Kingdom of Great Britain whereof wherein or whereto I am any ways seized or over which I have any disposing right or power unto my dear Aunt Mary Sutton Widow of Daniel Sutton of Upper Deal in the County of Kent her Heirs and Assigns for ever

All the rest of my Property such as money Securities for money Prize money that is or may be due to me at the time of my decease Household Goods Plate Linen and all other my Personal Estate and Effects of what nature or kind soever the same shall or may consist at the time of my decease I give and bequeath the same unto my dearly beloved wife Elizabeth Noakes her Executors Administrators and Assigns absolutely

Provided always that in case of her my said Wife marrying a second time then I will that within the space of six Calendar Months after such Marriage that the Sum of Five hundred Pounds lawful money of Great Britain be paid by her the said Elizabeth Noakes unto my Godson and Nephew George Noakes Son of my Brother George Noakes of Deal in the County of Kent
in case he should not be living then and in that case I will that the said Sum of Five hundred Pounds be equally divided among the Children of my Brothers and Sister

And hereby revoking and making void all former and other Wills by me heretofore made I publish and declare this my last Will and Testament only and thereof I nominate constitute and appoint my dear Wife Elizabeth Noakes my sole Executrix

In Testimony whereof I the said Daniel Noakes have to this my last Will and Testament set my hand and Seal this 25th of July in the year of our Lord 1793 Daniel Noakes

John Burrows 2nd Lieutenant H M Ship Alligator _ Richard Lee Lieut of Marines of said Ship _ Wm Clapp Purser of the said Ship

N.B. as this Will is not drawn up by an Attorney the Ship to which I belong being now at Sea it cannot be expected it is drawn up altogether consistent with that regular form observed by the Law yet I hope that no controversy will take place on that account but should there be any I trust the more learned Gentlemen of the Law will have Candour and Honour to comly with the true intent and meaning of this my Will and as there are some particular Friends and Relations to whom I would wish to give a something without distressing my dear Wife so I hope tho� small they will be pleased to accept it as a mark of love and esteem for them I will that the persons hereafter named shall each of them receive a Gold Ring not exceeding in value two Guineas to be given them by my Executrix so soon as convenient may be after my decease Viz

First my Father Mr John Noakes of Mongahan my Mother in Law his Wife my Aunt Mrs Mary Sutton to each of my Brothers and to my own Sister
to my Sister in Law Miss Ann Williams
to my good Friends General Smith and to my Friend George Leigh Junior
my Friend William Dunbar I cannot forget and beg that he will with all those above mentioned may receive one each

I have been under the necessity of omitting one thing which causes me concern and that is not being able to hit upon any plan of giving a certain something which might Contribute to the comfort of my Aunt Elizabeth Hardes but I have the satisfaction to know she cannot want and that my dear Betsy will be good to her in my account

having finished this my Will satisfactory to myself I heartily hope it will prove so to all whom it may concern most particularly so to my dear Betsy for whom I have done everything consistent with my ideas of Strict Justice May God Almighty protect and make her happy
