I Barbara Oldfield of Number 3 Frederick Place, Sandy Hill in the Parish of Plumstead in the County of Kent Widow do make this my last Will and Testament as follows

I give and bequeath my leasehold messuage and premises No. 22 in Gilbert Street, Grosvenor Square in the County of Middlesex with their appurtenances for all my term and interest to come therein And also all other my Estate and Effects of every kind unto my Son John Pearson Oldfield residing at No. 3 Frederick Place, Sandy Hill in the Parish of Plumstead in the County of Kent aforesaid, Printer and unto John Witherspoon of No. 47 Artillery Place, Woolwich in the County of Kent aforesaid, Bootmaker, their executors administrators and assigns

Upon Trust for my four Children John Pearson Oldfield the aforesaid, James Woodward Oldfield, Henry Borgman Oldfield and Ann Oldfield in equal shares as tenants in common and for their respective executors administrators and assigns Nevertheless made and subject to the directions and provisions hereinafter expressed and contained

And I direct that after making all necessary payments for ground rent and for reparation and insurance of or on any other account in respect of my said leasehold premises out of the yearly income to arise from the said trust premises and estate and the said Trustees shall out of the surplus of such income expend and apply forty pounds per year for and towards the maintenance and education of my said youngest Son Henry Borgman Oldfield and my said Daughter Ann Oldfield until she shall have attained the age of twenty one years

And if there should be any excess of the said yearly income after making the payments aforesaid and expending the said forty pounds per year, then I direct that such excess shall from time to time be placed out by the said Trustees in their names in Stock in the Bank of England to accumulate for the benefit of my two eldest Sons John Pearson Oldfield and James Woodward Oldfield in equal shares which accumulations shall be divided and had between and by them at the time when my said Daughter shall attain her age of twenty one years
But should my said Son Henry Borgman Oldfield and Daughter Ann Oldfield severally die before having attained his or her age of twenty one years then the said accumulations (if any) shall be divided and had between and by my said two eldest Sons upon the decease of the survivor of them my said Son Henry Borgman Oldfield and Daughter Ann Oldfield

And I further direct that upon the youngest or the youngest surviving of my said four Children having attained his or her age of twenty one years the said trust premises and estate not herein otherwise disposed of shall be divided and assigned, paid and delivered in equal parts or shares between and to my said four Children hereinbefore named or the survivors of them (if more than one) for their his or her respective absolute use and benefit

Provided always and my will is that notwithstanding the direction for accumulation hereinbefore contained the excess of the yearly income to arise from the said trust premises and estate after making the payments aforesaid And after the application of the said forty pounds per year shall be applicable (if needed by the said Trustees towards paying the expences of the board and lodging and clothing of my said Son John Pearson Oldfield until he attains his age of twenty one years and also of my said Son James Woodward Oldfield until he attains his age of twenty one years in such proportions as the said Trustees shall in their discretion think proper

And I also direct that my household goods and effects shall be sold and disposed of by the said Trustees as soon as convenient after my death either by public sale or private valuation as they shall consider best and the nett proceeds to arise from such sale shall be invested in their names in Stock transferable at the Bank of England which Stock is to form part of the said Trust Premises and Estate and to be held subject to the trusts and other directions hereinbefore expressed in all respects

I appoint the said John Pearson Oldfield and John Witherspoon Executors of this my said Will
And I declare that heir receipts shall be good discharges for monies paid to them or either of them and there shall not be any obligation on any other person or persons to see to the application thereof I also declare that the said Trustees and Executors shall not be liable for any loss which may happen of in or to any of the said trust premises and estate or any part thereof unless the same shall happen through their wilful neglect or default And that neither of them shall be responsible for the acts deeds receipts payments or wilful neglect or default of the other of them but each for his own acts deeds receipts payments or wilful neglect or default only

And that the said Trustees and Executors shall and may out of any monies to be received by them or either of them by virtue hereof deduct and retain to and reimburse themselves respectively and allow and pay to his Co trustee and Co Executor all such costs charges payments losses damages and expences which they or either of them shall incur make suffer or sustain or be put to in or about the Trusts and Executorship of this my Will or any matter or thing whatsoever relating thereto in any manner heresoever

And lastly I declare that I do not intend to discharge my said Executors or either of them from the payments of any sum or sums of money which they or either of them may be indebted to me at the time of my death

In Witness whereof I the said Barbara Oldfield have to this my said last Will and Testament contained in three sheets of paper set my hand at the foot of the first sheet and also the second sheet and also to this third and last sheet thereof the third day of May in the year of our Lord one thousand eight hundred and forty nine

Signed and published by the said Testatrix Barbara Oldfield as and for her last Will and Testament in the presence of us who at the same time in her presence at her request and in the presence of each other have subscribed our names as Witnesses
John Myers Boddy, 36 Artillery Place (Bookseller) Woolwich - Lucy Boddy, of the same place

Proved at London the 10th June 1850 before the Worshipful Alfred Waddilove Doctor of Laws and Surrogate by the Oath of John Witherspoon one of the Executors to whom Adm[inistrati]on was granted having been first sworn duly to administer
Power reserved of making the like grant to John Pearson Oldfield the Son the other Executor when he shall apply for the same

Notes:
John Pearson Oldfield was born 1st June 1829 and baptised 28th June 1829, s. of John and Barbara Oldfield, at St. James, Piccadilly, Middlesex.
John Oldfield and Barbara Powell, both of St. George, Hanover Square, MDX, were married at St. George in 1828.
Barbara Oldfield aged 50 was buried on 17th December 1849 at St. George, Hanover Square, Middlesex.
