This is the last Will and Testament of me John Osborn of Sandhurst in the County of Kent Bricklayer

I appoint John Upperton of Hawkhurst in the said County of Kent and George Hopkins also of Hawkhurst aforesaid Gentleman and Jarvis Munn of Sandhurst aforesaid Shoemaker to be Executors of this my will

I give unto my Cousin Elizabeth Chapman of Hawkhurst aforesaid widow my Bible and Testament
To my Cousin Ann Sandhurst of Hurstgreen in the Parish of Salehurst in the County of Sussex the sum of twelve pounds
To my Cousin Martha the wife of John Dobell of Milkhouse Street in the Parish of Cranbrook in the said County of Kent the sum of twelve pounds

and as to All the Residue of my Personal Estate and as to all my real estate if any such as I shall die possessed whatsoever and wheresoever (except estates vested in me upon any trust or by way of mortgage) I give and devise the same unto my said executors Upon trust with all convenient speed after my decease to sell my real estate together or in parcels by public auction or private contract and to convert and get in my residuary personal estate and to stand possessed of the monies to arise from such real estate and residuary personal estate

Upon trust in the first place for the payment of my just debts funeral and testamentary expences and after such payment
Upon trust to pay one third part to my Cousin the said Elizabeth Chapman
One other third part thereof to her sister Sarah Osborn of Hawkhurst aforesaid spinster
and the remaining third part thereof to her sister Mary Freeman of Biddenden in the County of Kent widow
But in case the said Sarah Osborn shall die in my lifetime then I give the share so as aforesaid directed to be paid to her equally amongst the children living at the time of my decease of the said Elizabeth Chapman and Mary Freeman

I devise all estates if any vested in me upon any trusts or by way mortgage unto the said John Upperton and George Hopkins subject to the trusts affecting the same respectively I declare that the receipts of my said executors for any monies stocks or securities which shall be paid or transferred to them by virtue of this my will shall effectually discharge the persons paying the same from liability to see to the application thereof

And I declare that my said executors shall have power to adjust or compromise any of my debts or credits if they shall think it expedient so to do And further that they shall be answerable for their own respective acts receipts and defaults only and shall be at liberty to retain to and allow to each other out of monies coming to their hands by virtue of my will all reasonable expences incurred in executing the trusts thereof
And I declare that the powers hereinbefore given to my said Executors shall extend and be applied to the executors and executor for the time being of my will

In witness whereof I have hereunto set my hand this twentieth day of March one thousand eight hundred and forty one
