Item I give and devise all that my Messuage or Tenement with the backside or yard and all and every the appurtenances thereunto belonging situate lying and being in Folkstone aforesaid in a certain street there called Durelucks and now in the tenure or occupation of Richard Hall unto Mary my beloved Wife for and during the whole time and term of her natural life
And Immediately after the decease of her my said wife I then give and devise all the said Messuage or Tenement with all and every the appurtenances unto my daughter Mary the wife of Richard Hall to her and her heirs for ever
She or they paying out of the same one shilling unto my said son Thomas Penny at three months next
after she my said daughter shall be in legal possession of the said Messuage and premises
and paying also the further sum of ten pounds of lawfull money of Great Britain at six months next after
being in possession as aforesaid unto my grandson Thomas Penny
and also the like sum of ten pounds at six months as aforesaid unto my grandson John Penny
And in case of default in the payment of the several legacys at the respective times aforesaid that then it shall and may be lawfull to and for my said son Thomas Penny and my said grandson Thomas Penny and John Penny either or any of them their or either of their assigns to enter into and upon the said premises and to receive the rents and profits for their use and uses until the said Legacys herein before given unto them and all costs and charges which shall accrue by reason of non payment shall be fully unto them paid according to the true Intent and meaning hereof
Item I give and devise all and every my household goods chattels and personal Estate whatsoever and wheresoever (after my just debts funeral expences and charges of proving and executing this my last Will and Testament shall be fully paid and satisfied) unto my said wife for and during her natural life
And after her decease I give and devise my clock and clock case and two best beds with the furniture and four pair of sheets one damask table cloth and six diaper napkins unto my daughter Mary the wife of Richard Hall
Item all the rest residue and remainder of my goods chattels and personal Estate I give and devise one
third part thereof unto my son Thomas Penny
and one other third part thereof I give and devise unto my said daughter Mary
and one other third part thereof I give and devise to be equally and evenly divided brtween my two
grandsons Thomas Penny and John Penny
Item I do hereby make and ordain my said wife sole Executrix of this my last Will and Testament and
hereby Make void and revoking all former Wills heretofore by me made to this my present and last Will
and Testament contained in this one sheet of paper have set my hand and seal dated the sixteenth day
of January in the thirteenth year of the Reign of our Sovereign Lord George the second by the Grace of
God of Great Britain France and Ireland Defender of the Faith and so forth and in the year of our Lord
one thousand seven hundred and thirty nine � the mark of Thomas Penny � Signed sealed and declared
to be the last Will and Testament of the above said Thomas Penny at whose request we have hereunto
set our hands as witnesses

The before registered Will of Thomas Penny deceased was proved the 7th day of June 1740 before the Reverend Thomas Leigh Clerk lawfull surrogate to the Worshipfull George Lee Doctor of Laws Official general to the Reverend the Archdeacon of Canterbury lawfully constituted by the oath of Mary Penny wife of the deceased and sole Executrix named in the said will to whom Administration of the goods chattles and credits of the said deceased was committed She being first sworn well and truly to perform the same.
