Alsoe I do give and bequeath unto my welbeloved wife Elizabeth my best bedstoole, bedding and furniture
standing and in the best Chamber of the house wherein I now dwell to be delivered to her my said wife within
one month next after my decease.
Alsoe I give and bequeath unto her the said Elizabeth my deare wife the sume of one hundred pounds of good
and lawfully money of England to be paid to her my said wife by my said Executors hereafter named within
twelve months next after my decease.
Alsoe I do give and bequeath unto my only Daughter Elizabeth Philpott the sume of seven hundred pounds of
like lawfull money of England to be paid to her my said Daughter by my said Executor at her age of one and
twenty years or day of marriage which shall first happen.
And if she my said Daughter Elizabeth shall happen
to dye before she attains the said age of one and twenty years or day of marriage then I doe give the said sume
of seven hundred pounds unto my only Sonn William Philpott to be paid to him my said Sonn William
Philpott within twelve months next after such the decease of my said Daughter Elizabeth.
Alsoe I doe give and bequeath unto my two kinswomen Katherine Rickesies and Elizabeth Rickesies daughters of Josiar Rickesies deceased the sume of five pounds apiece to be paid them yearly and every yeare during the terme of seven years next after my decease by four quarterly payments the first payment thereof to be made within three months next after my decease for and towards their better maintenance and education.
And whereas I am possessed of divers messuages, Lands and Tenements by leases from severall persons hereinafter mentioned I doe give and dispose of the same as followeth.
And first I doe give and bequeath unto my Brother William Philpott the lease of the farmes wherein I now dwell made to me from Edward Harvey Esq. And all my title Tenant right and interest and forme of year's of in unto or out of the said Lease, he my said brother William Philpott his Executors, Administrators and Assignes from time to time well and truely paying the rent thereby reserved And performeing the covenants therein mentioned on the tenants parte to be performed.
Alsoe I doe hereby give and bequeath unto my said Brother William Philpott the Lease of the farms and Lands called Buckland in the parish of Woodnesborough in the said county of Kent made to me from one Mr. Barnes of London and the Lease of the Land lately made to me from the Honoble Philipp Lord Viscount Strongford to hold and enjoy the last two menconed Leases untill my said Sonn William Philpott shall attaine the age of one and twenty years.
And doe hereby appoint that my said Brother William Philpott shall then assigne the said two leases and all right title and Interest in the same unto my sonne William Philpott with all the land thereunto belonging in as good state and condition as I shall leave them at the time of my decease. He my said Brother William Philpott well and fairly paying the yearly rent reserved in and by the two last menconed leases and performeing the covenants therein menconed on the tenants parte to be performed for and dureing such time as he shall use and enjoy the said farms and Lands by virtue of this my Will aforesaid.
Alsoe I doe give and bequeathe unto my Brother William Philpott in trust and to and for the only use and benefitt of my said some William Philpott the Lease granted to me by the Deane and Chapter of Christ Church Canterbury of Lands called Rush Marsh in the parish of Word als Worth aforesaid with power for him my aforesaid Brother to renew the said leases in trust for my said Sonne William Philpott as aforesaid.
Alsoe I doe give and bequeath unto my Brother William Philpott in trust for my Sonne William Philpott as aforesaid the Lease of the Lands lyeing in the parish of Word aforesaid made to me from Mr. Boys to be assigned to my said Sonne William Philpott at his age of one and twenty years.
Alsoe I give and bequeath unto Mr. Crosier one guinea for preaching my funerall sermon
And I do hereby will and appoint that my goods, cattle, chattells, householddstuffe, stock and personall estate whatsoever now remaineing and being in or upon all the messuages, farmes and lands in my occupation shall within due and convenient time after my decease be valued and aprized by two able and indifferent men and that the money for the same according to the apprizement and valuation shall either remaine in the Hands and Custody of my said Brother William Philpott he giving sufficient security for the payment thereof with Interest for the same to my said Daughter Elizabeth Philpott and other legatees herein before menconed or also that the said money shall be put out on good security or securities and to such person and persons and at such rate of interest as my said Executors and Overseer hereinafter named shall think fitt to the Intent that my said Daughter and other legatees may have and receive their severall and respective legacies at their severall ages and times therein before limited and appointed for payment thereof.
And my Will and mind further is that my said Executors shall pay unto my said Daughter Elizabeth out of the Interest of the said moneys the sume of thirty pounds yearly and every yeare untill her porcon hereby bequeathed shall become due and payable by vertue of this my Will for and toward her education and maintenance.
All the rest and remainder of all and singular my goods, cattle, chattells, moveables and personall effects whatsoever, wheresoever and of what nature and quality or degree soever the same shall exist and be (not before in this my Will particularly given or reserved, all my just debts, funerall charges and probate of this my Will being first paid and deducted) I doe give and bequeath the said remainder of my personall effects unto my said Sonne William Philpott.
And of this my last Will and Testament I doe make and ordaine my said Brother William Philpott and my
Brother Thomas Denne of Patrixbourne joynt Executors and my kinsman Edward Philpott of Minster in the
Isle of Thanet in the said county of Kent, Yeoman Overseer of this my Will and doe hereby require them my
said Executors that they with one consent doe agree and take care that this my will in all things only
performed and fulfilled according to the true intent and meaning therein expressed and declared.
And that they on all occasions doe take the advice and assistance of my loveing friend Mr. William Verrier of Sandwich and
I doe hereby give and bequeath unto my said Executors the yearely sume of five pounds apiece of lawfull
English untill my said sonne William Philpott shall attaine the age of one and twenty years for their care and
pains in the one and true Execucion of this my Will.
And I doe give the said William Verrier the sume of three
pounds of like money to be paid to him within six months after my decease for his advice and assistance to my
said Executors for the better performance of this my will.
This is the last Will and Testament of the said Ralph Philpott made and declared the 6th Day of November in the third yeare of the reign of Our Sovereign Lady Anne by the Grace of God of England, Scotland, France and Ireland, Queen Defender of the Faithe Anno Dmi 1704 the disposing of all my messuages, Lands, Tenement and hereditaments herein after menconed situate, lyeing and being in the said parish of Word als Worth, in the parish of Eastry or elsewhere in the said county of Kent.
First I doe give and bequeath unto Elizabeth my wife, over above and besides the joynture setled upon her
before our intermarriage for and during the terme of her naturall Life if she soe long continue my widow in full
recompense and satisfaction of whatsoever she cann or may obtaine out of my reale and personall estate and
Annuity or yearly rent charge of twenty pounds of lawfull money of England to be yearly issueing, giving,
received and taken by my said wife out of the messuage, Lands, premisses situate, lyeing and being in the
parish of Word als Worth and now in the tenure or occupacon of of my said brother William Phillpott at the
four most usual Feast Days in the Yeare that is to say the Feast Days of the Birth of Our Lord Christ, the
Annuncon of the Blessed Virgin Mary, the Nativity of St. John the Baptist and the Feast of Michael the
Archangel, by even and equal porcons or within fourteen days next ensueing the said feasts upon paine of
distresse and such other penalties as is usual in such cases. The first payment thereof to be made at that feast
day of the feasts aforesaid which shall happen next after my decease
provided always nevertheless And my will
and mind is if the said Elizabeth my said wife shall intermarry again and take another husband or shall make or
commence any suite, trouble or demand either in Law or equity of for or for any parte of my goods, chattells
Lands or tenements otherwise than by this my will are given and devised or shall molest or interupt my said
Executor in the due execution and performance of this my said Will that then she my said wife by soe doing
shall thereby clearly loose all such legacies and other benefitt as she might otherwise have thereby (anything
before in this my Will contained to the contrary thereof in anywise notwithstanding).
Also I doe give and bequeath unto my sonne William Phillpott And to his heirs all my messuages, Lands, Tenements and Hereditaments whatsoever situate, lyeing and being in the said parishes of Word als Worth and Eastry or elsewhere in the county of Kent (charged with the Annuity payable to my said wife upon condicon as aforesaid) to have and to hold all my said messuages, Lands, tenements and hereditaments unto my said sonne William Phillpott and his heirs forever.
IN WITNESS whereof I the said Ralph Phillpott to this my last Will and Testament in the three sheets of paper
contained to every sheet thereof my Hand and Seale have set the aforesaid sixth day of November in the third
yeare of the Reign of our said Sovereigne Lady Anne by the Grace of God of England, Scotland, France and
Ireland Queene Defender of the Faith Anno Dmi 1704
Ralph Phillpott Signed, sealed, read, published, acknowledged and declared by the said Ralph Phillpott to be his
last Will and Testament the said sixth day of November in the third yeare of our said Sovereigne Lady Queene
