Will of Betsey Pilcher

of St. Margaret's at Cliffe, Kent

I give unto my Son Jesse Wood Pilcher a Legacy of Ten Pounds to be paid to him immediately after my decease

Also I give devise and bequeath all my real estate of what nature soever unto my two sons James Pilcher and William Wood Pilcher both of the Parish of Saint Margarets at Cliffe aforesaid Farmers their heirs executors administrators and assigns respectively according to the nature of the property Upon trust with all convenient speed after my decease to sell collect and convert unto money such part of my personal estate as shall not consist of Money And upon further trust that the said Trustees and the Survivor of them his heirs or assigns do and shall sell all my real Estate by public auction or Private Contract and in one Lot or several Lots for such price as they or he shall think proper and for such purpose enter into do and execute all such Contracts Agreements Deeds Conveyances matters and things as they or he shall think expedient

And upon further trust with and out of the money to arise from my real and personal Estate and that of which I shall die possessed to pay and discharge all my just debts funeral and testamentary expenses the Legacy hereinbefore given and such other Legacies as I may hereafter give by any Codicil hereto

And upon further trust to pay and divide the residue of such Monies unto and among my five Daughters Mary, the wife of James Temple the younger, Sarah Ann the wife of Robert Palmer, Elizabeth the wife of Edward Sladden, Maria Pilcher and Jane the wife of Benjamin Venables and their respective Executors Administrators and assigns in equal shares
And I direct that the shares of my said Daughters the said Mary Temple, Sarah Ann Palmer, Elizabeth Sladden and Jane Venables shall be for their respective separate use and not be subject to the control or interference of their respective husbands and shall be paid to the said Mary Temple, Sarah Ann Palmer, Elizabeth Sladden, and Jane Venables respectively or to such person and for such purposes respectively as they shall respectively direct and their respective receipts notwithstanding their respective covertures shall be a sufficient discharge for the same to my said Trustees and Trustee

And I appoint the said James Pilcher and William Wood Pilcher Executors of this my Will
And I hereby declare that the receipts of the Trustees and Executors of this my will for any money payable to them or him under the Trusts for sale hereinbefore contained or otherwise by virtue of this my will shall discharge the persons respectively paying the same from the money herein respectively acknowledged to be received and from all liability for any loss or misapplication thereof
And I hereby further declare that my Said Trustees and Executors shall not be answerable the one for the other and by no means for involuntary loss and that they shall be allowed and may retain all the costs charges and expenses which they may incur in the execution of the Trusts of this my Will or in anywise relating thereto And that my said Executors may pay the Debts due or claimed from me upon any evidence they may deem satisfactory and may take any security or compound for any Debts due to me and allow any time for the payment thereof

In witness whereof I the said Betsy Pilcher the Testatrix have to this my last Will and Testament set my hand this seventh day of November One thousand eight hundred and forty five --- Betsey Pilcher --- Signed and acknowledged by the said Betsey Pilcher the Testatrix as and for her last Will and Testament in the presence of us who at her request in her presence and in the presence of each other have at the same time hereunto subscribed our names as witnesses

The before registered Will of Betsey Pilcher, Widow, deceased, was proved the Eleventh day of September 1847 before the Worshipful Sherrard Beaumont Burnaby, Doctor of Laws, Commissary General of the City and Diocese of Canterbury lawfully constituted by the Oath of James Pilcher Son of the deceased, one of the Executors named in the said Will He being first sworn (by Commission) well and truly to perform the same / Power reserved of making the like grant to William Wood Pilcher, Son of the deceased, the other Executor when he shall apply for the same.

Betsey (nee Wood) Pilcher died 13 July 1847.
She was the widow of John PILCHER 1756-1826, farmer of St Margarets
