Will of Mary Pye

of Deal, Kent

I give and bequeath unto my son John Pye and to his Children their Executors Admintrs and Assigns all that Messuage or Tenement with the Yard and Appurtenances in Deale aforesaid now in my own occupation with the priviledge and use of the water well in the well yard there provided alwaies and my will is that if my said son John shall dye before his wife Anne then the said Anne shall have the use of the said Messuage and premisses and receive the rents and profits thereof during so long time as she shall continue a widow after his decease she keeping the said premises in good repair

Item I give and bequeath unto my daughter Anne Knowler and to her children John[,] Charles[,] Thomas[,] George[,] and Anne Knowler their Exectrs Admintrs and Assigns all that Messuage or Tenement with the Appurts in Deale aforesaid now in the occupation of David Russen and also the Capstone Ground upon the beach there in the occupation of John Goldstone also the priviledge and use of the water well in the said well yard

Item I give and bequeath unto my daughter Elizabeth Campbell and to her Children their Exectrs Admintrs and Assigns all that Messuage or Tenement with the Yard and necessarie house as the same is now fenced in with the Appurtenances in Deale aforesaid now in the occupation of Raymond Gurling with the priviledge and use of the water well in the said well yard and also all that tenement or dwelling house yard and appurtenances in Deale aforesaid in the occupation of Robert Church and also the priviledge and use of the water well in the said well yard provided alwaies and my will is that is my said daughter Elizabeth shall dye without leaving any child or children surviving her then in such case I give and bequeath the said messuages and premises in occupation of Raymond Gurling and Robert Church as followeth (that is to say) I give and bequeath one moiety or half part thereof unto my daughter Anne Knowler her Exectrs Admintrs and Assigns and one quarter or fourth part there of unto my said son John his Exectrs Admintrs and Assigns and the other quarter or fourth part thereof unto the four daughters of my daughter Mary Watts dcsed their Exectrs Admintrs and Assigns

Item I give and bequeath all that stable and yard with the appurts in Deale aforesaid in the occupation of Edward Sole and all that Tenement or Dwelling House[,] Yard and Appurts in Deale aforesaid in the occupation of Fabian Clayton and also the priviledge and use of the water well in the said well yard unto my said son John Pye my said daughter Anne Knowler and my said daughter Elizabeth Campbell their Exectrs Admtrs and Assignes provided always that my will is they my said son John and daughters Anne and Elizabeth their Exectrs & Admtrs shall in consideration of my giving them the said stable and tenement and premises pay unto my grandaughter Ursula Dissell and to Ellenor wife of my grandson John Pye the sume of Five pounds a yeare of lawfull money of Great Britain within two yeares after my decease.

Item I give and bequeath unto my grandsons Jonathan Watts and George Watts their Exectrs Admintrs and Assignes all that messuage or tenement and garden with the appurts in Deale aforesaid now in the occupation of John Huttson and a Cave in the well yard by the Well Gate under the house where I now dwell[.] And also the Capstone Ground and Storehouse on the beach there[.] Also the priviledge and use of the water well in the said well yard[.] And also the priviledge to build against the side of the messuage in the occupation of David Russen as there shall be occasion

Item I give and bequeath unto my granddaughters Martha Watts and Mary Watts their Exectrs Admintrs and Assignes the said messuage or tenement with the appurts in Deale aforesaid now in the occupation of Nathaniel Christianson and also the priviledge and use of the water well in the said well yard and of a passage thro the gate that goes into the said well yard as it is now used[.]

Item I give and bequeath unto my Grandaughters Elizabeth Watts and Anne Watts their Exectrs Admintrs and Assigns all that tenement or dwelling house with the backside and appurts in Deale aforesaid now in the occupation of Simon Pritchard.

Item I give and bequeath unto my grandaughters Mary Smith and Anne Pye (the Children of my son Rand Pye dcsed) their Exectrs Admintrs and Assignes all that messuage or tenement backside and appurts in Deale aforesaid in the occupation of Robert Norris provided nevertheless and my express mind and will is that if the said Mary Smith and Anne Pye shall p[re]tend to claim any debt or debts due from my late husband upon an amount made with their late mother or otherwise howsoever then my bequest to them of the said messuage and premisses shall be utterly void and of none effect and then I will the said tenement and premisses shall be sold by my Executors towards the payment of my debts.

Item I give and bequeath to my grandson John Pye and to my Grandaughter Ursula Dissell (the Children of my son Thomas Pye dcsed) their Exectrs Admintrs and Assignes all that messuage or tenement[,] backside and appurts in Deale aforesaid in the occupation of John Duck

Item my will is that the watercourse through the yard in the occupation of Fabian Clayton shall be alwaies kept open as the same now is for the benefitt of all the tenements next the said well yard and my express will is that all those who shall have tenements next the said well yard to whom I have given them by this my will shall have the priviledge of the gate called the well gate that goes into the Lane and shall bear an equale part of the charge of repairing the said gate and of repairing the said well bucket and rope all while said premisses are leasehold estate under the Lord Archbishop of Canterbury[.] And my will is that when the leases of the tenements and premisses by me hereby given to my said son John and his Children[,] to my said daughter Anne and her Children and to my said daughter Elizabeth and her Children when renewed shall be taken in the names of such persons as they my said son & daughters shall appoint as trustees to the intent the same may descend and go according to the true meaning of this my will provided always and my will is that my grandsons Jonathan Watts and George Watts shall in consideration of my giving them the messuage and premisses aforesaid pay unto their sisters Elizabeth and Anne Watts the Sume of ten pounds of lawfull money of Great Britain to be equally divided between them within two years after my decease[.] And also that my grandaughters Martha Watts and Mary Watts shall in consideration of my giving them the tenemt and premisses aforesaid pay unto their said sisters Elizabeth Watts and Anne Watts the sume of Five pounds of like money within two years after my decease

Provided also and my will is that my grandchildren the children of my daughter Mary Watts dcsed shall not have the possession of the said tenements and premisses hereby given them during the life of their father or untill they be married but shall only receive the Rents and profitts thereof and in case any of them dye before their said father or their marriage then I give and bequeath the part of him her or them so dying unto the survivors of them their their Exectrs Admintrs and Assigns
Provided also and my will is that my Executors hereafter named shall have and receive the first half years Rents of all my said messuages and leasehold Estates that shall become due next after my decease towards the payment of my debts legacies funerall and expenses about this my will

Item I give my son John Pye the sume of Five pounds towards the charges of repairing the messuage hereby given him
Item I give to my son John Pye my best feather bed[,] bolster and one pillow[,] two blanketts and a Quilt red on one side[,] my Clock and Case[,] my two armed cane chair[,] the couch[,] a large looking glass[,] seven small pictures by the said glass[,] two brass Sconces in the hall and six cane chairs in the best chamber and the bed sheddle and curtain of the bed where I lay
Item I give my daughter Anne Knowler my second best feather bed[,] bolster and two new pillows[,] a pair of blanketts and my best Quilt used on my best bed

Item I give to my daughter Elizabeth Campbell my next feather bed[,] bolster[,] pillows[,] blanketts and furniture thereto belonging a wooll bed quilted and also the bedstead[,] curtaines and vallance of my best bed[,] a small table in the best chamber and the window curtaines of the best chamber and seven cushons made of the same of the bed curtaines[.] Also I give my said daughter Elizabeth a pair of Fire grates Fender firepan & tongs spits and all other the fire irons and things in the chimney in the hall now used by me and also the jack copper in the cellar and six tubbs as she shall think fitt for her life[.] Also I give and bequeath unto my said daughter Elizabeth all and singular the goods[,] moveables[,] household stuffe and things whatsoever now standing and being in the back part of my messuage wherein I dwell containing two low rooms a chamber and a garrett and the end of a shed parted off next the back door that goes into the yard and which goods are now used and in the possession of my said daughter Elizabeth

Item my will is that my said daughter Elizabeth shall continue to use and occupy the said rooms in my said messuage where she now dwells during the months after my decease without paying any rent for the same
Item I forgive my son in law Robert Campbell and my said daughter Elizabeth his wife all sumes of money claimes and demands whatsoever due to me or to my late husband John Pye for their diet and board
Item I give my grandaughter Elizabeth Watts my large chest of drawers standing in my best chamber
Item I give my said son John Pye my wedding ring and to my sons in law Henry Watts[,] Thomas Knowler and Robert Campbell to each of them a gold ring
Item I will that my wearing apparrell[,] and wearing linen be divided in three parts and I give one third part thereof to my daughter Anne Knowler[,] one third part thereof to my daughter Elizabeth Campbell[,] and the other third part thereof to the four daughters of my said daughter Mary Watts dcsed

Item all and singular the rest and residue of my goods[,] chatls and personal estate whatsoever and wheresoever (after payment of my Debts[,] legacies[,] funerall and probate of my will and all incident charges in and about the execution thereof) I will shall be divided into four equal parts[.] And I give one fourth part thereof to my said son John[,] one other fourth part thereof to my said daughter Anne[,] one other fourth part thereof to my said daughter Elizabeth and the other fourth part thereof unto the four daughters of my said daughter Mary Watts

Item in case the said residue of my personal estate shall fall short of paying my debts[,] funeralls and charges about this my will then all my said children and grandchildren (except the children of my said sons Rand Pye and Thomas Pye) shall bear an equall part proportionable to the Estates by me hereby given them in this my will
Item I make consitute and appoint my said son John Pye and my said daughter Elizabeth Campbell Joynt Executors of this my will

Item I give to my daughter Anne Knowler a brass fire pan and a pair of brass tongs and the brass Sconce in the entry[.] And I give to her daughter my grandchild Anne Knowler a silver pint cup and I give to my daughter Elizabeth my pallet bedsted
Item I give to my cousin Mary Iggulden wife of James Iggulden half a guinea of gold to buy her a ring

And revoking all former wills by me made I do made and declare this only for my true and last Will and Testament contained in the two precedent and this present sheets of paper[.] In witness whereof I the said Mary Pye have to each sheet of this my will set my hand and seal the tenth day of April Anno Dni 1719 and in the fifth year of the reign of our Soveraign Lord George King of Great Britain[.] the mark of the said Mary Pye signed sealed published and declared by the said Mary Pye the testatrix for and as her last Will and Testament on the day of the date thereof in the presence of us who subscribed our Names as witnesses in the presence of the said testatrix

[The statement regarding the probate of the will is in Latin. The will was proved on 5 March 1719/20.]

Mary Norman Pye, daughter of grocer John Norman the younger and Mary Rand Norman, was baptised at St Leonard’s in Deal, Kent, on 4 September 1642. She married pilot John Pye at St Leonard’s in Deal on 27 July 1663. She was the mother of four sons and three daughters. Mary Norman Pye was buried at St Leonard’s in Deal on 6 December 1719.
