In the name of God Amen I Isaac Rutton of the Towne and port of New Romney in the county of Kent gent being sicke and weake in body but of perfect and disposeing memory and understanding (praised be God) this present twelveth day of September in the five and thirtieth yeare of the raigne of our Soveraigne Lord Charles the second by the Grace of God now King of England etc Annoq Domini 1683 doe make & ordaine this my last will and Testament in manner and forme following (vizt)
First I committ my soule to Allmighty God that gave it hopeing to be saved by his mercies and through the meritts of Jesus Christ my blessed Redeemer And my body I committ unto the earth (from whence it was) to be decently and in christian like manner interred at the discrecion of my Executors hereafter named And as to the disposall of my temporall estate wherewith it hath [pleased] Allmighty God to blesse me I will and bequeath the same as followeth

First I give and bequeath unto Mary my loving wife all my houses lands & Tenements in Romney Wye and Kennarton in the said county of Kent for and during her naturall life
and from and after her decease I give and bequeath my dwelling house knowne by the signe of the George in New Romney aforesaid with the brewing vessell and leaden cesterne as they now stand unto Thomas Rutton my sonne his heires and assignes forever

Item I give and bequeath unto Isaac my sonne all that my messuage or Tenement and eleaven acres of land in Kennarton aforesaid now in the occupacion of Thomas Muncke to be had and holden unto my said sonne Isaac his heires and assignes forever from and after my said wifes decease

Item I give and bequeath all that my Tenement in Romney aforesaid now in the occupacion of Stephen Jorden from and after my said wifes decease unto Elizabeth my daughter her heires and assignes forever

Item I will and bequeath unto Mary my daughter all that my part and purpart that is to say two third parts of all that my Tenement and five acres of land with the appurtenances now in the occupacion of John Shaxby To have and to hold unto my said daughter Mary her heires and assignes forever immediately from and after my said wifes decease

Item as to the moyety of foure acres of meadow land in Wye and one sixth part of three acres of meadow land in Wye aforesaid now in the occupacion of Thomas Sutton & Mr Thomas Mascall or their assignes I will & bequeath the same (from and after my said wifes decease) unto my said sonne Thomas his heires and assignes forever

And my minde and will is that my said sonne Thomas shall pay and satisfy unto Rebecca my daughter out of the lands and Tenements before bequeathed unto him the sum of Fifty pounds and for non payment thereof it shall and may be lawfull for my said daughter Rebecka to enter & distraine and the distresse and distresses there to be had & taken from thence to lead beare and drive away and the same to withhold and keepe untill the said summe of Fiftie pounds shalbe fully satisfyed contented & paid

Item I give and bequeath unto my daughter Ellen all those my household goods now at Sandgate Castle
Item I give and bequeath unto the child which my wife now goes with the sum of Fiftie pounds to be paid at eighteen yeares of age if a daughter and one and twenty years of age if it be a sonne

Item my minde and will is that my sonne Isaac shall pay and allow out of the lands before bequeathed unto Him the sum of twenty pounds towards making up my said daughters or childrens portions fiftie pounds apeece and that if any of my said daughters shall dye before they shall receive the benefit of this my will then the porcion or legacy given to her or them as aforesaid to be equally divided amongst my surviveing daughters and child my wife goes of as aforesaid

All the residue of my goods & chattells whatsoever after my debts paid and my funerall expences with the probate of this my last will and Testament discharged I will devise and bequeath unto my said loveing wife

And I make and ordaine and appoint my said wife and John Mascall Esq & now Maior of New Romney aforesaid and James Pashley of the towne and port of Hithe to be Executors of this my last will and Testament
And I doe hereby revoke and make void all former wills

In witness whereof to the first sheete of this my will I have sett my hand and to this second and last sheete thereof I have sett and put my hand and seale the day and yeare first within written Isaac Rutton his marke
Signed sealed published and declared by the said Isaac Rutton to be his last will and Testament in the presence of
Nicholas Ingham - Anne Ingham her marke - Margaret Barnsley her marke - Tho Tournay.

Probatum fuit –huiusmodi suprascriptum Testamentum Isaaci Rutton defuncti haben etc bona notabi vicesimo quarto die Octobris Anno Domini 1683 coram magistro Johanne Thomas cleric Comissionar etc venerabilis viri Thoma Boushier legum doctoris etc Comissarii Generalis rite et legitime deputat Juramento Maria Rutton relicta dicti defuncti et unius Executorum in dicto testamento nominat Ac inde approbatum etc onusque Execucionis dicti testamenti … Executrici Comissum fuit prius ad sancta etc iurat etc salvo iure etc reservata consili potestate alteris Executoribus etc cum venerint in se etc
