In the Name of God Amen I Thomas Rutton of the Town of Folkstone in the County of Kent Butcher being in good health and of sound and perfect mind and memory (praised be Almighty God for the same) doe hereby make and ordain my last Will and Testament in manner and form following
First and principally I recommend my Soul to the Mercy of Almighty God my Creator hoping through the Merrits of Jesus Christ my Saviour to have full and free pardon and forgiveness of all my Sins and to inherit Eternal life and my Body I will to be decently Interred with Christian Burial at the discretion of my Executors hereinafter named
And as to my Worldly Estate wherewith it hath pleased God to bless me I dispose of the same as followeth That is to say

I give and devise unto my Daughter Mary the Wife of Thomas Baker of Folkstone aforesaid Fisherman the sum of two hundred pounds of lawfull Money of Great Britain to be paid unto her by my Executors hereinafter named within one year next after my decease
Upon this Condition that the said Thomas Baker and the said Mary his Wife shall then give a full and Authentic Discharge to my Executors hereinafter named for all such Moneys as shall then be due to her or to the said Thomas Baker in her Right by Virtue of my Bond bearing Date on or about the Twentieth day of November which was in the year of our Lord One Thousand seven hundred and Eight made to Elizabeth Tucker then of Lydd in the said County Widow now deceased
And in Case of refusal of such discharge Then she my said Daughter Mary shall have no Benefit or Advantage by or from this my Will or of any Legacy hereby given

Item I give unto my two Daughters Susanna the Wife of John Hague and Ann Rutton Spinster and to each or them the Sum of two hundred pounds of like lawfull Money of Great Britain apiece to be respectively paid unto them by my Executors hereinafter named within one year next after my decease

Item I give and devise All that my Messuage now made into two Dwellings with the Appurtenances Scituate lying and being in the Town of Folkstone aforesaid and now or late in the several Occupations of my said Son in Law John Hague and Thomas Martin or One of them their or one of their Assignee or Assigns unto my loving Wife Ann and her Assignes for and during the whole Time and Term of her natural Life she and they during all that Time keeping the said Messuage or dwellings in Tenantable repair and committing no wast thereon

And Immediately from and after her decease I then give and devise the said Messuage or dwellings and every part thereof with their Appurtenances unto my Son Isaac Rutton his heirs and Assigns for ever

Item I give all that my Messuage or Tenements with the Shop and Appurtenances wherein I now dwell and my Yard adjoyning to my said first mentioned Messuage or dwellings And the Schoolhouse erected in the said Yard with their and every of their Appurtenances now in the several Occupations of my self and Gibbon Walbank or One of Us unto my said Son Isaac Rutton his heirs and Assigns for ever

Item all the residue and remainder of my Goods Chattels and Personal Estate whatsoever and wheresoever after my Just Debts Legacys and Funeral Expences shall be paid and satisfied (except the Debts due from me to the said Isaac Rutton by Virtue of the said Bond) I give and devise the same and ever part thereof unto my said Wife and my said Son Isaac Rutton Equally to be divided between them

And my Will and mind is that he my said Son shall pay and satisfie himself the Money due to him by Virtue of the said Bond out of his Share of my said residuary bequest Which I hereby give him for that purpose Otherwise he shall have no Benefit or Advantage by or from the same and in such Case I give the whole of my said residuary Bequest unto my said Wife

Item I hereby make and ordain my said Wife and my said Son Isaac Rutton Joint Executors of this my last Will and Testament
and hereby revoking Void all former and other Wills by me heretofore made to this my last Will and Testament contained in these two Sheets of paper together annexed I have to the first Sheet thereof set my hand and to this Second and last Sheet thereof my hand and Seal Dated this Six and Twentieth day of October in the Year of our Lord One Thousand Seven hundred and Thirty Seven Tho Rutton

Signed Sealed delivered published and declared by the said Thomas Rutton the Testator for and as his last Will and Testament in the presence of us who at his request and in his presence Subscribed our names as Witnesses hereunto

The before Registred Will of Thomas Rutton deceased was proved the 4th day of June in the Year of our Lord 1745 Before the Reverend Thomas Lamprey Clerk lawfull Surrogate to the Worshipfull Edward Simpson Doctor of Laws Official General to the Right Revered the Archdeacon of Canterbury lawfully constituted by the Oath of Isaac Rutton Son of the deceased and one of the executors named in the said Will To whom Administration of the Goods etc of the deceased was committed He being first Sworn duly to Execute the same The like power being reserved to the other Executor to prove the same when She thinks fit
