Virginia Militia in the Revolutionary War, p.69
GILES, ISAIAH.--Prince Edward, Sept. 17, 1832. Born in
Chesterfield, 1756. Performed a three months' tour under Capt.
Jacobs, of Amherst, the time being spent in guarding prisoners
at Albemarle Barracks. Col. Burnley and Maj. Meredith were in
command. Second tour was under Capt. Richard Ballinger, this
service being at Hood Fort in Prince George. His Company was the
only one there. Third tour was under Capt. John Christian. He
was at Richmond, Hobb's Hole, Bottom's Bridge, the Chickahominy,
and other places. By recollection the tour was for three months
and Gen. Lawson was in command. The fourth tour, of three
mouths, was under Capt. John Phillips, and he served below
Richmond. In the fifth tour, his father's wagon being impressed
by Col. Gabriel Penn, of Amherst, he was assured by the said
Penn that if he went with the wagon it would answer as a tour of
duty. Length of his tour forgotten, but it included the Siege of
Yorktown. All the tours were from Amherst.
Colonel in the Amherst County militia and participated in the
North Carolina campaign. Was Paymaster Buckinham Batallion
1775-7. Will filed Amherst County Will Book 3up. 506 was proved
16 July 1798.
Gabriel Penn, Sgt. 1st Va. Reg't 1764; Lt Mil., 1769; Capt.,
Minute Men, 1775; Lt. Col., 2nd Bn., Va. Mil. 1782; Col. Va.
Militia. - The Penn family of Virginia, a chronilogical record,
1915:
1764 deed Apr20, Gabriel Penn of Amherst Co. and Sarah, his
wife, to John Penn of Spotsylvania Co. Witnessess John Penn Jr.
Thos. Penn. DAR Vol. 1 Pg. 526 Gabriel Penn Col. P.S. VA "was
promoted to Col. of Amherst militia, and served with same to
the surrender at Yorktown. " - Hist. of Henry Co. VA DAR pg 88
Gabriel Penn, (1741-98) was a member of the Committee of Safety
and commanded a company of Amherst Co., militia.

Amherst Co. and Sarah, his wife, to John Penn of Spts. Co. £60

1764.
Will of Gabriel Penn, recorded in Will Book No. 3, page 506, of
the Amherst County records is as follows:
I, GABRIEL PENN, of Amherst County and State of Virginia, being
of sound mind and recollection, do make and ordain this to be my
last and testament in writing. Imprimis,
I give to my son, James Penn, to him his heirs and assigns
forever my right and interest in and to one fourth part of a
Military Land Warrant, or the lands surveyed and secured under
it, which was granted to the executors of my deceased brother,
William Penn, I also give to his heirs and assigns forever all
the property which he as already received from me and which he
has had in possession.
Item. I give to my daughter Betsey Calloway two debts due to me
from the estate of David Shepherd, deceased, viz., one of
hundred and six pounds eight shillings with the interest
thereon, it being the amount of a bond which I paid to Carter
Braxton, bearing date the 16th of February, 1775, given in
consideratin of lands purchased by said Shepherd from said
Braxton. The other bond of Ezekiel Gilbert amounting to
fory-one poiunds thirteen shillings and four pence specie which
bond I lent to the said David Shepherd in his life to discount
in the payment of land purchased from said Gilbert.
Item. I give to each of my daughters, Sophia Crawford, Permelia
Haskins, Matilda Nash and Fannie White all the property which
they respectively have received from me and have had in
possession since their respective marriages, to them their heirs
and assigns forever. Item.
I give to my daughter Nancy Penn (besides the negroes to which I
have made her deed of gift) on her marriage or arrival at the
age of twenty-one years the following property, viz.: two cows
and calves a riding horse and saddle, a feather bed and
furniture, and such pewter as have been usually given to my
other daughters on their respective marriages.
Item. I give to my son Edmund Penn to him his heirs and assigns
forever, and to take in possession after the decease of my
beloved wife eight hundred and seventy acres of land being part
of the tract on which I now live, and which has lately been laid
off by a survey made the 8th day of January, 1794, by James
Higginbotham Surveyor of Amherst County, and besides the six
negroes, which I have already given him by deed of gift. I give
to him his heirs and assigns forever upon his marriage or
arrival to the age of twenty-one years one-sixth part of my
stock o horses, cattle, sheep and hogs, a good feather bed and
furniture and book case and such other of my household furniture
as my wife in her discretion may think proper to allot to him.
Item. I give unto each of my daughters, Sally Penn & Catherine
Penn respectively (besides the four negroes which I have given
to each of them by deed of gift) a good feather bed and
furniture, a riding horse and saddle, two cows and calves and
such pewter as has been given to my other daughters on their
respective marriages or becoming of age, to each of their heirs
and assigns forever.
Item. I lend unto my beloved wife Sarah Penn during her natural
life the tract of land on which I now live containing eight
hundred and twenty acres and being the land which in a preceding
clause of this my will I have given to my son Edmund after the
decease of my said wife. Also I lend her for life all the
remainder of my slaves, stock, household and kitchen furniture
and plantation utensils for the purpose of her comfortable
maintenance and support and the bringing up and educating my
younger children and the management and direction of the estate
which I have thus lent to my wife I entrust to the prudence and
management of my executors herinafter mentioned.
Item. It is my will and desire and do direct that all the
remainder of my real estate (not hereinbefore given) including
the balance of the tract on which I now live and which I have
given to my son Edmund, and containing three hundred and fifty
seven acres laid off and surveyed by James Higginbotham, the 7th
day of January, 1794, also Higginbotham's Mill Creek tract
containing three hundred line missing-------- River containing
one hundred and forty-six acres as also what lands I may be
entitled to in Kentucky shall be sold by my executors or the
survivor or survivors of them whenever they may think it most
convenient and necessary, and the money arising therefrom to be
considered as personal estate and to be applied as hereinafter
directed. Item.
It is my further will and desire that after the decease of my
beloved wife all the slaves with their natural increase, stock
of all kinds, household and kitchen furniture, and plantation
utensils which I have lent to her as hereinbefore mentioned,
excepting such as may be necessary and convenient for my
executors to sell for the payment of my lawful debts as also all
the money which may arise from the sale of my lands my share in
the James River Company which my executors may at any time sell
when necessary and also all the remainder of my property of
every kind whatsoever not before herein mentioned, may be
equally divided among all my children, viz.: Betsey Calloway,
James Penn, Sophia Crawford, Permelia Haskins, Matilda Nash,
Fannie White, Nancy, Edmund, Sally and Catharien Penn to each of
them their heirs and assigns forever.
Item. I appoint my son James Penn guardian to my son Edmund,
Thomas Haskins guardian to my daughter Sally and James Calloway
guardian to my daughter Catharine, who are hereby authorized and
required to suffer to remain in the bulk of estate for their
comfortable support and the conveniency of my beloved wife until
they become of or may, if their or either of their conveniences
should require it to remain there so long the property which
have heretofore given the said wards,--for which at any furture
day they are not to be called to account.
Lastly. I appoint my son James Penn and my two sons-in-law Wm.
S. Crawford and James Calloway executors of this my last will
and testament, hereby revoking all former Given under my hand
and seal this 21st day of November Anno Domini 1794.
GABL. PENN {Seal} Signed , sealed and acknowledged in the
prescence of George Dillard, Reubin Crawford, Jas Ballinger
line missing=------------ At a Court held for Amherst County the
16th day of July, 1798.
This will was aproved by the oath of James M. Browne a witness
thereto, and George Penn, Senr., another subscribing witness to
the said will being dead, William Penn and George Penn being
sworn deposed that they are well acquainted with the handwriting
of the said George, dec'd and verily believe that his name
subscribed as a withness to the said will is in the proper
handwriting of the said George Penn, and the said will is
ordered to be recorded:
Whereupon William S Crawford, one of the executors in the said
will named refused to take on himself the burthen of the
execution thereof and on the motion of James Penn, another
executor in said will mentined, certificate is granted him for a
obtaining a probate thereof in due form he having made oath and
given bond with Philip Gooch, Joseph Burrus, George Penn,
William Penn, Thomas Penn and William S Crawford, his securities
in the penalty of seven thousand pounds current money
conditioned as the law directs. Teste, W. W. Crawford, Clerk

On 4th May, 1782, Gabriel Penn conveyed to George Coleman 562
acres in Amherst. Gabriel died, testate, in Amherst, leaving
children, viz: James and Edmund Penn; Elizabeth, wife of William
Long; late Elizabeth Callaway, widow of James Callaway; Sophia,
wife of William S. Crawford; Pamelia, wife of Thomas Haskins;
Matilda, wife of Abner Nash; Fannie, wife of William White;
Nancy, widow of John McCredie, deceased, late widow of Alexander
Brydie; Sarah, wife of Thomas Crews; Catherine, wife of ----
Holder. Elizabeth Braxton recovered dower in said lands as widow
of Carter Braxton, to whom they were patented.
Colemans seek to recover from Penns. Will of Gabriel Penn of
Amherst. Son, James, lands by military land warrant, surveyed to
Gabriel's deceased brother, William Penn; daughters, Betsey
Callaway, Sophia Crawford, Permelia Haskins, Matilda Nash, Fanny
White, Nancy Penn (infant); son, Edmund (infant); daughters,
Sally and Catherine Penn (infants); wife, Sarah; sons-in-law,

George Braxton devised to his son Carter Braxton (whose widow
Elizabeth is) 2,500 acres in Goochland (Amherst), patented to
George 25th November, 1743. Defendants are holders of parts of
this tract and Elizabeth seeks to recover dower in the lands.
These defendants added, viz: William Cabell, John Penn, James
Savage, Sophia and Wm. Lee, infants of Francis Lee, deceased;
Seaton M. Penn, Charles B., Elizabeth, Polly, Joseph Penn,
infants of Joseph Penn, deceased.
James Watson answers, he purchased from Carter Braxton in 1776.
Alleges a marriage settlement between Carter and Elizabeth.
William Warrick answers ditto, he bought of William and George
Penn, Jr., who were devisees of their father, George Penn, Sr.,
who was devisee of Ambrose Lee, deceased, who is supposed to
have bought from George Braxton.
Edward Watson answers, he holds by deeds from Henry and George
Gilbert sons of Henry Gilbert, who purchased from Carter 6th
October, 1774.
Will Long answers, holds by marriage with wife Elizabeth, part
was conveyed by Braxton to David Shepherd, remainder is part of
