3. William Whitely According to research by TDW, William was in
the mercantile business, dealt in real estate, and
money-lending. He was an administrator in several wills. He
and his brother Charles had a mill, made whiskey, and dealt in
tobacco. Charles was the administrator of William's estate.
According to the report, even though William apparently left
considerable assets, Mildred had to go to court for settlement
but apparently got nothing and died almost penniless.
Will of William Whitely
In the name of God amen, I William Whitely of Bedford County and
State of Virginia being of sound mind and disposing memory, do
make and ordain this my last Will and Testament in manner and
form following that is to say.
First It is my will and desire that after my decease all my Just
debts and funeral expences be first paid by my executors whom I
shall hereafter name
Secondly, I give and bequeath to my beloved wife Milly one third
part of all my estate both real and personal and also the
following slaves, namely Jenny, Hannah. Rachael & Washington,
for and during her natural life and at her decease I give the
same to my eight children, namely
Nancy, Charles, Susan, Narcissa, Francis, Albert, James &
William to them and their heirs forever
Thirdly, it is my will and desire that my said Executors shall
at their discretion dispose of the whole of the property
belonging to William & Charles Whitely as partners in trade
either by public or private sale or in any way that they may
think most conducive to the interest of the Estate. It is also
my will and desire that my said Executors, shall if they think
proper and to the interest of the parties concerned renew the
stock of goods on hand and keep up the store for twelve or
eighteen months and make such arrangements as they may think
proper to bring the whole of the business to a speedy close, and
should my said Executors think it most to the interest of the
parties concerned, not to dispose of the real estate for one,
two or three years, it is my will that they shall not dispose of
it. It is also my will that my said Executors, provided my wife
wish it, purchase at a fair price the negro man Bob
belonging to William & Charles Whitely, and pay for him out of
any part of my estate.
Fourthly, I give and bequeath to my eight children namely Nancy,
Charles, Susan, Narcissa, Francis, Albert, James and William,
the whole of the balance of my said Estate both real and
personal of every kind and nature whatsoever to them and their
heirs forever.
Fifthly, I do hereby constitute and appoint John H Smith and
Charles Whitely Executors of this my last Will and Testament,
hereby revoking all others and former wills and testaments by me
heretofore made in witness whereof I have hereunto set my hand
and affixed my seal this 14th day of March 1821

At a Court held for Bedford County at the Courthouse the 30th
day of March 1821 This last Will and Testament of Wm Whitely dec
Was Returned to Court and proven by the oath of John Cobbs
Lenaus Scott and Frazure O Stratton and Ordered to be Recorded
and on the motion of John H Smith and Charles Whitely the
Executors therein named Who made oath & gave bond and Security?
according to law Certificate is granted for the obtaining a
probate thereof in due form.
"John Whitely and #1.1.3 William Whitely witnessed a deed
together in Loudoun County in 1799. Their joint appearance at
this time helps confirm that they were adult sons of #1.1
William and Susannah (Tyler) Whitely. It is thought that John
was the eldest son since he
approved the adoption of his sister Nancy (Anne) by Isaac
Skillman in 1798. John and William must have moved to Bedford
County about 1800 because they appear in the annual tax lists
beginning in 1801. John bought land from a Houmans in 1801 and
married Bathsheba Haynes in 1803. William married Mildred
Haynes in 1805. Both girls were daughters of Henry Haynes by
two different wives. John and William bought adjacent lands
next to their father-in-law Henry Haynes in the southern part of
Bedford County. Nearby were lands of John Hampton, said to be
from Fairfax County and William Mead, formerly of Loudoun
County. Since William Mead owned land in Loudoun at the time of
his death in 1816, his will was recorded there too, where I
found it. The fact that these families - Meads, Hamptons and
Whitelys moved from Northern Virginia about the same period to
Bedford stirred my curiosity. Did the travelers on the old
Carolina Trail stop at Goose Creek and tell of the busy
crossroads town of Liberty (now Bedford Co) nearly two hundred
miles Southwest? Perhaps land was easier to buy and less
crowded. Even Daniel Boone was there in Bedford County for a
while before going west".
