Mrs. Melissa Elizabeth Stone Hodges died at her domicile in
Livingston Parish, Louisiana, on November 04, 1912 leaving as
her sole and surviving children, the following named: William
George Hodges, Rosalie Hodges, Jincy Hodges, Mary Elizabeth
Hodges, Alma Dora Hodges
That she was united in matrimony at the time of her death to
Henry C. Hodges who departed this life in St. Helena Parish,
Louisiana on March 04, 1939, and that the above named children
were the sole issue of said marriage between decedents.
That the said Mrs. Melissa Elizabeth Stone Hodges departed this
life interstate. That she and the said Henry C. Hodges had
acquired certain property during the existence of the community
of acquets and gains that existed between them, said property at
the time of the death of the said Mrs. Hodges being described as
follows:
The southwest quarter of the northeast quarter of section 8 T 5
SR 4 E, St. Helena Meridian, Greensburg Land District of
Louisiana, Livingston Parish, Louisiana.
That the said property was legally inherited one half as his
community interest therein by the said Henry C. Hodges and the
other undivided one half interest therein of the deceased mother
by the above named childre and heirs.
That at the time of the death of the mother, the surviving
spouse and children failed and neglected to open the succession
and to be put and sent into possession of the above described
property as the owners thereof in indivision.
That under date of May 19, 1917 by deed recorded in COB 31 page
95 Livingston Parish, Louisiana, the said Henry C. Hodges and
the other legal heirs of Mrs.Elizabeth Stone Hodges sold and
transferred to one George W. Hodges, Sr. their entire interest
in and to the property described hereinabove all as will appear
by reference to said deed of record.
That subsequently therto. The petitioner, the Federal Deposit
Insurance Corporation acquired title to the said property and is
presently the owner and possessor of said real property.
That it is necessary that the Succession of Mrs. Melissa
Elizabeth Stone Hodges be opened and that the inheritance taxes
due thereon be paid, or the property be decreed to be exempt
from the payment of said taxes, and that the said possession of
said property to validify the title presently held by the
petitioner.
Petitioner shows by the attached affidavit that the property
comprising the estate of the said decedent and presently owned
by the petitioner was valued at not exceeding the Sum of
$400.00, and that same is free and exempt from payment of any
and all inheritance taxes. Whereefore: Petioner prays that a
rule be issued herein, directed to the Sheriff and ex-officio
inheritance tax collector of the Parish of Livingston, State of
Louisiana, and commanding his to show cause if any he has or can
why the property above described should not be decreed to be
free and exempt from any payment of any and all inheritance
taxes, and after due trial that said rule be made absolute.
Futher prays that the said Henry C. Hodges be recognized as the
surviving spouse in community of the decedant Mrs. Melissa
Elizabeth Stone Hodges and as such the owner of an undivided
one-half interest in and to all the property left by decedent as
community property and that the above named children William
George Hodges, Rosalie Hodges, Jincy Hodges, Mary Elizabeth
Hodges, and Alma Dora Hodges be recognized as the sole legal
heirs of the decedent and as such the owners in indivision in
equal proportion of the other undivided one-half interest in and
to all the property left by decedent and particularly the
property hereinabove described, and as such that they be put and
sent into possession of the said property as the owners therof
to validate the title of the petitioner.
