David fought with Andrew Jackson at the Battle of New Orleans
serving as a lieutenant in an East Feliciana Militia Company.
The U.S. Daughters of the War of 1812 erected a marker on
David's grave in Scott Cemetery.
David built Hickory Hill Plantation about 1812 near Wilson, LA
of hickory, ash, hard pine and butternut. The red brick was
baked on and wooden pegs were used instead of nails. Hickory
Hill survived the Civil War and is described in the "The Writers
Program, American Guide Series-Louisiana": "...On the front,
four tall white plastered brick columns rise to a fan-lighted
pediment. The columns are of the Doric order, the outer ones
square and the two center ones round. Both upper and lower
galleries are enclosed at each end by a brick wall...". Each of
the eight rooms has a fireplace with hand carved mantels. The
kitchen, pantries and dining hall were in a separate building
reached by a covered walk.
Before David married Maria he settled the estate of his first
wife, Jane McNish. this record is filed in Clinton, LA,
Notarial Records, book G, p. 25-29. recorded 3/24/1838.
David McCants also maintained a home in New Orleans at 8 Camp &
Chestnut in the Garden Dist. where the family usually stayed in
the winter months while the children attended school.

Thursday, October 4th 1839 ---at the residence of Hon. Thos W.
Scott by Rev. A.D. Wooldridge, David McCants to Maria Young
Livingston.
He was in New Orleans when he made his will on Feb 28, 1856;
Recorded in Clinton, East Feliciana Parish, LA, #219, 5th
Judicial Court #186-#235 inclusive , and was proved Aug. 16
1865.
"In the name of God Amen. I David McCants of the city of New
Orleans do make and publish this my last will and testament in
holographic form - hereby revoking any other wills by me maid,
viz. (A Holographic Will is one written entirely in the
handwriting of the testator. In some jurisdictions, such a Will
does not require the usual acknoweldgement before witnesses}.
1st item - that my just debts be paid. 2nd Whereas doubts have
been expressed as to the validity of the donations contained in
the Marriage Contract with my beloved wife Maria Y. Livingston
posed in notarial form 3rd day of October A D 1839 and Whereas I
am unwilling that she should lose anything if said instrument
should be by any means proved inoperative, Now therefore I do
hereby will and bequeath to my wife in lieu of said sum donated
to hir in said Marriage Contract - one undivided fifth part of
my slaves to be held by hir in full property and ownership and
also four lots of ground in the fourth district of New Orleans
numbered seventeen, eighteen, nineteen and twenty in square No.
eighty and bounded by eight Camp and Chestnut Streets with the
buildings thereon it, being the same house wherein I reside at
present - I recognize this property as community and bequeath to
My Wife this residence to be held in full property and ownership
without Accounting to the community for it. I also recognize
the purchase which I maid of the tract of land in East Feliciana
on which the dwelling house and ginhouse stands - as common -
viz having purchased it at probate sale after marriage and I
will that if the residence of the community is not sufficient to
pay the community debts that so much as maybe a charge on the
plantation be reimbursed to hir out of separate estate so that
she shall hold one half of this tract clear - it being my will
that my said wife should receive what I have bequeathed to hir
in full property and clear of incumbrances in lieu of the
donation in the Marriage Contract.
3rd I hereby appoint my said wife executrix of this my last will
and testament and give hir seizin on my intire estate - this
done and written by me in my own hand writing and dated this
twenty-eighth day of February A D one thousand and eight hundred
and fifty six in the City of New Orleans and State of
Louisiana".

David McCants June 4, 1864, age 82 years, six months, 17 days.
In 1865, The sucession of David McCants is proved in Probate
Record E, 1858-1868, p. 408-409, Clinton, LA. In his will
David states that he recognizes the dwelling house in East
Feliciana to be community property because he purchased it at
probate sale after his marriage. He is likely referring to
probate sale of his deceased wife Jane McNish's community share
of real estate, as no mention is made of real estate in the
partition of her personal property. (Clinton, LA Notarial
Records, Bk G)
David left his wife, Maria, 1/5 part of my slaves, four lots of
ground in New Orleans, numbered 17, 18, 19, & 20 in square No.
80 and bounded by eight Camp and Chestnut Streets with the
buildings thereon, being the same house wherein I reside at
present. He also bequeathed her 1/2 clear of all property and
the dwelling house in E. Feliciana Parish, LA.
The Will was probated, Sucession David McCants - 5th District
court, New Orleans, East Feliciana, Louisiana.
In this matter now comes Mrs. Maria Y. McCants, surviving widow,
and respectfully represents that her deceased husband, David
Mccants, left a last will and testament which said last will and
testament is in a sealed package, and herewith presented mark.
That the same ought be opened, read, proved, recorded and
ordered to be executed, and that letters testamentary should
issue to the Executor appointed - That he left the following
heirs viz; issue of the marriage of his son, David A. McCants
deceased with Eliza Livingston, - to wit: Miss Maggie McCants,
major, and Rosamond, Texana, Caroline, Louisiana and David
McCants, minors, to whom this said mother Mrs. Eliza McCants is
trustrix - all of East Baton Rouge parish.
Also the children of David McCants, deceased, the testator,
issue of his marriage with petitioner to wit: Robert McCants, a
major, and Imogene, Blanche, Junius, Thomas, and Ernestine
McCants, minors, to whom petitioner is trustrix.
Also the children of the testator's daughter Elizabeth McCants
issue of her marriage with Lawson Higginbotham to wit: Frances,
Clayton and William Higginbotham, majors, and Thomas, Riley,
Wesley and Caleb Higginbotham, minors, for whom William W
Chapman of East Feliciana is agent and attorney in fact, the
said Higginbothams, being residents of the Parish of Morehouse.
Wherefore petitioner prays that a day may be fixed for the
opening, reading, and proof of said last will and testament, and
said Major heirs, and said Minors through their said trustrix
and through said W. W. Chapman, agent and attorney in fact, may
be duly notified to attend at the reading and probate of said
will at the time and place fixed if they think proper; that
after due legal proceedings the said will be recorded and
ordered to be executed as required by law, and that in case the
testator has appointed petitioner executrix of said last will
and testament, that letters tesamentary issue to her, and for
costs and general relief in the premises.

the foregoing petition being considered it is ordered that said
will be opened, read and probated on Wednesday, August 16, 1865
at 11 o'clock AM at the clerks Office in said Parish and that
said heirs be notified to attend thereat should they think
proper to do so. This August 9th A.D. 1865. H. Hardesty,
Clerk.
This August 16th 1865 - the said Mrs. Maria Y. McCants being
appointed by said Will, Executrix thereof with seizen it is
ordered that other testamentary issue to her accordingly and
that she have possession of all the property of the testator.
In Notarial Book A plats shows an exchange of land between David
McCants and Caleb Higginbotham. "The above work was executed on
the 12 of July 1827. P 27th June 1828. this 5th Sept. 1828.
signed: A. B. Graham, Parish Surveyor for East Feliciana
Parish". The transfer was signed by the participants and Thos.
W. Scott, Parish Judge. " Truly recorded Nov 18, 1828.
In the volume "Large Slave Owners of Louisiana-1860" by J. K.
Menn, David McCants, age 78, is listed as D. M. Cants an owner
of 84 slaves, 18 slave dwellings, 1500 acres, real property
valued at $36,000 and personal property at $65,530. In David
and Maria's household in 1860 there were seven of their children
and Maria's sister, Ann, age 47.
lists him as David Scott McCants p. 11.
Hickory Hill - this plantation was formerly owned by Mr.
Benjamin Richardson.
Per telecon 23 July 1997, with Robbie Jane McCants Jones, she
stated that Blanche Freeman had said that David's middle name
was Scott, however Robbie never found any records of David
McCants that used the Scott middle name.
"The former was born in 1781, and about 1810 came with other
families to Louisiana
and settled in East Feliciana parish. He took up his residence
on the property on which his
daughter, Mrs. Freeman, now resides, and there he continued to
make his home until his death in January, 1864. He had been
very active during his early life and became quite an extensive
and successful planter. At the time of his death he was a
member of the Episcopal church and
throughout life had been a democrat in politics."
This LARGE Feliciana Parish was divided in 1824 and split into
East & West Feliciana Parishes. The Heads of the Households for
this census were transcribed from the original rolls. Some
designated areas on this census may correspond to places in
later East or West Feliciana Parish. A head of household on this
census, by 1830, would either be listed in East or West
Feliciana Parish if they remained in the area. Make note of the
names of neighbors on this census, whose records may later
assist you in your research. The men listed on this census may
have participated in the War of 1812 and fought at the Battle of
New Orleans on 8 January 1815.
The parishes in "old West Florida.": West Florida includes
"land in that part of the Province of West Florida, as it was
governed by both England and Spain, south of the 31st parallel,
east of the Mississipi River, north of the Gulf of Mexico, Lake
Pontchartrain, Lake Borgne, an Lake Maurepas, and west of the
Apalachacola River." This would include the present-day
parishes of West & East Feliciana, E Baton Rouge, E Ascension, E
St. John the Baptist, St. Helena, Tangipahoa, Washington, St.
Tammany & Livingston. St. John the Baptist and Ascension
parishes are debatable. The Isle of Orleans was excluded. The
area actually covered and who owned it when have long been
disputed.
Also included during the time frame 1763 - 30 Mar 1798 is "land
east of the Mississippi River as far north of the 31st parallel
as the mouth of the Yazoo River (above present-day Vicksburg,
Mississippi) and south of a line running due east from the mouth
of the Yazoo across the State of Mississippi and thence across
the State of Alabama south of present day Demopolis to a point
on the west bank of the Chattahoochee River, near, present-day
Columbus, Georgia and west of the Chattahoochee River.
There is a lineage group in existence called The Sons and
Daughters of the Province and Republic of West Florida
1763-1810. Membership is open to those proving lineal descent
from a resident of the area described above, during the
prescribed time periods.

1. William Henry "Wille" Noyes, born March 10, 1896 in Missouri.
He was living in 1944 in Versailles, Missouri.
2. Hiram Franklin "Frank" Noyes, born January 4, 1909 in
Missouri. He married Marion Ross, born 1916. Marion died 1964
and was buried in City Cemetery, Versailles, Missouri. Frank
died December 2, 1972 at Lebanon, Laclede County, Missouri, and
was buried beside his wife.
3. Orpha May Noyes, born about 1910 in Missouri. She married
Hugh Hicks. Orpha resided (1977) as a widow in Lebanon,
Missouri.
4. C. Elmer Purl, born March 12, 1915 in Missouri; resided
(1977) in Springfield, Missouri.
