"The following is a partition of the negroes and personal
property belonging to and held in community of David McCants of
said Parish and his deceased wife, Mrs. Jane McCants, made by
Lafayette Saunders, Parish Judge of said Parish of E. Feliciana
assisted by Wm. Sandel and David Thomas experts duly qualified
as such, the said David McCants acting herein in his own behalf
and the heirs of the said Mrs. Jane McCants being represented as
follows (to Wit) Mrs. Elizabeth Higginbotham of the Parish of
St. Helena, aided, assisted and authorized to do this act by her
husband Lawson Higginbotham, David Alexander McCants, minor
child of said David McCants and Mrs. Jane McCants, deceased,
represented herein by his undertutor, Alexander Scott; Alexander
Hamilton Waddill, minor child of Mrs. Ann Caroline Waddill,
deceased, represented herein by his undertutor John McKneely,
David McCants the tutor of said minor being interested herein."
Lot # 1 consisted of 21 negroes, ages 1-60, listed by name,
value listed $100 to $800; 8 horses, valued $40 to $150; 26 head
sheep, $1.50 each, total $7,585.50.
Lot # 2 consisted of 20 negroes valued from $100 to $800 and
ages 1 to 34; a horse valued $100; 26 head of sheep at $1.50
each, Total $7,595.50.
David McCants drew Lot #1 and the heirs drew Lot # 2.
Witnesses: Henry Shipwith, Thomas S. McCants. Experts: William
Sandel, David Thomas. Subscribing Witnesses: David McCants,
Elizabeth Higginbotham, Lawson Higginbotham, John F. McKneely,
Alexander Scott. Recorded Mar 24, 1838.
"The heirs then divided their share of the estate to suit
themselves - each receiving several negroes, shares of the
capital stock of the Clinton and Port Hudson R. R. Co.
Alexander Hamilton Waddill drew Lot # 1, amt. to $2515; David
Alexander McCants drew Lot # 2 amt. to $2450; Elizabeth
Higginbotham drew lot # 3 amt. to $2420."
Jane McNish was Referred to as Jeanette McCants on her daughter
Caroline's tombstone in Copiah Co. MS. She was also listed as
Jannet in a donation to one of her daughters which she signed
with a mark and someone wrote her name.
On p. 14 described her as Caroline Jane McNish. Her will
recorded in Clinton, LA Mar 24, 1838 listed heirs: Elizabeth
Higginbotham, wife of Lawson Higginbotham; David Alexander
McCants, minor son, represented by Alexander Scott; Alexander
Hamilton Waddell, minor son of Mrs. Ann Caroline McCants
Waddell, deceased, represented by John McKneely.
These children received their share of their mother's community
property, half of the estate, before David remarried. It was
also thought that David and Jane had a son by the name of James
Nathaniel who died young.
