Austin Sandidge was Born [page crumbled]. d.s.p. Will recorded in Spotsylvania Co. VA. Extracted from "Virginia Soldiers of 1776" p.68.

Your memorialist, represents to your Excellency, that Austin Sandridge, the brother of Ann Bronaugh and Winifred Boxley, was an officer in the Va. line of the Rev. army. He died intestate, about the year 1822 or 24, and without issue, leaving a widow, Mary Sandridge surviving him. He devised in his will his landed estate to his sisters above mentioned namely Ann, wife of David Bronaugh, and Winifred the wife of Joseph Boxley--all of whom are now living in Louisa county. The said Austin Sandridge, at the time of his death was a resident of Spottsylvania Co. where his will is recorded.

Lieutenant Austin Sandridge.
Spotsylvania Co. court, Sept. term, 1853. Whereas, Larkin Sandridge, a son of James Sandridge, decd. and heir at law of Austin Sandridge, decd. who was a Lieut. in the Va. Contl. line of the Rev.war,--was entitled to his share of military land, has within the past six or seven years died, leaving one heir, a daughter, who in the year 1852, also died.

Therefore the only heirs at law of said Austin Sandridge are:--1st, The children of Ann Bronaugh, decd. These are Mary G. Taylor (Tyler?), Elizabeth Trice, Thomas, David, John, William, Jeremiah and James Bronaugh;

2nd, The children of Winfred Boxley, namely: James and Pattison Boxley, Winifred Goodwin, Mrs. Mary Massey, Ann Boxley, Sarah Turner, George and Joseph Tyler; and

3rd., The children and heirs of James Holladay (who married Sophia Sandridge, a sister of Austin Sandridge); namely:-- Elizabeth Holladay (dau. of James and Sophia); Mary B. Frazer (dau. of Lewis Holladay, a son of James); Ellen M. Stewart (dau. of Dr. James Holladay); and Elizabeth and Mary Hughes (two children of Sophia Holladay, who married Lundin J. Schooler, and who was a daughter of James Holladay) also William J. Reason and Ann Rawlings (two children of Ann Holladay, daughter of James).

Spotsylvania Court 5 Sept 1853. Austin Sandidge served in the 2d regiment of the Virginia State Line. He died in Spotsylvania Co before 6 December 1825 testate without issue and widow was Mary.

Ann Sandidge sister died l852 married David Bronaugh of Louisa Co VA and it lists the Bronaugh children.

Winifred Sandidge sister married Joseph Boxley in Caroline Co. She died before 1853 and it lists 6 children

James Sandidge was a brother died before 1841 lived in Henrico Co VA and had children Larkin Sandidge died around 1846 widow Eliza Ann, Elizabeth Jane Sandidge, Mary Jones adopted daughter

Sophia Sandidge sister d before 1853 married James Holladay and lived in Spotsylvania Co VA children were named for 2 generations of Holladay and Schooler families.

Note. Dr. James Holladay is said to be a grandson of James Holladay, and the Sophia who married Lundin Schooler is a question as to whether she is James wife, and married a second time, or if she is a later Sophia. The so called legal language is so unintelligible that the courts can find Satisfactory proofs where I fail to find lucid information. In the foregoing mixture of names, I hope those interested may solve the maze of relationships. I have copied it as the clerk copied it from court records.

A letter from H. L. Brooke, Counsel, May 29, 1841, to the Executive of Va. The enclosed lists were furnished me by the Agents of the heirs of the officers, whose claims for additional L. B. have recently been rejected, by the Executive. They exhibit the practice of the Government from the earliest period to the present time in relation to one class of these claimants--Supernumerary Officers, and show that of the whole number of officers who became superny. by the reduction of the Regiments in 1778, there are but three who have not been allowed the additional bounty, who entered the service more than six years before war ended. As these lists were not before the Executive when the claims referred to were rejected, I now submit them. and respectfully ask a reconsideration of the claims. Signed, H. L. A list of Supernumerary Officers of Va. State Line and State Navy who have drawn additional land bounty.

[p.428] ttt On another page a list of Superry. Officers of the Va. State line who have received additional land for service over six years is given. All reported as Superys. save one (C Edenburg) have received B. L. from Va. although it is a well known fact that many have not served three years, being appointed in the Summer and Fall of 1779, and all retired 31st Dec., 1781, particularly the Illinois and Crockett Regts.

All the naval officers who became superny. have drawn, although many were appointed in 1777 and 78, and became superny; yet all have at times from 1782 to the present day received B. L., both Contl., State, and Navy, and when the service exceeded six years, have received additional B. L., and in all instances, at all times, from 1782 to the present day, Captains, Lieutenants have received the land of Captains. and in the case of Capt. John Tibbs, he is shown to have been a Capt. Lieut. in the Spring of 1778, and a Junior Capt. on the 14 Sept., 1778, when he became a Superny.

It is respectfully suggested that the evidence of the record made at the time, should outweigh the certificate of any officer, given from bare recollection, twenty years or more afterwards. As Tibbs land was drawn in 1800, it is presumed that the certificate referred to, was obtained for the purpose [p.429] of obtaining the allowance of land. The officer himself died in Lexington, Ken. in 1785, hence he could give no explanation as to his rank.

I cannot believe that the Governor and Council will disregard an established rule acted on ever since 1782 as to Superny; Capts. and Lieuts., to say nothing of all the other classes especially at this day, when nineteen twentieth of all have since been allowed, and must believe that they will be disposed to review and reconsider those cases.

If you see the Governor, lay this statement before him. Should all efforts fail before the Governor and Council, I will get the parties to petition the Legislature--many were obtained in this way. At an early date, even the Legislature decided that Superny were entitled--see the resolution in the cases of Nathl. Lucas, Augustine Slaughter, James Upshur and many others.

Lieut. Austin Sandridge became a Superny at the reduction of the Regts. at White Plains, 15 Dec., 1778 (see extract from Washington papers, here with filed). It does not appear when he enlisted in the service--that is immaterial, since no particular period of service before he became superny is necessary to be shown to give him a title to land tilt the officers upon the list contained in the extract referred to have received land, with the exception of Sandridge and Bell--the last of whom is stated to have been of too exceptionable a character to be recommended. According to the provision of Congress, to be recommended, a large majority of those who have not served three years before they became superny. Indeed, superny officrs have always been entitled to original bounty land, and a vast majority of them have drawn additional bounty for a service to the end of the war, estimating the time from the period at which they enlisted in the service. The above argument of Counsel Brooke is at least consistent, or logical. If the other officers hart been favored, it was rather hard on Sandridge to have a change in methods before he received his share.

To His Excellency, The Acting Governor of Virginia.

Names and rank of the officers of the Va. Contl. line, who retired as Supernumeraries at the first consolidation of the Contl. Army at White Plains, Westchester Co., New York, on the 14 Sept., 1778.--with the bounty land drawn by them from Va. and the period when drawn.

[p.433] Of the officers marked Pris. (prisoners) many, probably two thirds again entered the service after they were exchanged, and served to the end of the war. Some few of the officers enumerated, accepted apointments in the State line, as did William Cherry, Benjamin Kinley and Augustine Slaughter.

There were two other consolidations subsequent to the 14 Sept., 1778, and previous to 3 Oct., 1780, in which officers returned as supernys, in neither of which were the supernys half as numerous as those at the first consolidation. It is not known where to refer to them. The first list is on file with the Washington papers, in the State Dept. at Washington, D.C.

All supernys in all the lists drew their bounty land with the exception of Captain Colston and Lieuts. Sandridge and Livingston. They have also drawn additional land for term longer than six years, from the commencement of their service, to the end of the war.

These officers did not serve three years previous to 14 Sept., 1778, as on the 14 Sept., 1775, the officers of one company only, had been appointed, and that was commanded by Captain John Green.

In his appeal to the Executive; H. L. Brooke also said (beside what has been quoted before); It does not seem as though a rule of decision which has been adhered to by all persons whose business it was to pass on these claims, persons, many of whom were then intimately acquainted with, and had borne a part in that struggle, will not be abandoned when, at most, there are but few, very few cases which have not already been satisfied.

Admitting it to be true that many claims have been improperly allowed, in consequence of too much reliance being placed on parole testimony, yet when a case is presented, the facts Of which are sustained by the records, can it be a different construction of the law will now be adopted, from that which has been persued for fifty nine years?
