First I recommend my Soul into the Hands of god that gave it and
my body to the earth to be decently Buried at the Discretion of
my Executor hereafter Named and Touching Such Temporal Estate as
it hath pleased god to bless me with in this Life I give and
dispose of as followeth
Imprimis I give and bequeath forty foot Square of my Land to be
laid of at the Usual Place for a Buriing place never to be sold
nor disposed of for any other use but to remain so forever,
Item I lend to my son Wm. Cox and Margret his wife that part of
my Land he now lives on during their Natural lives to be bounded
by the road that Leadeth from John Pickets old field to Samuel
Allens and the path that was formerly Called Harpers path at a
Marked white oak and after the decease of my said son Wm. Cox
and Margret his wife I then give and bequeath the said Land with
all the Appurtenances thereof unto my Grand son Ambrose Cox Son
of the said Wm. Cox to him and his heirs Lawfully begotten of
his body and for want of Such Heirs the said Land to go to my
Grand son Ayress Typus Cox to him and his Heirs Lawfully
begotten of his body with all the Appurtenances thereof.
Item I lend to my son Henry Cox and his wife Ann During their
Natural lives all the remainder of my Lands and after their
decease I give & bequeath the said Lands with all the
appurtenances thereof to my Grand son John Cox son of Henry Cox
to him and his Heirs Lawfully begotten of his body and for want
of Such heirs the said land to go to my Grand son Wm. Cox son of
Henry Cox to him and his heirs Lawfully begotten of his body
furthermore the negro Girl Margery which I have lent to my son
Mathew Cox deceased and now in the possession of Richard Hodges
and Mary the wife of the said Mathew Cox decd. the said Negro
Girl Margery and all her Increase and three Head of Cattle I
Lent my Son Mathew Cox deceased which was a Cow a Heifer & a
Young Stear the said Cattle & the said Negro Girl Margery and
all her Increase I give and bequeath unto my five Grand Children
John Elizabeth Amey Clare and William Cox Children of Henry Cox
to them and their Heirs Lawfull begotten of their bodys to be
Equally Devided between them. Also my bed and Furnuture which I
lie on and one Young Heifer & one Buckeneer Gunn a Great Chist
Two Small Iron Pots & pot hooks & one Iron pot Rack & a large
frying pan and one Horse Bell I give to my Grand son John Cox
son of Henry Cox
Item I give and bequeath my Horse with Bridle and Saddle to my
Son ^ son (sic) ^ Henry Cox If it pleases god that I die
Suddenly my son Henry Cox Shall Sell my Cattle which is four
Stears a Barron Cow and a yearling to the best Advantage for
ready money
Item my will is that all the Cash that I shall have by me or in
my house and all that I shall have due to me by Bond or Accounts
and the money that my Cattle sells for Shall be Equally devided
between my son Henry Cox ^ and my son in Law James Pryor.
Item I lend to my Daughter ^ Sarah Bowcock during her Natural
Life five Negros & all their Increase Vizt. Jack (?) Sarah Judy
Jeffery and Ben and after my Decease and my Daughter Sarah
Bowcock decease Item I give and bequeath the said Negros and
all their Increase to my ^ Grand ^ Daughter Jeney Bowcock to
her and her heirs Lawfully begotten of her body and if she dies
without heirs Lawfully begottten of her body Then the said
Negros and all their Increase to go to my Two Grand Sons James &
Anthony Bowcock to them and their heirs Lawfully begotten of
their bodys to be Equally devided between them and if either of
them dies without heir Lawfully begotten of their body then the
said Negros and their Increase to go to the Longest liver if the
said Brothers
** Item I lend unto my Daughter Frances Gatewood and my son in
Law John Gatewood during their Natural lives four Negroes Vizt.
Jenny Nell Lydia and Murear and their Increase and after the
decease of the said John Gatewood and his wife Frances the said
Negros and their Increase to be equally devided between the five
Children of the said John Gatewood Vizt. Cathrine John Phillip
Chaney and Mathew Gatewood to them and their heirs Lawfully
begotten of their bodys
Item I Lend unto my Daughter Pryor and my son In law James Pryor
one Negro Girl Named Murear & her Increase during their Natural
Lives and after their decease the said Negro Girl Murear and her
Increase to be Equally Devided between the four Children of the
said James Pryor and Mary his wife Vizt. Mildred Caty Croxton &
Frankey To them and their heirs Lawfully Begotten of their bodys
Item I give to my Daughter Mary Pryor one large Skillet one pint
pot one Larg Mugg and Tankard and a Small Bason
** Item I give to my Grandson John Gatewood one Small Chist
Item I give to my Grand son Philip Gatewood one two Gallon Jugg
Item I give to my Grand son Chaney Gatewood one Two Gallon Jugg
Item I give to my Grand son Martha (sic) Cox son of Mathew Cox
decd. five Shillings Cash
Item I give to my son Henry Cox all my Waring Cloaths
Item my will is that all the Houshold goods and Stocks which I
have lent to my Children Shall and may remain in their
possession after my death without Molestation of any one
Excepting what I lent my son Mathew Cox decd.
Item I do Constitute and Appint my son Henry Cox my whole and
sole Executor of this my last will & Testament In witness

deceased was this day presented into (Page 295) Court by Henry
Cox the Executor therein Named who made oath thereto & the same
being also proved by the oaths of Samuel Allen Marthew Allen and
Wm. Allen three of the witnesses hereto and thereupon the same
is Admitted to record and on the motion of the said Executor and
his performing what ^ the ^ Laws in such Cases require a
Certificate is granted him for Obtaining a Probate hereof in due
form

Six children are identified in the will: Jannet Daniel Barr;
John Daniel, William Daniel, Agnes Daniel Singletary, Elizabeth
Daniel McCants, Martha Jones Daniel McCants.
On Jul 11, 1839, William Daniel, guardian of Sarah Margaret and
James Dodd Daniel, Agnes Daniel, Martha Daniel, and Stephen M.
B.Haselden, for $700 sold to Samuel Singletary a negro boy named
Dara, aged fifteen years witnessed by Jannet Barr, James A.
McCants and Martha M. McCants.
On Dec 26, 1840, Alexander McCants, Sr for $200 sold to James D.
Singletary two tracts of land: one tract of 96 acres granted to
James Daniel February 21, 1786 and bordering at time of the
original survey by John Jones, Sr., James Daniel and the waters
of Muddy Creek and one tract I heired from the Estate of James
Daniel, deceased, being 84 acres adjoining the other tract.
Thomas McCants renou ced his claim to these lands and Martha J.
McCants was named as wife of Alexander McCants.
On Jan 11, 1841, James A. McCants, for $33 sold to james D.
Singletary his portion of the lands of the estate of James
Daniel, deceased, said lands on waters of Muccy Creek. Wit:
James D. Daniel, Martha Daniel, and William Daniel.
