Charge: Disobedience of Orders

Specification: In this: that said Thomas F Walter 1 Lieut Co "A" 91st P.V.V. having been duly detailed to go on Picket by the Adjutant on the 31st day of December 1864 And having been told by Lt. Col Eli G Sellers Commdg the Regiment that he could not be excused unless by Surgeons Certificate did Positively refuse to obey the order stating that he would go under arrest first

Charge Absence with [sic] leave

Specification:--In this. that Said John Blum Private Co "K" 91st Pa V Vols did on or about the 10th day of October 1864 receive a furlough for 10 days to visit his home in Bermingham Allegheny [sic] Co Pa on account of sickness in his family at the expiration of which the said John Blum did fail to report to his company & regiment unlit [sic] arrested as a deserter and forwarded under guard to his regiment Jany 9" 1865

All this at or near Petersburg Va on or about the 9" day of January 1865

P.V.V did absent himself from his Company and Regiment without proper authority on or about the 8th of March and did remain absent until arrested at City Point and was returned to his Regiment on the 12th inst. under guard. this at Camp near Hatchers Point Va

I have the honor to submit the following report in case of M.D. Miller Private Co "C" 91st Regt. P.V.V.

He is reported on the Rolls of the company as a drafted man from the fourteenth district. Franklin County Penna and reported for duty on the 27th of Sept. 1864, was sent to this Regt. along with a detachment of one hundred Drafted men and Substitutes, and arrived on the 14th of Oct. 1864 since which time he has been with the Regiment and has always been attentive to his duties

I have the honor to submit the following report called for in the case of Zachariah A Schaffer Co F 91st Regt P.V.V. I learn from Sergt. Hause of that Company (the Captain being absent on leave) that this man was sent to this Regiment along with a Detachment of One Hundred Drafted men and Substitutes on the 14th day of Oct. 1864, as a Drafted man from the 16th Dist of Penna, and was assigned to Co F on the 15th of that month. He was sent to the Div. Hospital on the 21st day of Oct. 65 [sic], and has never been with the Regiment since that time

Charge 1st. Disobedience of Orders

Specification 1st that Capt Joseph Gilbert Co "C" 91st Regt P.V.V., when ordered by the Commanding Officer of the Regiment, Lieut. Col Eli G. Sellers, to take Command of Co F in the first division of the Regiment, while on Parade for Review, he the said Capt Joseph Gilbert, did not obey the order but did say in a very disrespectful manner, that there was some God damn funny things agoing on here.

Charge 2nd Contempt and disrespect towards his Commanding Officer

Specification 1st In this that Capt Joseph Gilbert did when ordered by his Commanding Officer Lt. Col. Eli G. Sellers, to take command of a Comp. in first Division of his Regiment behave in a very disrespectful manner and say that there was some God damn funny things agoing on here

This at or near Hatchers Run Va on or about the 16th day of March 1865

I have the honor to submit the following Report in the case of Capt Gilbert. It is true he was placed under arrest on the 16" day of March while the regiment was on review, for disobedience of orders & conduct prejudicial to good order & military discipline. He was tried before the court of which Howard W Prince 20 Me. Vols was judge advocate on the 28" day of the same month since which time his case has not been heard from. He has forwarded his resignation to these Hd Qrs which was returned to him as I did not think that it would be proper to forward it while awaiting the result of the trial

This Officer did absent himself from the regiment without proper authority on or about the 31st day of March and did remain absent until the 23 day of April 1865
