Before the war

He was born in 1827/28 (5 (34 in 1862)). He was born in Philadelphia, Pennsylvania (5).

On 13 March 1859, he married Ann Cullen (9). They were married by Reverend Edward McMullen, of the Church of Our Lady of Consolation, Chestnut Hill, Philadelphia, Pennsylvania (9). They had one child:(9)

When he enlisted, he was a tinsmith (5).

Description

When he enlisted, he was 5 feet 8 inches tall, and had a dark complexion, dark eyes, and dark hair (5).

During the war

He enlisted on 4 September 1862 (6, 9). He was mustered into service on 12 September 1862 (9; see also 1 [14 Sep], 5 [13 Sep]). He was enlisted for three years, at Philadelphia, Pennsylvania, by Lieutenant Gregory (5). He was mustered into service by Colonel Reiff (5). He was a private in company A (1, 13).

He was wounded on 3 May 1863, at the Battle of Chancellorsville (2, 8, 11 [slightly wounded], 12 [slightly wounded]). He apparently received a medal connected with those wounds (9 see page 16).

He died in Finley Hospital, at Washington DC, on 17 June 1863, of those wounds (1, 3, 5, 6 [27 [?] Jun 63], 8, 9 [27 Jun]). He was a private in company A (1, 3, 13). Perhaps he was buried in Philadelphia, since the Philadelphia death records include a death record for him (8).

After the war

On 3 August 1863, his widow, Ann Mills (later Ann Schaub) applied successfully from Pennsylvania for a pension (6, 7, 9). She was living in Chestnut Hill, Philadelphia, Pennsylvania (9). Her pension began 27 June 186, and the certificate was dated 27 or 28 May 1864 (9). She initially received $8 per month (9).

On 27 October 1864, her pension certificate was transferred to California (9).

On 17 October 1866, she applied for an increase in pension, and received an additional $2 per month for their child Joseph Mills, until he was 16 (9).

On 8 April 1872, John Schaub was appointed guardian of the estate of Joseph Mills (the son) (9). On 21 April 1867, his widow, Anna Mills, married John Schaub (also spelled 'Sharp'), at Petaluma, California (9).

On 21 June 1872, Joseph Mills, his son, applied successfully from California for a pension (6, 7, 9).

In November 1872, Annie Schaub and her family were living at 96 Broadway Street, San Francisco, California (9).

On 20 May 1905, Annie Schaub's second husband, John Schaub, died, at San Francisco, California (9). According to his newspaper death notice, he was the father of John, Mary, Winnie, Annie, and Caroline Schaub, and Joseph Mills (9).

In 1917, his widow successfully applied for a renewal pension (6, 9). She was living at 11 Lafayette Street, San Francisco, San Francisco County, California (9). She received $20 per month beginning 2 January 1917 (9).

In 1920, his widow, Annie Schaub, was living at 11 Lafayette Street, San Francisco, San Francisco County, California (10). She was living with her daughters Mary and Winifred (10).

On 19 October 1925, his widow, Annie Schaub, died (9).

I have the honor to acknowledge the receipt from your Office of application for Pension No. 29.798, and to return it herewith, with such information as is furnished by the files of this Office.

It appears from the Rolls on file in this Office, that Joseph Mills was enrolled on the 4th day of September, 1862, at Philadelphia Pa. in Co. "A", 91st Regiment of Penna Volunteers, to serve three years, or during the war, and mustered into service as a private on the 12th day of September, 1862, at Philadelphia Pa., in Co. "A", 91st Regiment of Penna Volunteers, to serve three years, or during the war. On the Muster Roll of Co. "A" of that Regiment, for the months of May + June, 1863, he is reported "Died at Gen'l Hospital Washington D.C. June 27. 1863 of wounds."

On this Third day of August A.D. 1863, personally appeared before me, Prothonotary of the Court of Common Pleas, which I certify to be a Court of Record of the County + State aforesaid Ann Mills a resident of Philadelphia in the County of Philadelphia and State of Pennsylvania aged Twenty Eight years, who being first duly sworn according to law doth on her oath make the following declaration; in order to obtain the benefit of the provision made by the Act of Congress, approved July 14th, 1862, that she is the widow of Joseph Mills Deceased who was a private in company "A" commanded by Col Gregory in the Ninety First Regiment of Pennsylvania Volunteers in the War of 1861, who died at Finly Hospital in Washington D.C. on the Seventeenth (17th) day of June A.D. 1863 from the effects of wounds recieved [sic] at the Battle of Chancellorville Virginia.

That her maiden name was Ann Cullen and She further declares that she was married to the said Joseph Mills on the 13th day of March in the year 1859. at Philadelphia. Pa. by Rev. Edward McMullen. and that she knows of no record evidence of said marriage and that the aforesaid Joseph Mills died on the day above mentioned, and that she has remained a widow ever since that period, as will more fully appear by reference to the proof hereto annexed. She also declares that she has not, in any manner, been engaged in or aided or abetted the rebellion in the United States. She further declares that the following is the name and age of all the child [sic] under sixteen years at the date of its [sic] father viz: Joseph Mills born on the 4th day of May 1863 who resides with its [sic] mother at Chestnut Hill in the 22nd Ward in the city of Philadelphia aforesaid.

Also personally appeared John Golden and James Holmes residents of Philadelphia, Philadelphia County + State of Pennsylvania, persons whom I certify to be respectable and entitled to credit, and who being by me duly sworn say that they were present and saw Mrs Ann Mills sworn and sign her name to the foregoing declaration: and they further swear that they have every reason to believe, from the appearance of the applicant and their acquaintance with her, that she is the identical person she represents herself to be, and they know that since the death of her husband, the said Joseph Mills that she has remained a widow. They also further state that they know the child and from their acquaintance with it [sic] they believe the above statement as to the name and age to be correctly stated by claimant, and that they have no interest in the prosecution of this claim.

Before me John Stallman an Alderman of the City of Philadelphia and ex officio a Justice of the Peace personally appeared on this Thirty First day of March AD 1864 William Harnett who being duly sworn according to law saith that he is the pastor of the "Church of Our Lady of Consolation" at Chestnut Hill in the City of Philadelphia, and as such that the records of said Church are in his Custody and keeping - that among the marriage records of said Church the marriage of Joseph Mills to Ann Cullen is regularly entered as follows

"Joseph Mills and Ann Cullen - Witnesses present
"John Golden and Mary Cullen.

The foregoing is a true and faithful copy of the record of the said marriage. Said Joseph Mills a private in Co. A. 91 Penna Vols. died as this deponent is informed and believes at the Finlay Hospital in Washington on the 17th June 1863 of wounds received in the battle of Chancellorsville. His widow the said Ann Mills still resides at Chestnut Hill in the City of Philadelphia and is a member of the Church of the Lady of Consolation at Chestnut Hill of which this deponent is pastor as aforesaid. She has not married again.

on the 13 March 1859 in the "Church of Our Lady of Consolation" at Chestnut Hill in the City of Philadelphia by the Revd E. M. Mullen. This deponent was present at the marriage ceremony and witnessed the said marriage. This deponent is well acquainted with Ann Mills (formerly Ann Cullen) the widow of the said Joseph Mills. She still resides at Chestnut Hill. The said Joseph Mills was a private in Co. A. 91st Regt., Penna Volunteers. He died at Washington on the 17 June 1863 in the Finlay Hospital of wounds received by him in the battle of Chancellorville. The said Ann Mills is still a widow.

Shanklin Pension Agent of the U.S. Pension Agency at San Francisco, Ann Mills a resident of the City + County of San Francisco Cal. aged 32 years who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefit of the provision made by the 2d. Section of the Act of Congress increasing the pensions of widows and orphans approved July 25. 1866:

That she is the widow of Joseph Mills who was a private in Co. A. 91 Regt Penn. Vols in the War of 1861: and that by reason of his death in the service aforesaid, she has been granted a pension of Eight dollars. per month in accordance with a certificate numbered 23236 bearing date May 27. 1864. She further swears that she has the following named children of her

That on the 2nd day of April 1867 said Ann Mills widow of Joseph Mills late a private Co "A" 91st Pa Vol. was remarried to John Schaub named Sharp in church record this claimant at Petaluma by Rev Father Birmingham whose affidavit is enclosed herewith. That said Joseph Mills left surviving him one Son, the legitimate child of Joseph and Ann Mills. That the name of said child is Joseph Mills and it was born at Philadelphia Pa on the 4th day of May 1863 and was baptised on the 10th day of May 1863 by Fr Wm Harnett That said Joseph Mills was never married prior to his marriage with Ann Mills (formerly Anna Cullen) and said minor Son Joseph Mills was the only issue of said Marriage - the proof of which marriage is now on file in the pension office to which reference is hereby made. That he hereby appoints W. H. Aiken

ON THIS 27th day of December A.D. one thousand nine hundred and sixteen personally appeared before me, a Notary Public within and for the County and State aforesaid Annie Shaub aged 86 years, a resident of San Francisco County of San Francisco State of California who, being duly sworn according to law, makes the following declaration in order to obtain re-newal [sic] pension under the provisions of the ACT OF CONGRESS APPROVED APRIL 19, 1908, as amended by the Act of September 8, 1916.

That she is the widow of Joseph Mills who was enrolled under the name of Joseph Mills at Philadelphia on the 14th day of September 1862 as a private in Co "A" 91st Regt Penn Vol Inft and died in service Sept 14th 1862, having served ninety days of more during the late war of the rebellion. That the soldier was not in the MILITARY OR NAVAL SERVICE of the United States except as stated above [blank]. That she was born in Ireland Jan 1st, 1830.

That she was married under the name of Annie Cullen to said soldier at Chestnut Hill Philadelphia, on the [blank] day of March 1856 or 1857 by a Chatolic [sic] Priest; that there was no legal barrier to the marriage; that she had not been previously married; that the soldier had not been previously married.

That the said soldier died Sept 14th 1862, in service that she was not divorced from him;

That the NAMES and DATES OF BIRTH of all the children of the soldier, now living and under SIXTEEN YEARS OF AGE are as follows:

That after the death of the soldier she married John Sacaub [sic] at Petaluma California about April 1867 and he died at San Francisco California May 20th, 1905. That she has not since remarried and John Schaub never rendered any military or naval service in the United States.

That she has heretofore applied for pension, Application No. Was a pensioner cannot recall certificate number

In reply will say that this is a current number of an original widows claim. You will find that the application filed by us Jan 2nd, 1917, is for a renewal of widows pension, and the number of the claim should be some early widows certificate number, as the soldier died in 1862 while in the service and she remarried about April 1867 and prior to her remarriage had been granted a widows pension.

ON THIS 4th day of January, A.D. 1917, personally appeared before me a Notary Public in and for the aforesaid County, duly authorized to administer oaths Mary Connolly aged 51 years, a resident of San Francisco in the County of San Francisco, and State of California whose Post-office address is 244 Guerrero Street, San Francisco California. well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: That the affiants [sic] most earliest [sic] recollection of happenings in life is the above named claimant and her second husband John Schaub. That affiant was born in Marin County California and claimant and her husband John Schaub were near neighbors. That the affiant has been most intimately acquainted with the claimant, claimants [sic] children and affiant went to school together and affiants [sic] has been most intimate with the family all of affiants [sic] life. That the claimant and John Schaub were never divorced and that they lived together as man and wife until John Schaub died affiants [sic] is most confident for if there had been a divorce affiant would have heard of it.

That after the death of John Schaub in 1905 the claimant has not remarried.

Means of knowledge from personal intimate acquaintance and being near neighbors.

She further declares that she has no interest in said case and is not concerned in its prosecution.

ON THIS 3rd day of January, A.D. 1917, personally appeared before me a Notary Public in and for the aforesaid County, duly authorized to administer oaths Ellis Miller aged 49 years, a resident of San Francisco in the County of San Francisco, and State of California whose Post-office address is #452 Haight Street, San Francisco California. well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: That she first made the acquaintance of the above named claimant in Marin County California about thirty years ago. She was then the wife of John Schaub, and they were know [sic] and recognized in the community in which they resided as man and wife. That from the time of making their accquaintance up to the death of John Schaub they lived together as husband and wife and were never divorced. That John Schaub died in San Francisco California in May 1905 since which time the claimant has not remarried.

Means of knowledge from personal intimate acquaintance and being neighbors during the entire period both in Marin County, and San Francisco California.

She further declares that she has no interest in said case and is not concerned in its prosecution.

ON THIS [blank] day of January, A.D. 1917, personally appeared before me a Notary Public in and for the aforesaid County, duly authorized to administer oaths Annie Schaub aged 86 years, a resident of San Francisco in the County of San Francisco, and State of California whose Post-office address is #11 Lafayette Street, San Francisco California. well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: That she is unable to furnish a verified copy of the public record of death of John Schaub, for if the same existed it was destroyed by the fire of April 1906 in the City and County of San Francisco California, and in liue [sic] thereof she herewith furnished a verified copy of the publication of the death notice of John Schaub

That she has been married twice in her life first to the soldier Joseph Mills, and after his death she remained a widow until she married John Schaub and after she married said John Schaub, they lived together as husband and wife until his death and were never divorced.

That John Schaub never rendered any military or naval service in the United States.

That she is unable to furnish the testimony of persons who knew her while she was a widow showing that she never married again until she married John Schaub as they are dead or whereabouts unknown. Asks that the sworn statement to her pension vouchers that were executed when she was a pensioner to be accepted in connection with the testimony of Ellis Miller, Joseph Taylor and Mary Connolly be accepted [sic] to prove no prior marriage, no divorce from Schaub and no remarriage since.

She further declares that she has no interest in said case and is not concerned in its prosecution [sic!].
