GEORGIA WILLS 42 Georgia Warren County In the name of God, Amen. I JOSEPH PEAVEY SEN of the State and County aforesaid, being weak in body but of perfect mind and memory but knowing that it is appointed for all men once to die, do make and ordain this my last Will and Testament. First & principally, my body I recommend to the earth to be buried in a decent manner at the descretion of my executors herein named, & my soul I recommend to Almighty God, that gave it nothing doubting at the general resurection to receive the same again by the almight power of God. And as touching such worldly estate which it hath pleased Almighty God to bless me with in this life. I demere and dispose in the following manner & form. - Item. - I give to my beloved wife, ANN PEAVEY, the tract of land I now live on, with all my stock of all kinds, also all my plantation tools, household and kitchen furniture ???? during her natural life, and at her death to equally divided betwix all my children. Item - I give to my grandson WADE HAMPTON PEAVEY one sorrel filly, also one brindel heifer, to him and his heirs forever. Item - I give to my Daughter MARY PEAVEY one Bed to be given her by my wife, to her and her heirs forever. It is my wish and desire for my wife to sell the wagon & horses also the land, and any of the stock she may think proper, after paying my grandson WADE HAMPTON his legacy. And I do constitute and appoint my son ABRAHAM PEAVEY and my beloved wife ANN PEAVEY, Executors to this my last Will and Testament, ratifying this and no other to be my last Will and Testament, and also revoking all other former wills heretofore by me made. - In witness whereof I have herein to set my hand and seal, this 25th day of August, 1810. Also I next give to my grandson Guilford Peavy one cow _[?]_ year old from the date of this writing and I farther give and bequeath to my beloved wife Patience Mizell all the remainder of my estate both real as well as personal for and during her natural life. Item the second it is my will that the above stated estate after the death of my beloved wife Patience Mizell shall be equally divided between my beloved daughters Nancy Peavy and they heirs of her body & Jincy Douglass and the heirs of her body. Item 3d I, Luke Mizell, do by these presents make ordain & appoint Patience Mizell, Dan'l B. Douglass and John Moore my sole executors to this my last Will and Testament revoking all former will[s] by me made. September 29th Luke Mizell (LS) Georgia, Screvin County: Personally appeared in open court George Newton, who being duly sworn deposeth and saith that he was present and saw Luke Mizell sign, seal and acknowledge the within instrument of writing to be his last Will and Testament, and deponent further saith that Peter Rogers and James C. The DAR Books included family records as follows for the Mizell Family (Moselle - Mazel - Misell - Measle - Meazle - Mezell) noting that the information on the Mizell Family was taken from "The Genealogy of One Smith Family," by Dr. E. V. Smith, Auburn, Alabama, 1960, which includes information on Smiths, Coxes, Mizells, Loves,Bryans, Crittendens, Mahones, Flournoys, Marshalls. Other information was taken from "The Alabama Historical Quarterly," Spring Issue 1957, Vol. 19, No. 1, "Dale County and Its People During the Civil War." (Reminiscences of Mary Love (Edwards) Fleming). Three brothers of Huguenot faith emigrated from the Moselle River section of France to Old Abermarle, of NC, before 1702. Joshua Mizell and the unnamed brother settled in what was later Bertie County, NC. Joshua was the father of: --Kader (or Cader) Mizell, died c. 1825. His descendants migrated to Kentucky, Illinois, Kansas, and Midwest. --(Probably) David Mizell, who settled in Florida. Thomas Mizell settled in what was later Martin County, NC. He was the father of: --Luke Mizell, whose descendants migrated to Georgia. --William Mizell I, whose descendants migrated to Georgia, Alabama, Florida, and Texas. --James Mizell, who moved to Jackson, Miss ca. 1810. The family of William Mizell I: William Mizell I, b. before 1700, married Sarah Griffin, daughter of Martin Griffin (probably of Chowan Precint). Their children were: William, Luke, James, and possibly John, who moved to Georgia. Luke Mizell married Sukey Jones and moved to Georgia soon after his brother William II. James Mizell married Eleanor _[?]_, Bulloch Co, GA ca. 1783. William Mizell II moved with his family to Georgia about 1771. He settled in St. Phillips Parish and had land (later in St. George's Parish). William Mizell II had four children by a first marriage. With this family he moved to Georgia. 1. Luke Mizell, b. 1759, d. 1827, m. Patience 2. Sarah Mizell, b. 1760, d. 1807, m. David Hendrix 3. Susannah Mizell, b. 1763, m. John Fletcher - lived near Tallhassee, Fla. 4. Friffin Mizell, b. 1767, near Savannah, GA, d. in Telfair County, GA, m. Susannah Carter William II married (2nd) Susannah _[?]_. They were the parents of: 1. Winnie Mizell, b. 1777, m. willie Williams, 1802.
