County of Polk } A List of
the Separate Property of Mrs. Sarah S. Bailey owned and
possessed by her Separately and apart from her husband Nathaniel Bailey
all of which
property both real and personal is situated located? and owned in the
aforesaid County of
Polk and State of Texas and is described enumerated and set forth
as follows. Towit:
The undivided half of a certain tract or parcel of Land Lying in Polk
County, containing
Three hundred and Seventy four acres known as the Arbuckle? Tract,
the same being a
part of the Thomas Bradley headright—third of a League, the boundaries
of which are fully
and at length set forth in a deed dated the 28th September 1858 made
by Nathaniel Bailey
to Mrs. Harriett M. McClenny; also all of that certain tract or parcel
of land consigned to
N. Bailey by Thomas Stubblefield administrator of Thomas Bradley by
deed dated January
3rd 1850?. Which said deed is now of record in the office of
the Clerk of the County Court
of Polk County in Record Book of Deeds B alias D pages 626, 7 &
8, the same being apart
of the Headright of Thomas Bradley and containing Forty one acres of
land.—Also all that
certain tract or parcel of land conveyed to N. Bailey by Thomas Stubblefield
administrator
of Thomas Bradley by deed dated 27th day of August 1849 which Said
deed is now on
Record in the office of the Clerk of County Court of Polk County in
Record Book of
Deeds B alias D pages 258 & 9 the same being
apart of the Headright of Thomas Bradley
containing by estimation Twenty three and one half acres more or less;
Also apart of that
certain tract or parcel of Land Conveyed to N. Bailey by Jonas Butler
administrator of
J. T. Pinckney by deed dated 1st day of November 1848 which said deed
is now of record
in the office of the Clerk of County Court of Polk County in Record
Book of Deeds B alias D
page 286, 7 & 8—The same being apart of the Headright of John T.
Pinckney containing
Seven Hundred and Twenty acres of land more or less. That is
Three hundred and Sixty five
acres off of the South side of the above described tract of land is
here understood;
Three hundred and fifty five acres off of the North Side having heretofore
been sold—to
A. P. Garner; also all of that certain tract or parcel
of land lying in Polk County and
conveyed to N. Bailey by James Andress by deed dated 15th day December
1855 which
Said deed is now of record in the office of the Clerk of the County
Court of Polk County
in Record Book F of Deeds on pages 549 & 550—The Same being a part
of the Head Right
League of John T. Pinckney containing Two Hundred and twenty acres
of land; also that
certain tract or parcel of land lying in Polk County Conveyed to N.
Bailey by E. J. Smith
Sheriff of said County by a deed dated the 2nd day of July 1856 which
deed is now of record
in the office of the Clerk of the County Court of Polk County in Record
Book F of Deeds
Pages 229 & 230, which said tract of land is apart of the Headright
of Oliver P. Hurt
Containing one hundred and sixty acres—
Also the following Town Lots in the Town of Swartout in said County
of Polk Towit:
Lots No. 2, 7 & 8 in Block 21; Lots 23 & 4, in Block 19;
Lots no 1, 2, 3, 4, 5, 6, 7 & 8 in Block 23;
Lots No 1, 2, 3, 4, 5, 6, 7 & 8 in Block 22;
Lots No 1, 2, 3, 4, 5, 6, 7, & 8 in Block 47;
Lots No. 5, 6, 7 & 8 in Block 46;
Lot No. 5 in Block 19 and also the following described personal property
Towit:
One Negro Man named John about thirty seven years of age of bright
copper color;
One Negro named Sarah about Fifty years of age of bright copper color;
Also forty head of Stock Cattle branded NB (symbol) and marked with
a crop off the left ear
and a hole in the right; also three Yoke of Oxen and one Wagon and
one Covered Carriage;
also one thousand bushels of corn in crib, also Twenty three head of
Sheep marked with crop
off the left ear and a hole in the right—In Testimony whereof we Nathaniel
Bailey and Sarah L.
Bailey have hereunto set our hands & Scrolls for seals on this
the
thirtieth day of September A.D. 1858—

County of Polk } Be it known &
remembered that on this the 30th day of September in
year Eighteen hundred fifty Eight personally came and appeared Mrs.
Sarah L. Bailey wife of
Nathaniel Bailey resident citizens of Polk County State of Texas and
both to me well known
before me L. S. McMickin Clerk of the County Court of the State
and County aforesaid
and the said Sarah L. Bailey presented the foregoing as a Schedule
of her Separate Property
and Solemnly declared to me that it contained a true, correct and complete
Schedule of her
Separate Property now in possession and control of herself and husband,
claimed and owned
by herself and She the said S. L. Bailey and Nathl. Bailey signed the
Same in my presence for
the purpose of Registration—
To Certify which I have hereunto set my hand and official Seal on
this 30th day of September A.D. 1858
