For the consideration of Fifteen Hundred Dollars to us in hand paid the receipt of which is acknowledged, we have this day bargained, Sold and released, and do by these presents transfer and convey unto Martin F. Smart and C. W. Smart our undivided five sevenths interest in Homestead of the said M. F. & C. W. Smart in the following tracts or parcels of land situated in the 16th civil District the aforesaid State and County and known as the Johnathan Smart deceased lands which are bounded as follows:  viz commencing on the Shun Pike road Duvals South boundary line; Thence North sufficiently for to Embrace fifty acres of land and known as tract No. 1, Also an other tract known as tract No. 2 Beginning at a stake in the middle of the Shun Pike road, and corner to Jonathan Smart running W 5 degrees & 6 1/2 Poles to a stake

line 85 0? to Jonithan Smarts corner, Thence East 119 0 to the beginning, containing 61 1/2 acres by survey.  Also another tract of land known as tract No. 3, Beginning at Johnithan Smarts N. E. corner in the Shun Pike road, running thence with the North boundary N. 88 3/4 W. 29 22/100 chains to a post oak with pointers; thence N. 6 13/100 chains to a black Jack marked fore and aft; Thence East with South boundary of the Dower Woodland 14 67/100 to the Shun Pike - Thence with the middle of the same S. 9 W 6 43/100 chains to the beginning, containing 18 1/4 acres, to have and to hold said 5/7 interest undivided, and also our 5/7 interest in the homestead of M. F. & C. W. Smart to the said M. F. & C. W. Smart their heirs and assigns forever.  We covenant with the said M. F. & C. W. Smart that we are lawfully seized of said 5/7 Sevenths undivided interest in said lands and homestead by inheritance and the legal title is in us and we have a (good) perfect right to convey title to the same, and it is not encumbered.  And we further covenant and bind ourselves our heirs and legal representatives to warrant and forever defend the right and title in and to said 5/7 undivided interest and homestead to the said m. F. & C. W. Smart their heirs and assigns against the legal claims of any and all persons whomsoever.

It is understood and agreed that this conveyance does not have any affect or change on the present crop on these lands.  In testimony whereof we set our hands Respectively on this the 29th day of September 1900.

Sumner County         Personally appeared before me W. T. McGlothlin, a Notary Public in and for said county & State the within named I. Bracken & wife Bettie Bracken, J. B. Johnson & wife Mattie Johnson, Mollie Smart, Unie Smart & Maude Smart the bargainors with whom I am personally acquainted, and who acknowledged that they executed the within written instrument for the purposes therein contained.  And Mrs. Bettie Bracken and Mattie Johnson wives of the said Isaac Bracken and J. B. Johnson having personally appeared before me, privately and apart from their husbands, the said Mrs. Bettie Bracken and Mattie Johnson, acknowledged the Execution of said Deed to have been done by them freely, voluntarily, and understandingly, without compulsion or constraint from their said husbands, and for the purposes therein expressed.  Witness my hand and official seal at Portland Tennessee, this 29th day of Sept 1900.
