This indenture made this thirteenth day of November one thousand Eight hundred and thirty Eight Between Elisha W. Smart & William C. Smart and Martha A. Smart of the County of Green and State of Missouri of the one part and Rial B. Morgan of the County of Robertson and State of Tennessee on the other part witnesseth that the said Elisha W. Smart, William C. Smart and Martha A. Smart for and in consideration of Seventy five dollars to them in hand paid by the said Rial B. Morgan at and before the Sealing and delivery of these presents the benefit of which whereby acknowledged hath consented Bargained and sold and by these presents doth hereby bargain and Sell to the said Rial B. Morgan his heirs and assigns a certain tract or parcel containing by estimation Sixty five acres be the same more or less lying in the Said County of Robertson on Red river and bounded as follows:  Beginning at two post oaks on the south side of Red River running north one hundred and sixty poles with Joel Moon's line to Two hickories thence East Sixty five poles to a stake thence South one hundred and sixty poles to a stake thence West Sixty five poles to the Beginning together with the appurtenances thereto belonging to have and to hold the said tract of Land with its appurtenances to the Said Rial B. Morgan his heirs and assigns to the sole use of the said Rial B. Morgan his heirs and assigns  and the said Elisha W. Smart William C. Smart and Martha A. Smart and their heirs to the above mentioned tract of land with all its appurtenances unto the said Rial B. Morgan his heirs and assigns against the claims of all persons whatsoever will forever warrant and in witness whereof we the said Elisha W. Smart William C. Smart and Martha A. Smart hath hereunto set and subscribed our names and affixed our Seals this day and year above.

County of Green    Be it remembered that on the 12th day of November 1838 personally appeared before me William Smart and Elisha Smart both personally known to me to be the same men whose names are Subscribed to the foregoing instrument of writing acknowledged the same to be their acts and deeds for the purposes therein contained and also Elias Bowers and Elisha Brown Subscribing witnesses as the Signature of Martha Smart who being by me duly sworn do say that the said Martha Smart Signed and Subscribed her name to the foregoing and acknowledged the same in their presence for the purposes therein contained.
