Quit Claim Deed

Whereas heretofore to wit on or about the 7th day of Feby 1872 Sarah Garrett departed this life intestate at her late residence on Drakes Creek in the 7th Civil District of Sumner County, Tennessee, leaving as her only heirs at law and distributes Paralee M. Garrett, Josephine B. Garrett, Wm. E. Garrett, James B. Garrett, and Sarah A. Garrett. Since that time Paralee M. Garrett has also died intestate leaving as her only heirs at law and distributes two children James W. Garrett & Willie J. Garrett. The said Josephine B. died intestate without issue leaving as her only heirs at law and distributes her sisters and brothers as aboved described all of whom survived her, the said Jas. B. has married and has a wife living Mrs. Matilda Garrett. The said Wm. E. Garrett is married and lives in California, the name of his wife is unknown and is not necessary in this conveyance. The said Sarah Garrett at the time of her death owned in fee simple a tract or parcel of land on Drakes Creek in the 7th Civil District of Sumner County, Tenn., bounded on North by land of John Montgomery, South by land of Dr. John Lanier, East by Mrs. Jane Garrison & West by Drakes Creek, containing 180 acres more or less. And whereas on the 14th day of March 1873 all the heirs agreed to a division of said land into 5 separate tracts giving to each heir as nearly as possible an equal amount in acres or value said allotment was made by John Clendenning, James Watkins and Samuel D. Murry. By said allotment lot #4 was assigned to Josephine B. Garrett, and is bounded as follows to wit: Beginning at a sweet gum, thence N. 60 degrees W. 34 poles to a Buckeye, thence S. 53 degrees W. 25 poles to center of creek, thence down the same with its meanderings 34 poles to the N. W. corner of lot #3 (which was assigned to Jas. B. Garrett), thence N. 60 degrees E. 41 poles to the beginning also a lot of timber land bounded as follows: beginning at a stake, thence N. 79 degrees E. 22 poles to a stake, thence N. 99 poles to a stake in the old North boundary line W. 34 poles to a stake in said old line, thence S. 102 poles to a double oak, thence 34 degrees E. 12 poles to the beginning containing in both tracts 30 acres more or less. And whereas the said Josephine B. purchased of Mrs. Jane Garrison a certain tract or parcel of land bounded as follows: Beginning in the center of the Branch in Sarah Ann Garretts E. boundary line, thence 24 poles to stake with Beech pointers, thence N. 80 degrees E. 24 poles to a stake with Elm pointers, thence S. 10 degrees W. 8 poles to center of branch, thence S. 50 degrees W. with said branch 30 poles to the beginning containing 2 & 1/4 acres more or less. And whereas the said Josephine B. at her death owned the above described land as a 1/5 interest of the Real Estate belonging to her mother Sarah Garrett together with the land bought of Mrs. Jane Garrison above described together with a small amount of personal property. And whereas she had expressed the desire that all property belonging to her real personal or mixed should be inherited by or descend to her niece Selena D. Garrett & her daughters Laura S. and Ella P. Garrett as tenants in common. Now therefore to carry out the wish of the said Josephine B. Garrett and in consideration of above facts, we James W., Willie J., Wm. E., James B., & wife Matilda Garrett and Sarah A. Garrett have bargained sold and do hereby transfer, quit release & convey unto the said Selena D., Laura S., and Ella P. Garrett all the right title claim or interest that we have in and to any property belonging to the estate of the said Josephine B. and especially the land above described. To have and to hold the same unto the said Selena D., Laura S. and Ella P. Garrett their heirs and assigns forever. And we do hereby covenant with the said Selena D., Laura S. and Ella P. Garrett that we as the surviving heirs at law and distributes of Sarah Garrett & Josephine P. Garrett are lawfully seized and possessed of said real estate, have a perfect title thereto a good right to convey and that the same is unencumbered. And I the said Matilda Garrett wife of James B. Garrett join in the above conveyance for the express purpose of releasing any claim or interest in said land that I now have or may hereafter acquired as homestead or dower by virtue of being the wife or widow of the said James B. Garrett. Given under our hands this 1st day of August 1899.

State of California, County of Mariposa - On this the 16 day of November in the year one thousand eight hundred ninety nine before me, D. G. Kidder a Notary Public in and for the said County of Mariposa, residing therein, duly commissioned and sworn, personally appeared W. E. Garrett known to me to be the same person described in, whose name is subscribed to, and who executed the within instrument and he duly acknowledged that he executed the same. In witness whereof I have hereunto set my hand and affixed my official seal at my office in the county of Mariposa, the day and year in this certificate first written. D. G. State of Tennessee, Sumner County - Personally appeared before me D. A. Montgomery, Notary Public for Sumner County State aforesaid, the within named Jas. W. Garrett, Willie J. Garrett the bargainers with whom I am personally acquainted and acknowledged that they executed the within written instrument for the purposes therein contained. And Matilda A. Garrett wife of the said J. B. Garrett having personally appeared before me privately and apart from her husband the said Matilda A. Garrett acknowledged the execution of the said instrument to have been done by her freely and understandingly without compulsion or constraint from her said husband & for the purposes therein expressed.
