I Joseph Mason have this day bargained and sold and do hereby convey to M. W. Mason for the sum of Five dollars to me paid and the other considerations herein after mentioned, two tracts of land in the 13th District of Sumner County, Tennessee, containing by estimation fifty five and the other twenty five acres, be the same more or less and bounded as follows: The first beginning on a Beech; thence S. 94 poles to a Poplar; thence W. 100 poles to Maple & Sourwood; thence N. 94 poles to stake; thence E. 100 poles to beginning.
The other is bounded on the E. by O. Staley, E. F. Austin on the N. and S. and T. G. Moss on the W. To have and to hold the same to the said M. W. Mason his heirs and assigns forever. I do covenant with the said M. W. Mason that I am lawfully seized of said land, have a good right to convey it and that the same is unencumbered. I do further covenant and bind myself my heirs and representatives to warrant and forever defend the title to said lands and every part thereof the said M. W. Mason his heirs and assigns against the lawful claims of all persons whatsoever, also all my house hold and kitchen furniture, three head of horses, nine head of cattle, also my present crop of corn and fifty barrels and tobacco about 1100 thousand pounds, between fifty and sixty head of hogs, & etc. But this deed is made for the following uses mentioned and for other purpose that is to say I am indebted to O. Staley by note for Fifty dollars with interest about two years and thereby five dollars by account for the present year. Also James A. Mason by note for twenty five dollars. Also Joseph A. Carter Ten dollars by note with interest from the 8th of this instant. Also F. M. Durham five dollars by account. Also S. W. Morris by execution Twelve dollars with interest from the 1st of May last. Also to M. W. Mason by note for Eight hundred dollars with interest from this date. Now if I should pay the said debts by or before the 1st day of March 1858?, then this deed to be void. But if I should not then the said M. W. Mason as Trustee after giving twenty days notice in writing at the Courthouse door and at the Election Ground of the 13th District, and three other public places in the neighborhood, may expose the said lands and other property to public sale and sell it to the highest bidder for cash and appropriate the proceeds first to the necessary expenses and cost. Secondly for the satisfaction of said debts and thirdly to pay the balance if any there be to me. This 27th of September 1856. Joseph Mason (Seal)
