Article of agreement made and entered into between John Miller of the County of Sumner State of Tennessee of the one part and Nancy D. McKendree of the County of Sumner and State of Tennessee. Witnesseth that in view of this celebration of the bands of matrimony which is agreed to take place between the said John Miller and the said Nancy D. McKendree and in consideration of the sum of one dollar which is paid by each of the said contracting parties to each other in consideration where of it is covenanted and agreed that the said Jno. Miller and the said Nancy D. McKendree intermarry on or before the 3rd day of Dec. 1840. And as regards the real as well as the personal estate and its increases possessed by each of said contracting parties. It is agreed that the property both real and personal and income of the said Nancy D. McKendree shall belong to and be enjoyed by the said Nancy D. McKendree and her heirs to be under her control and management and subject to her sale or gift by deed proved and registered or her will authenticated as the law directs. As regards the property both real and personal of the said John Miller and its increases. It is agreed that the said John Miller shall in the event of his departing this life before the said Nancy D. McKendree leave or give by his will to the said Nancy Five hundred Dollars or if he should die in testate she the said Nancy there shall receive of the said John Miller's estate five hundred dollars. And it is agreed that the said Nancy D. McKendree have and retain her said property real and personal and the property agreed to be given as aforesaid in lieu of her dower in the estate of the said John Miller if she the said Nancy D. McKendree should survive him. The balance of the said property of the said John Miller not herein disposed of to be subject to the sale or will of the said John Miller or in the event of his dying in testate the said Nancy D. McKendree. If she should survive him to recover nothing therefrom without the said John Miller shall & so devise by will. In testimony of all which this marriage contract is signed by each of the contracting parties and sealed with their seals. This 28th day of Novr. 1840.

Sumner County. Personally appeared before me, Andw. McGlothlin Clerk of the County Court of said Sumner County John Miller and Nancy D. McKendree the bargainors with whom I am personally acquainted and who acknowledge that they made and executed the with marriage contract for the purposes therein _____ Witness my hand at office this 28th day of Novr. 1840. Andw. McGlothlin, Clk of Sumner County Court.
