This indenture made the 6th of August in the year of our Lord one thousand eight hundred and thirty five between Fayette Posey of the county of Henderson and Louisa J. E. Posey his wife of the county of Henderson and State of Kentucky of the one part, and Isaac Perry of the county of Sumner and State of Tennessee of the other part. Witnesseth that the said Fayette Posey & Louisa J. E. Posey his wife for & in consideration of the sum of one thousand dollars to them in hand paid the receipt whereof is hereby acknowledged have bargained and sold & do by these present bargain and sell convey unto the said Isaac Perry a certain tract or parcel of land lying in the county of Sumner aforesaid on the waters of Shelby's Fork of Station Camp Creek beginning at a rock and small walnut sprout running thence with Kirkendalls old line of the tract on which John Martin now lives North 88 & 1/2 degrees East passing a rock the Southwest corner of Allison's tract at forty two poles in all 131 & 1/2 poles to a stake thence North one and a half degree West 179 poles to a stake thence South 88 & 1/2 degrees West, 89 & 1/2 poles to a stake in Allison's western boundary line thence with said line South 1 & 1/2 degrees East, 18 poles to a stake, thence South 88 & 1/2 degrees West 40 poles to the McKoins line then South with said McKoin's line & Delian Mitchell line 161 poles to the beginning containing 140 acres one hundred and forty acres more or less together with all and singular the rights profits and privileges & appurtenances thereunto belonging or in anywise appertaining. To have and to hold unto the said Isaac Perry his heirs and assigns forever. And the said Fayette Posey & Louisa his wife do hereby for themselves their heirs and executors & C covenant and promise and agree to warrant and defend the tract of land above mentioned against, all and every legal or equable right title interest or demand of themselves their heirs and all other persons whomsoever. Signed and acknowledged in the presence of us:
State of Kentucky - Henderson County - We James Alves & Joseph Cowan two of the Justices of the peace in and for the county aforesaid do certify that this deed from Fayette Posey and Louisa J. E. Posey his wife to Isaac Perry was this day produced to us by the Grantors in our county aforesaid and acknowledged before us by the said Fayette Posey to be his act and deed & she the said Louisa J. E. Posey being examined by us privately and apart from her husband declare that she did fully and willingly sign seal and deliver said deed and wished not to retract it. And acknowledged the said deed again shown and explained to her to be her act and deed & consented that the same might be recorded which is hereby certified to the proper office in the State of Tennessee for record. I William D. Allison, Clerk of the County Court of Henderson County in the State of Kentucky do certify that James Alves & Joseph Cowan Esquires before whom the written and foregoing Deed was acknowledged are acting Justices of the Peace in and for the said County of Henderson duly commissioned and sworn & that full faith and credit ought to be given to all their official acts as such. In testimony whereof I have hereunto subscribed my name and affixed the seal of said Court at Henderson the 6th day of August 1835. Will D. Allison
