This indenture made this eleventh day of February in the year of our Lord one thousand eight hundred and twenty eight between Caswell Smith of Sumner County and State of Tennessee of the one part and William Perry of the county of Sumner and State of Tennessee of the other part witnesseth that the said Caswell Smith for and in consideration of the sum of two hundred & fifty dollars to him in hand paid by the said William Perry the receipt whereof is hereby acknowledged hath given granted bargained sold aliened conveyed and confirmed and by these presents doth give grant bargain sell alien convey and confirm unto the said William Perry his heirs and assigns forever a certain tract piece or parcel of land situate lying and being in the County of Sumner to wit: Beginning at a sugar tree and beach on the side of the hill near the big road and opposite the house where said Smith now lives running S. 43. W. fourteen and one half poles to two beaches Hogan's corner thence N. 36. W. thirty eight poles to a stake thence S. 51 W one hundred & ten poles with Hogan's line to a beach in Norfleet Perry's line thence North with said Perry's line one hundred and sixty nine poles to a large Beach thence East with the old line one hundred and twenty poles to a small ash and hickory thence South with Hogan's line of another tract one hundred and twenty poles to the beginning containing by estimation ninety seven acres more or less. To have and to hold the aforesaid land with all and singular the rights endowments, hereditaments and appurtenances  of in and to the same belonging or in any way appertaining to the only proper use benefit and behoof of him the said William Perry his heirs and assigns forever and the said Caswell Smith for himself his heirs executors and administrators to do covenant and agree to and with the said William Perry his heirs assigns that the before recited land and bargained premises he will warrant and forever defend against the right title interest or claim of all and every person or persons whomsoever in witness whereof the said Caswell Smith hath hereunto set his hand & affixed his seal the day and year first above written. State of Tennessee, Sumner County Court February Term 1821 -  This Deed of bargain and sale from Caswell Smith to William Perry for ninety seven acres of land was duly proved in open court by the oath of Norfleet Perry & Lewis Ralph subscribing witnesses thereto and ordered to be registered.
