This Indenture made this ninth day of July in the year of Our Lord Seventeen Hundred & Ninety Eight between Howel Tatum of the County of Davidson and State of Tennessee and John P. Wiggin Administrator of the estate of Henry Wiggin deceased in pursuance of the powers vested in him by an act of the General Assembly in favor in the said State, late of the County & State aforesaid of the one part and William Harper, Mark Rickman, and Nathan Rickman all of the County of Sumner & State aforesaid of the other part. Witnesseth that the said Howel and the said John P. as Administrator with the powers aforesaid for and in consideration of the sum of Eight Hundred dollars in hand paid to the said Howel and to the said Henry deceased in his life time the receipt whereof is hereby acknowledged hath given granted bargained sold aliened conveyed and confirmed and by these presents doth give grant bargain sell alien convey and confirm unto the said William, Mark & Nathan all that certain tract & parcel of land contained two surveys lying and being the County of Sumner & State aforesaid on the Waters of Goose Creek on both sides of Gibson's Trace butted and bounded as follows to wit: Beginning at a large Sealy Bark Hickory Elm & Buckeye on Levi West boundary about sixty five poles South of the said trace running from thence North three hundred & twenty poles to a stake thence West One Hundred & sixty poles to a stake then South crossing a branch and the trace and passing two sugar trees marked as corners at three Hundred & twenty poles in all four Hundred poles to a stake thence East one Hundred & sixty poles to a Sugar tree and dogwood thence North Eighty poles to the beginning containing four hundred acres granted to the said Howel Tatum & Henry Wiggin by two grants bearing date the fourteenth day of September Seventeen Hundred & ninety seven together with all woods waters mines minerals hereditaments & appurtenances. To have and to hold the before recited tracts of land & bargained premises that is to say one moiety thereof to the said William Harper and the other moiety thereof to the said Mark & Nathan Rickman with all and singular the remainder & remainders revision & revisions rents issues & profits of in and to the same belonging or in any wise appertaining to the only proper use benefit & behoof of them the said William, Mark, & Nathan in the proportion aforesaid their heirs and assigns forever and the said Howel Tatum for himself his heirs Executors & Administrators and the said John P. Wiggin as Administrator vested with the power contained in the act aforesaid for and in behalf of the heirs Executors and Administrators of the Estate of the said Henry Wiggin deceased doth hereby covenant and agree to and with the said William Harper, Mark Rickman, & Nathan Rickman their heirs and assigns that the before recited tracts of land and bargained premises they will warrant and defend in the proportions aforesaid against the right title interest claim and demand of all and every person and persons whatever. In witness whereof the said Howel Tatum for himself and the said John P. This day personally appeared Howel Tatum & John Permot Wiggin before me John Overton Esquire, one of the Judges of the Superior Courts of Law & Equity, for the State aforesaid and acknowledged the within Deed of Bargain & Sale to William Harper, Mark Rickman, & Nathan Rickman to be their act & deed delivered for the purposes therein obtained.
