Stratton To Barry - Trust
I Mosely Stratton for and in consideration of one dollar to me paid and the other consideration herein afterwards mentioned have this day bargained and sold and do hereby convey to Thomas Barry the following described personal property to wit; 1 sorrel horse about 7 years of age, 1 sorrel mare about 5 years of age, 1 other sorrel mare 7 years old and 3 yearling colts a sorrel a black & a brown, also 10 head of cattle and 25 stock hogs. I do covenant that I have a right to sell the same & do warrant the title to said Barry. But this conveyance is made for the following uses & trusts and no other that is to say I am indebted to Isaac N. Guthrie in a judgement before Thomas Boyers Esq. In the hands of Constable Chapman amounting to the sum of $173.70 and cost also to W. F. Holder & Co. in an acc. for 1859 in the sum of $63.00, also to Wm. Solomon in an account for 1859 & 59 to W. N. Montgomery in the sum of $155 dollars all of the above are now due and payable. I am also indebted as follows which is not yet due, 1 note to Thomas Barry for $166.00 and to Humphrey Bate in the sum of $50.00 by note both due next fall. Now I am desirous of securing & making certain the payment of their debts the judgement first and the debts that are due next and then the notes not yet due. Now if I shall pay off all the said debts within 12 months from this time then this deed to be void otherwise the said Thomas Barry as my trustee after giving legal notice shall expose said property for sale to the highest bidder for cash and apply the proceeds first to the expenses of this trust then to the debts as above indicated and if there should be a balance pay the same to me. I Raymond Head have this day bargained and sold & do hereby convey to Robert Elkin for and in consideration of the sum of nine hundred dollars to me paid. A certain negro boy James of dark color aged about 10 years. I warrant said negro boy to be a slave for life. Gray, G. L. & Wife To J. M. Robb - Deed of Trust
For and in consideration of five dollars to us in hand paid and the other considerations here after mentioned. We have this day bargained sold aliened & conveyed and do hereby sell transfer and convey unto Joseph M. Robb the house and lot in the town of Gallatin at present occupied by us as a dwelling and being the same deeded to the undersigned Lucy F. Gray by her father Wm. Henley. To have and to hold the said house and lot to the said Joseph M. Robb his heirs & assignees forever against the lawful claims of all persons whomsoever. And the covenant that we are lawfully seized of said house & lot and have a good right to convey it. This deed however is made for the following uses & purposes and none other that is to say the said Joseph Robb is the security of the undersigned G. L. Gray is the Guardian of the minor children of James Miller deceased, and is likewise the security of said G. L. Gray as the Guardian of John Barton and he has in his hands a fund of near two thousand dollars belonging to said wards and being desirous to secure and save harmless the said Robb on account of his security ship. Now if the said G. L. Gray shall well & truly pay off to said minors as they may be entitled to and save the said Robb harmless in every respect then this deed to be void, but if he shall fail so to do and should the said Robb have anything to pay or should he be sued on account of his being security as aforesaid then and in that event the said Robb shall after giving twenty days public notice in writing at the court house door in Gallatin and two other public places expose said house and lot to public sale and sell the same for cash to the highest bidder and apply the proceeds to the payment of whatever may be due from the said G. L. Gray as guardian aforesaid of the said Miller children and the said Barton and in order to a clear understanding it is hereby expressly stipulated and agreed that all the claims against said minors which have been settled by the note of the said G. L. Gray but which have not been paid are entitled to be secured in this deed. And it is further expressly stipulated and agreed that the undersigned Lucy F. Gray parts with no further interest in said house & lot than a sufficiency to pay off and discharge what the undersigned G. L. Gray may be indebted to the minors aforesaid and should it be necessary to sell said house & lot for that purpose and the same should bring more than a sufficiency then the surplus is to be the separate fund of the undersigned Lucy F. Gray and is to be paid over to her to be held for her own separate use and if said indebtedness shall be paid off without a sale of said house & lot then the right of the said Lucy F. Gray is to be in no ways affected by this conveyance. In whereof we have hereunto set our hands and seals this 3rd day of

In consideration of various advances made to me by my Uncle Thos. Martin of Pulaski Giles County Tennessee for my education boarding and clothing from the time of the death of my mother Nancy Cook until I left Franklin College in this state also while I was at school at the Wesleyan University of Alabama and for the further consideration of two hundred & fifty (250) dollars to me in hand paid this day the receipt whereof is hereby acknowledged. I have this day sold and hereby convey to the said Thos. Martin all my right title interest and claim in and to the estate of my Grandfather Abram Martin late of Sumner County (Deed) the said interest in said estate accruing to me as one of the heirs of the aforesaid Nancy Cook who was a daughter of the said Abram Martin. Gray & Tabb To A. W. Patterson - Deed of Trust
Whereas we are indebted to A. W. Patterson (* Patterson marked through and Putnam written) of the city of Nashville as follows to wit one confessed judgement before Thomas Boyers for about four hundred dollars also by six notes each for one hundred & fifty three dollars due at six to eighteen twenty four thirty and thirty six months from the first day of January 1860 and whereas we did on the 3rd day of February 1860 by conveyance

transfer to James W. Guthrie in trust our Book accounts notes judgements and other evidences of indebtedness and a small lot of personal property which is specifically mentioned in said securities therein for particulars reference is made to said conveyance and whereas provision for the payment of said debts are made in said conveyance after which the said James W. Guthrie is directed to pay over to us any surplus which may be remaining in his hands. Now we hereby authorize the said James W. Guthrie to pay over to the said A. W. Patterson (crossed out, Putnam added) whatever may remain in his hands after the payment and satisfaction of the debts mentioned in said conveyance or whatever sum may be necessary to pay off and satisfy the above mentioned debts and all interest thereon and if there should still remain a surplus he the said Guthrie will pay the sum to us this 4th day of February 1860.

Elliott, H. To Lewis White - Bill of Sale
I have this day sold and do hereby convey to Lewis T. White his heirs and assignees forever for nine hundred and twenty five dollars to me paid a girl slave named Phebe aged about twelve years. I warrant the title to said slave to the said Lewis T. White his heirs and assignees against the lawful claim of all persons and I also warrant her to be sound healthy sensible and a slave for life. Crowder To Hodges - Deed of Trust
We Harbert & Lafayette Crowder hereby transfer & convey to Samuel Hodges a wagon & yoke of Oxen for the sum of five dollars to us paid. The above conveyance is made for the following purpose to wit the said Samuel Hodges has this day become security on a note payable to Francis Durham for said Crowders for the sum of thirty seven and (47) forty seven hundredth dollars due November the 30th 1860 now if said Crowders pay said note at maturity the above conveyance is to be void if not said Hodges is to sell the wagon & Oxen at Sarver's Mill to the highest bidder after giving ten days notice at three or more public places and pay said note and the balance of the proceeds pay over to us after paying all legal charges. Wilson, J. M. To Joseph B. Wallace - Deed of Trust
I have this day bargained sold and conveyed and do hereby for the consideration of five dollars and the other consideration hereafter mentioned sell transfer & convey unto Joseph B. Wallace my undivided interest in a tract of land in Sumner County State of Tennessee containing two hundred and fourteen & one half acres it being the tract of land on which my mother lives my interest being the one seventh for the boundaries of said land reference is hereby made to the deeds to my father Samuel Wilson. I do also convey & sell to the Joseph B. Wallace my house & lot near Gallatin being the same in which my business and dwelling house is situated being the same lot purchased by me from Jo. C. Guild. I do also sell & convey unto the said Wallace a negro man named Simon about fifty years old also I do hereby transfer & unto the said Wallace two notes on Elliott & Love for one thousand dollars each given for a house and lot in the town of Gallatin a lien being retained upon said house & lot to secure the payment of the said two notes which lien is hereby likewise conveyed I do also transfer & convey unto the said Wallace all the notes and accounts and evidences of debt of every and description belonging to me now in the hands of Constable W. R. Lane for collection a list of which accompanys this Deed amounting to near two thousands dollars. To have and to hold the above land house & lot negro & other choles in action hereby conveyed to the said Jo. B. Wallace his heirs & assignees forever and I covenant with the said Wallace that I am lawfully seized of all the above described property and have good right to convey the same and I bind myself to forever warrant & defend the title to the same and every part thereof to the said Jo. B. Wallace his heirs & assignees. This conveyance is made however for the following uses & purposes that is to say I am indebted to the Bank of Tennessee in the sum of one thousand & eighty five dollars and sixteen cents upon which Jo. B. Wallace is my endorser and upon which judgement was rendered on the 24th October 1859 likewise to the estate of John M. Henley in two notes now due amounting to $1500 dollars likewise to Joseph Barret by note now due for $1360 likewise to Eli Odom by note due for $500 likewise to Wm. McMurray by note due for $100 likewise to Ellen Ryan by note due for $75 likewise to J. A. Blackmore by note due for $567.66 likewise to William Trousdale by note due for $591.30 upon all which claims the said Jo. B. Wallace is my security and being desirous to secure the payment of said claims and to save the said Wallace harmless now if I shall meet and pay off said debts as they may be demanded then this deed to be void otherwise the said Jo. B. Wallace shall demand from and receive from the said Constable Lane all moneys collected on the claims in his hands and shall likewise collect from the said Elliott & Love the notes for two thousand dollars herein conveyed and shall likewise after giving twenty days public notice at the court house doors of Gallatin and at two other public places expose to public sale at the court house in Gallatin the said interest in the 214 1/2 acre tract of land likewise the house & lot & business house herein conveyed and likewise the slave Simon all for cash and apply as well the moneys collected as the proceed of the sales to the payment of the debt herein mentioned

Gray & Tabb To J. W. Guthrie - Deed of Trust
We Gabriel S. Gray and Thomas T. T. Tabb partners in trade under the firm and style of Gray & Tabb have this day bargained and sold and do hereby transfer and convey to James W. Guthrie for the consideration of five dollars to us paid and for the further consideration herein after mentioned; all our Book accounts notes judgements and other evidences of indebtedness now due us for and as amount of our copartnership business not heretofore otherwise disposed of a lot of tobacco all that is up and down stairs in our house a lot of chairs five table counters fifteen benches one bedstead and mattress and clothing, one keg of lead a lot of glass ware and all crockery on hand also lot of stone ware, three boxes of cigars one box of crem of tartar one tobacco knife one table three show cases, four straw cutters seven cultivators eight small lots of pipes including all in the house and the patent right to shovel plow for this & Davidson Counties which said right we purchased of one Harris as per deed recorded in court. To have and to hold the same to the said Jas. W. Guthrie his heirs and assignees forever. We will warrant the title of the said amounts note judgements personal property and evidences of indebtedness to the said James W. Guthrie against the claims of all persons whatever, but this conveyance is made for the following uses and trusts and none others that is to say; whereas we are indebted to Trabue & Lucus of the city of Nashville by three promissory notes each for about one hundred & eighty dollars, one due the first of February 1860 the other two due in one and two months thereafter, upon all three of which W. L. Baber is our security one other note in favor of the said Trabue Lucus upon which suit has been instituted for about one hundred and eighty five dollars upon which Schell & Blakemore are our securities also to I. N. Guthrie for a balance of about two hundred and forty dollars now due, also to Trabue & Lucus by note now due for about one hundred and sixty two dollars upon which Joyne & Co. are our endorsers, and whereas Benj. Gray is our security in sundry cases to about the sum of seven hundred dollars, and we are also indebted to John B. Foster in about the sum of one hundred and seventy seven dollars now due, also to Trabue & Lucus in two judgements before Thomas Boyers for about five hundred and twenty dollars in the hands of John S. White for collection. And whereas we are desirous to secure and make certain the payment of said debts and thereby protect and save harmless our said secure ties and endorsers. Now if we shall pay off and satisfy said debts and all interest thereon as they shall fall due and become payable and save harmless our said securities and endorsers aforesaid then this conveyance to be void and of no effect but should we fail so to do then the said James W. Guthrie as Trustee

authorized and directed to procure and collect said book accounts notes judgements and other evidences of debt and to sell said personal property after giving ten days notice in writing at three or more public places in District No. 5 to the highest bidder for cash. And as said accounts notes judgements and evidences of indebtedness are collected and the proceeds of the sale of said property are received by the said James W. Guthrie he will apply the same, First to the payment of all the necessary cost included in the execution of this Trust, Secondly to the satisfaction and payment of the debts mentioned in this conveyance and all interest and cost thereon in the order in which they are herein mentioned and set forth commencing with the debts upon which the said W. L. Baber is our security and continuing until the whole of said funds are exhausted. And thereby if there should remain a surplus to pay the same over to us to our order. Whereas Lafayette Davis convey to myself and Zach. W. Davis his undivided interest in the following slaves to wit Charity aged about 52 years Martha aged about 26 years Louisa aged about 17 and her infant child Mary aged or 11 years Lucinda aged 9 or 10 years old and Ed aged 7 years in Sept 1859 and whereas the said Z. W. Davis has this day purchased of me my half interest in the above slaves for $300 the receipt whereof is hereby acknowledged I therefore in consideration of the premises transfer and convey unto said Z. W. Davis one half interest in said slaves they being the same that were left by will by Hezekiah Davis to his wife Nancy for life and after her death to his children, Given under my hand this 4th day of Feby 1860. Know all men by these presents that I, Martha Savely, Executrix of the last will & testament of John Savely, dec'd., have made constituted and appointed and by these presents do make constitute and appoint John S. Cain my true and lawful attorney for me in my name place and stead to enter into and take possession of all real estate belonging to the estate of my said testator situate in the county of Sumner State of Tennessee and to rent said real estate or any part thereof for such price or sum of money or on such terms as he may think best and to demand receive and collect all sums of money which shall become due and payable to me by reason of such rent giving and granting unto my said attorney full power and authority to do and perform all and every necessary act and thing whatsoever to be done in and about the premises as fully to all intents and purposes as I might or could do if personally present with full power of substitution and revocation hereby ratifying and confirming all that my said attorney or his substitute shall lawfully do or cause to be do by virtue hereof. Halloran To Baxter Smith - Deed of Trust
I have this day conveyed to Baxter Smith for the sum of five dollars to me paid the following property viz. mares, one sorrel aged about 10 years, the other a sorrel between eight & nine years old, also ten cows, and seven calves all of which stock is now in my possession reserving to myself the use of said property for two years from the 1st January 1860. But this deed is made for the following uses & trusts that is to say the said Smith has this day become my security for costs in a suit which I have communed in the Circuit Court of Sumner against William Utley for damages. Now if the said Smith should have to pay the cost of said suit or any part of them then he is authorized to after the expiration of the two years give legal notice & sell said property & pay the expenses of this trust pay the amount the said Smith may have paid & the balance if any to me.
