State of Tennessee, Sumner County

To the Sheriff or some Constable for said You are hereby commanded that of the goods chattles lands & tenements of Wm P. Moore & H. M. Moore if in your county to be found you will cause to be made the sum of three hundred and twenty three dollars debt with interest from the 17th of Jany 1861 & all lawful costs the amount of a judgement that W. W. Berry & Demoville obtained against the said W. P. Moore & H. M. Moore before me on the 17th day of January 1861, herein fail not.  Given under my hand & seal this 23rd day of Jany 1861.  Jos. Roberson, J. W. To Geo. W. Allen - Deed of Trust

For and in consideration of five dollars to me paid & the other considerations hereafter named I have this day bargained & sold and do hereby sell a lien & convey unto Geo. W. Allen his heirs & assigns forever the following three tracts or parcels of land situated in Sumner County Tennessee & Dist. No. 15 & bounded as follows to wit, one tract Beginning at two Chestnuts the South corner to the original survey of 640 acres running West 100 1/2 poles to a Black, Thence North 101 poles to a White Oak, Thence East 100 1/2 poles to a Black Oak, Thence South 101 poles to the Beginning  One other tract lying on the East being the same tract bought by Noah Summers of Wm. Briley both tracts containing 67 acres, Two other tracts one containing fifty acres, the other containing sixteen acres be the same more or less being the same bought by me from John Summer & for the boundaries of which reference is here made to the Deed of the said Summers to me.  To have & to hold the above described lands to the said Geo. W. Allen his heirs & assigns forever and I covenant with the said Geo. W. Allen that I am lawfully seized of said lands and have a good right to convey them.  And I bind myself my representatives etc. to forever warrant & defend the title of the said lands to the said Geo. W. Allen his heirs & assigns against the lawful claims of all persons whatsoever.  This deed is made for the following uses & purposes & no other that is to say I am indebted to W. B. Bate Geo. W. Allen & James J. Turner each in the sum of one hndred & twenty five dollars by note this day executed and due in twelve months.  And being desirous to secure and make certain the payment of

the same.  Now if I shall at before the said three notes fall due pay off and discharge the same then this conveyance to be void, otherwise the said Geo. W. Allen as Trustee shall after giving twenty days notice by advertisement at three or more public places expose said lands to public sale and sell the same for cash and apply the proceeds first to the satisfaction of said three notes, Secondly to pay the balance over to me if any there should.  In witness whereof I have hereunto set my hand This 11th day of Feby 1861.

Chaney, M. W. To A. J. Duncan & Co. - Mortgage

This indenture made and entered into this the 28th day of January 1860 between Moses W. Chaney of the county of Allen State of Kentucky of the first part & A. J. Duncan & Co. of the city of Nashville County of Davidson State of Tennessee of the second part, Witnesseth that the party of the first part hath this day for and in part consideration of and to partly secure to the party of the second part the payment of two different notes due & payable as follows to wit.  first note No. 429 for fifteen hundred & thirty three dollars and 11 cents executed November the 12th 1859 and due four months after date & Note No. 430 for fifteen hundred & thirty three dollars & 11 cts. executed November the 12th 1858 and due six months after date bargained sold & conveyed and by these presents doth hereby bargain sell & convey to the party of the second a certain tract or parcel of land lying & being in the county of Sumner State of Tennessee & on the waters of the middle fork of Drakes creek & District No. 16 of sd. Sumner County & bounded as follows to wit Beginning on James Durhams NW corner, Thence South with sd. line to Peter Borders corner Thence with Borders line to Mary Ann Groves line, Thence West with said Groves line to a Post Oak Groves corner, Thence North to a White Oak, Thence West to Lamberts line, Thence North with sd. Lamberts, Groves & Dowels line to the Kentucky line, Thence with sd. line to the Beginning.  Containing about four hundred acres and I the sd. Moses W. Chaney of the first part do hereby bind myself my heirs etc. forever to warrant & defend the right title & interest of the above described tract or parcel of land to the sd. parties of the second part their heirs & assigns free from the claim or claims of any & all persons whatever.  But it is understood between the parties that if the sd. party of the first part shall well & truly pay or cause to be paid to the parties of the second part the notes above mentioned in this Deed & the interest accrued & accuring & the cost attending this deed then this Deed of Mortgage shall be void and of no effect, Otherwise to remain in full force & effect.  In testimony of all which I have this day set my hand & affixed my seal the day & date first above written and we the party of the first part & the parties of the second part do hereby make constitute & appointed William S. Munday of the county of Sumner State of Tennessee our true and lawful Attorney to sell for cash the above described parcel of land first advertising the same at least thirty days prior to sd. sale & at any time after the first note that is Note No. 429 becomes due and convey the same witness as above.

To any lawful officer to execute & return.  You are hereby commanded that of the goods chattles lands & tenements of J. C. Payne if to be found in your county of value sufficient you will cause to made the sum of fifteen dollars & 34 cts. debt with interest from 17th day of Jany 1860 and all legal costs the amount of a Judgement that H. J. Duncan obtained against the said Payne before me on the 17th day of Jany. 1860 and such money when collected pay over as the law directs.  This 11th day of Jany. 1861.

Moss, Wm. W. & Wife To F. R. Derritte - Power of Attorney

(Note - Francis Richard (Dick) Durrett, the son of Francis Durrett and Elizabeth Grymes Moore, was married to Jane Lattimer, August 12, 1833 in Sumner County, Tennessee)

Whereas Daniel Latimer died in Sumner County Tennessee in the year 1856 & left a last Will & Testament which was admitted to Probate by Sumner County Court & whereas by said Will his widow Elizabeth Latimer was given all the property both real & personal estate & she gave up a portion of the same to the heirs and distributees & whereas She has now on hand the real estate, some three slaves & the personal estate consisting of various articles & whereas She is desirous and willing to give her life interest up in the said estate now on hand upon conditions that five hundred dollars is left for her support during life & that the heirs & distributees will indemnify her for a further support provided the five hundred dollars is not sufficient for her support & whereas the heirs & distributees of said Daniel Latimer Dec'd are desirous of selling all of the property now on hand & of reserving to the widow five hundred dollars and of distributing the balance equally amongst the heirs and distributees. Therefore in consideration of the premises in the undersigned the widow & distributees of said estate do hereby appoint Francis R. Derritte as an Agent & Attorney in part, for us and in our names to proceed & advertise and sell all real property & personal and when the proceeds are collected or the notes are given our said Agent & Attorney is authorized to pay the widow the sum of five hundred dollars & to pay over & distribute the balance equaly amongst the heirs & distributees equally after the expenses are paid and we the undersigned heirs and distributees of Daniel Latimer Dec'd acknowledged ourselves indebted to Elizabeth Latimer in the sum of one thousand dollars to be all & truly paid they bind themselves their heirs distributees Executors.  But this obligation is so conditional that if the said Elizabeth Latimer should ever need anything more for her comfortable support than said five hundred dollars we shall pay over equally to the said Elizabeth Latimer a sufficient sum of money to support her, then this obligation to be null & void, Otherwise to remain in full power & effect.  If there should be any portion of the five hundred dollars remaining after the death of the widow then the same is to be distributed between the heirs & distributees.  The aforesaid Agent is hereby authorized & empowered to make title to the land & negroes & other property and hereby confirm & satisfy the lawful & actings & doings of said Agent.  In witness whereof we have hereunto set our hands & seals Octr. 19th 1860.

Moss to me well known and acknowledged that he executed the foregoing instrument of writing for the consideration uses & purposes therein set forth.  And also personally appeared Mary Moss wife of Wm. W. Moss aforesaid parties to the foregoing instrument of writing dated October 19th A. D. 1860 to me well known & after having the said husband declared that She had willing Signed sealed and delivered the same to be her act and deed.  And that she did not wish to retract it.  In testimony whereof I hereto set my hand and seal of office at Bonham.  This November 19th A. Latimer, Alexander To F. R. Derritte - Power of Attorney

Kirby, John L. To John S. Ward - Bill of Sale

Know all men by these presents that I John L. Kirby have this day sold unto & delivered to John S. Ward the Examiner Office fixtures and material and all accounts belonging to it for a value of a consideration of two of my promissory notes one for $824.00 and the other for $1802 the receipt of which is hereby acknowledged.  This 22nd day of Febry. 1861.

To the Sheriff or any Constable of said county You are hereby commanded that of the goods chattles lands and tenements of Wm. B. Lewis and T. W. McMurray principal and J. A. Lucus and A. H. Brizendine, R. C. Vs. Garrison & Pond - Judgement

State of Tennessee, Sumner County

To any lawfull officer to execute and return you hereby commanded to summons Wesley Garrison &. W. G. Pond to appear before one or other acting Justice of the Peace for said county to answer the complaint of R. C. Brizendine in a plea of debt due by note a sum under five hundred dollars herein fail not.  Given under my hand and seal this 3rd day of April 1860.  Jos. Mclothlin J. P.

Bartholomew To Crump - Deed of Trust

Gallatin Febry. 25th 1861.  Know all men by these presents that for and in consideration of the sum of one thousand dollars to me in hand paid the receipt whereof is hereby acknowledged I have bargained sold and conveyed & by these presents do bargain sell and convey unto John R. Crump my negro woman Jane about twenty six years of age to him & his heirs forever.  And for the same consideration I have bargained sold and delivered and by these presents do bargain sell and deliver unto said John R. Crump all my stock of groceries liquors casks glassware and grocery furniture which are now in my grocery store at Saundersville in Sumner County Tennessee consisting of six barrels of whiskey 2 bbls. of vinegar, 4 kegs of nails 5 gallons of French brandy, 1/2 bbl. soda, 1 box of Tobacco, 40 lbs smoking Tobacco, 14 bar decanters, 30 lbs. candy, 5 gallons of sweet wine, 12 bottles Cognac brandy 1000 cigars, 40 glass Jars, 1 keg ginger, 1/2 box candles, 1/2 box snuff, 1/2 box matches, 3 Jars of Peach brandy, 1 bag of shot, 24 flasks, 6 bottles Schapps, 6 bottles Ayers pectoral 24 papers of Tea 12 bottles sweet oil, 13 bottles of Ambrosial oil, 1 waiter & 12 glasses 1 pair of balances, 6 water buckets & 1 tub, 1 lounge bed & table, together with the books & book accounts due me amounting to about one hundred and twenty eight dollars & ninety cents.  This conveyance is intended as a Deed of Trust to secure and indemnify te said John R. Crump as my security on a forthcoming bond for the delivery of the said negro woman Jane who was attached by a decree of the Chancellor in the case now pending in the Chancery Court of Sumner County wherein John F. Puckett is complainant and I am defendant.  And these presents shall be void if said slave be delivered according to the tenor and effect of the said bond or if the said Crump shall be fully discharged of all liability thereon.  But in case default shall be made in the delivery of the said negro or the said Crump shall be in any manner injured or damnified on account of the said securityship then he is hereby empowered to sell the said negro after giving ten days public notice and the whole or any part of the other property above mentioned that may be on hands; and out of the monies arising from such sales to pay and discharge the full amount for which he may have become liable together with interest and cost and the over plus if any be paid to me.  It is further understood and agreed that the said negro Jane shall remain in my possession until she is required to be delivered by a decree of the court according to the tenor and effect of said bond.  But the said Crump is to take immediate possession of the grocery store, the groceries the books and the book accounts etc. etc. and carry on the business by himself or Agent in his own name, to sell buy and collect debts now due or to become due for which he and his Agent or clerk shall receive a fair and reasonable compensation.  All of which receipts are to be retained by said Crump and accounted for to me or applied to his indemnity as aforesaid.  Signed Sealed and executed on the day aforesaid.

Brigham To Leggett - Power of Attorney

Know all men by these presents that I Wiley Brigham of the county of Nevada in the State of California have made constituted and appointed & by these presents do make constitute and appoint Whit Leggett of the county of Sumner in the State of Tennessee my true and lawful attorney for me and in my name place and stead to enter into and take possession of all the real estate belonging to me situate in the county of Sumner in the State of Tennessee and to bargain sell grant convey and confirm the whole or any part thereof  for such price or sum of money on such terms as he may think best, And for me and in my name to make execute acknowledge and deliver unto the purchaser or purchasers thereof good and sufficient conveyances with warranty of the same, and to demand receive and collect all sums of money which shall become due and payable to me by reason of such sale or sales.  Giving and granting unto my said Attorney full power and authority to do and perform all and every act and thing whatsoever requisite and necessary to be done in and about the premises as fully to all intents and purposes as I might or could do if personally present with full power of substitution and revocation hereby ratifying and confirming all that my said Attorney or his Substitute shall lawfully do or cause to be done by virtue hereof.  In witness whereof I have hereunto set my hand and seal this sixteenth day of February A. D. 1861.
