Toomey, James To McAdams & Malone - Deed of Trust

I James Toomey have this day bargained and sold & do hereby transfer & convey to W. C. McAdams & J. N. Malone their heirs & assignees forever for the consideration of five dollars to me in hand paid and for other valuable considerations herein after mentioned the entire stock of dry goods, groceries, queensware, hardware, drugs, & dye stuffs together with the wagon & team harness & what other merchandise shall from time to time be purchased with the proceeds of the present stock to have and to hold to the said W. C. McAdams & J. N. Malone their heirs & assigns forever. I bind myself my heirs and representatives to warrant and defend the title to said stock of goods horses & wagon & c to the said W. C. McAdams & J. N. Malone their heirs and assigns against the legal claims of all persons whatever. But this deed is made in trust for the following uses. On the 31st day of January 1861 I executed 14 notes of one hundred dollars each payable in the bank of Tennessee as follows one of them for $100 payable one month after date, one payable two months after date, one three, one four, one five, one six, one seven, one eight, one nine, one ten, one 11, one twelve, one thirteen, one fourteen months after date all for one hundred dollars each for the payment of which notes the said W. C. McAdams and J. N. Malone has become security for me. Now if these several notes are all faithfully met and paid by me then this deed is to be null & void. But if I should fail to pay them as they become due then said W. C. McAdams and J. N. Malone shall have power and they are fully authorized to advertise and sell the entire stock herein mentioned for cash by giving ten days public notice in the usual way of advertising such stock to pay the notes herein mentioned & after paying said notes together with the expenses & if there is anything left the same shall be paid over to me or my representatives. Hobdy, J. C. To J. W. Eubanks - Bill of Sale

Whereas I John C. Hobdy and heir of John Hobdy dec'd are entitled to an undivided interest subject to an estate in favor of Elizabeth C. Hobdy under the last will and testament of the said John Hobdy in and to the following slaves to wit; Milley aged about thirty five years, John aged about 8 years, Lewis aged about 13 years, Julia aged about 5 years, and Sam aged about twenty months all of said slaves are now in the possession of the said Elizabeth Hobdy. Now for the consideration of two hundred dollars to me paid, I have this day bargained and sold and do hereby transfer and convey to J. W. Eubanks the whole of my undivided interest in said slaves subject however to the right of the said Elizabeth C. Hobdy. To have and to hold the same to the said J. W. Eubanks his heirs and assigns forever. I will warrant the title of my interest in and to said slaves against any and all claims made by me through me but further or otherwise. I confer upon the said Eubanks all the power and authority which I possess to any on or to institute any suit necessary to obtain a division of said slaves or to procure a degree for a sale of the same to order for a division of the proceeds and to receive whatever share or portion would rightfully be coming to me under said will on account of said slaves. Allen, B. F. To W. D. Haggard - Bill of Sale

I do hereby sell transfer and convey unto W. D. Haggard a negro man by the name of Linsley age about 40 years of yellow complexion. I do hereby bind myself in case the said negro Linsley shall become at any time so bad from his present malady (which is derangement) as to render it necessary for his safety or the safety of others that he shall be confined so as to become a charge then in that event I am to pay one half of all the expenses that may necessarily accrue for the purpose for the period of five years from the time said necessary expenses shall commence. And the said Haggard agrees to take said negro on the above conditions freeing me from all liability or responsibility on account of said negro except as above set out. Feby. 14th 1861. Benj. F. State of Tennessee Sumner County - To any lawful officer to execute and return. You are hereby commanded as before that of the goods chattles lands and tenements of Serena Nimmo, J. A. Nimmo, Seth Colley stayor Nimmo & Co. J. J. Turner security upon forfeited bond if to be found in your county you cause to be made the sum of twenty five dollars 57 cents debt with interest from the 23 day of April 1860 and legal cost to satisfy a judgment that Eli Odom obtained against S. No. 3688 Eli Odom vs. Fi Fa Serena Nimmo et als issued 11 day of March 1861. Come to hand - day of - 18 -Debt $25.57, interest ---, commissioner --, warrant $1.00, Levy double $1.00, JP fee $1.00. Levied the within Fi Fa upon one saw mill, one grist mill, one boiler and engine, and all other machinery & fixtures belonging to the said saw & grist mill & one buggy & harness the only personal property of J. A. Nimmo & Co. to be found in my county upon which to levy. Therefore levied the same upon 215 acres of land lying in District No. 15 & bounded as follows; North by David Gaines, East by William Caldwell, South J. S. Davis and West by Fosters heirs the property of J. A. Nimmo which levy was given me by the said Nimmo. Bond taken for the delivery of the personal property to be sold on the premises on the 26th day of Novr. 1861. This levy is taken from levy of 7th Jany. 1861 for which bond was given and forfeited. Roundtree, Wm. & Wife To Abner Turner - Deed of Trust

We William Roundtree and Margaret Roundtree wife of said William for one dollar paid us and the other considerations hereafter set forth have this day bargained and sold & do hereby convey & deliver to Abner Turner & his heirs or assigns forever the property hereinafter specified consisting of Real Estate, slaves and Race horses or Blooded Stock & itemed & described as follows to wit; Item 1, A certain parcel of land fronting ninety nine fatsix inches on a certain fifty foot street in what is known as the Hog Factory property in or near the City of Nashville in Davidson County & State of Tennessee & being the same & including all those lands heretofore conveyed to said Wm. Roundtree by Wm. P. Jones deed dated 22nd day of August 1857 and duly registered in the Registers office of said Davidson County in Book 29 pages 13 & 14 which is referred to & made part of this instrument for more particular description. Item 2, a parcel of land situated in Balch & Whitesides addition to said City of Nashville and being the same and including all those lands heretofore conveyed to said William Roundtree by E. R. Glasscock as attorney for Nathan Manney by deed date 2nd day of November 1857 duly registered in the Registers Office of said Davidson County in Book No. 27 pages 204 & 205 and referred to & made part of this article for more particular description. Item 3, A parcel of land situated and fronting thirty feet on Crawford Street in Balch & Whitesides addition to same said city of Nashville and being the same and including all that parcel of land heretofore conveyed to said William Roundtree by Henry Carow by deed dated 24th July 1857 registered in the Registers Office of said Davidson County in Book No. 26 page 621 & hereby referred to & made part of this article for more particular description.

Item 4, a certain parcel of land situated in the town of Gallatin in the county of Sumner in the State of Tennessee & bounded and described as follows to wit on the South by what is known as Main Street in said town of Gallatin on the East by a street separating it from a lot or formerly owned by Mrs. Blackmore on the North by a lot now or formerly owned by Albert Lewis & on the West by a lot belonging to the heirs of Daniel McAuley dec'd. It being the same premises at present occupied by Mrs. Emily Roundtree as a residence and further being the same and including all those parcels of land heretofore conveyed to said William Roundtree by Reuben Searcy as administrator & others as heirs at law of Mary Lockhart dec'd by deed dated 18th April 1855 & duly registered in said Sumner County & hereby referred to & made part of this article for more particular description. Item 5, Two negro boy slaves one named Tom aged about fourteen & of copper complexion, the other named Peter aged about seventeen years and of dark complexions. Item 6, The following racing or Blooded Stock to wit; Two Brood mares, one a bay the other sorrel colored both being sired by the Imported horse Glencoe and their dam being the race mare Senora Love, also two colts yearlings being the produce of above first mentioned two Brood mares and by the race horse Lexington, bay Race mare Bettie Hawkins & her yearling colt by Childe Harrold, Sorrell race mare Lady Ciffees by race mare Sallie Woodward, one two year old filly by Highlander out of Brown Mare Cherokee Rose, also sorrel Stallion Tom Eames and sorrel horse Shanghie making in all eleven head of race horse stock. To have and to hold each and all of the afore mentioned parcels of land Itemed herein respectively 1,2,3, & 4, together with all the buildings improvements & appurtenances thereunto belonging to him said Abner Turner & his heirs or assigns forever and we covenant to warrant & defend the title to such and all said four several mentioned piece as parcels of land to said Abner Turner his heirs assigns or representatives against the lawful claims of all persons whomsoever and the said Margaret Roundtree wife of said William Roundtree does hereby expressly relinquish release & convey & forever quit claim to said Turner all right of dower which she may have or be entitled to in and to all or any of said aforementioned parcels of land, and further said William Roundtree warrants the title to each and both of said negro slaves Tom & Peter sound & slaves for life and also warrants the title to each and both of said slaves and the title to each and every one of the aforementioned race stock to said Turner against the lawful claims of all persons whomsoever. But this conveyance is in Trust and for the following uses & purposes & none other that is to say said William Roundtree owes the following described debts on which said Abner Turner is his security to wit; One note being for forty five hundred and forty eight 81/100 dollars dated Septr. 1st 1861 payable to order of one Walter Scott one day from date and expressing in its face to draw interest at rate of ten per centum per annum until paid. This said note being under seal and signed by Ed. Brenthal & said William Roundtree as principals and by said Turner as security one note for fifteen hundred dollars dated --- day of --- and payable to order of one A. M. Waddell said Turner being also security on this note and suit being brought thereon in the Circuit Court of Davidson County, Tennessee also said William Roundtree is indebted to said Abner Turner in the sum of thirty six hundred and seventy eight dollars as evidence by the note of said William Roundtree dated Jany. 19th 1861 & due & payable to said Turner one day after date this last note being for said sum of $3678.00. Now it is to secure the payment in full of each and all of the above mentioned debts of said Roundtree and to indemnify and save harmless said Abner Turner as security. This conveyance is made and for this purpose

possession of each and all said parcels of land and of both negroes and of all said race stock is hereby given to said Turner and he as Trustee is hereby empowered to rent out said parcels of land and collect the rents therefore if he elect so to do or he is hereby expressly empowered to sell any or all the aforementioned real estate negroes or Blooded stock either for cash or on such time as in his judgment he may deem best for providing means to pay in full each and all of the debts of said William Roundtree herein specified and make such sales either privately or publicly as to him seems best and should he not succeed in selling enough of said property within one year from this date to pay off & satisfy in full each and all of the afore mentioned debts of said William Roundtree together with all interest damages & costs that may accrue upon them then he is hereby directed to advertise the same or so much of said real estate negroes or horse stock as may be unsold and after having giving twenty days notice of the time and place of sale in some newspaper published in the city of Nashville aforesaid he shall proceed to sell for cash to the highest bidder whatever of such real estate negroes or horse stock may be unsold until there shall be this realized in a fund sufficient to pay off the whole indebtedness which may at the time be unpaid on either or all of the aforementioned three several notes, said Turner shall not however be compelled to selay for one year but is expressly authorized hereby to make sale either privately or publicly as he may deem best of any part of such real estate negroes or horse stock at any time between this and the expiration of the year and on such terms as he may consider necessary or proper for carrying the purposes of this trust. When all the aforementioned indebtedness of said Wm. Roundtree shall be fully paid then the residue of the property herein conveyed if any remain shall be reconveyed to said Wm. Roundtree said Turner as Trustee is to reserve in addition to means sufficient to discharge all aforementioned indebtedness the funds necessary to discharge all the costs of executing this trust. State of Tennessee - County of Shelby - Personally appeared before me F. R. Cheatham, Clerk of the County Court of said county, the afore named William Roundtree the bargainor with whom I am personally acquainted and who acknowledged that he executed the annexed instrument for the purposes therein contained. Tresevant, Clerk of the County Court of said county, Margaret Roundtree the bargainor to the foregoing & hereby attached Trust Deed with whom I am personally acquainted and acknowledged that they executed the same for the purposes therein contained. And Margaret Roundtree wife of Wm. Roundtree having also appeared before me privately and apart from her husband the said Margaret Roundtree acknowledged the execution of the Trust Deed to have been done by her freely voluntarily & understandingly without expression or constraint from her said husband and for the purposes therein expressed. Montgomery & Merrill To George W. Threlkeld - Deed of Trust

For and in consideration of the sum of five dollars to us paid and the other consideration hereafter named, we have this day transferred and conveyed and do hereby transfer & convey unto George W. Threlkeld all of our Book of Accounts as well as note & all other evidences of debts as well as all claims of every kind that is owing to & due us under the name & style Montgomery & Merrill. This conveyance is however made in Trust for the following uses & purposes that is to say; We are indebted to Solhart & Co. by judgment for $350 upon which W. H. Blackmore is stayor. We are likewise indebted to Eli Odom by judgment for $150 upon which Jno. H. Malone is stayor, we are likewise indebted to Jones Bullard & Barnes by judgment for $314 stayed by John H. Malone likewise to Eli Odom by judgment for $200 stayed by Joseph Fowler, likewise to Nickerson Mosley & Co. by judgment for $187 stayed by H. Bate, likewise to the same firm by judgment $187 upon which J. H. Malone is stayor, likewise to Eli Odom by note due sometime  this month $1000 upon which W. B. Bate, Geo. W. Winchester and others are securities, likewise to the same another note for $1000 due some time on which S. M. Blythe & others are securities, likewise to W. R. Lane in the sum of $150 for borrowed money, to Howell Smith & Co. by note for $350 past due, to Bobcock & Pomroze by note due in Novr. last for $441, to McAuly Brother & Brewster by note due for about $440, one Howell Smith & Co. $500 now due, one to Bobcock & Pomraye for $432 due Novr. last, one to the same firm for $112 due, one to McAuly Brother & Brewster for about $440 due next month, to Bobcock & Pomeroy by account for about a $1000. Now being desirous to secure the payment of all of the above enumerated debts the said George W. Threlkeld to whom this conveyance is made is authorized and empowered to collect all the debts of every kind due to Montgomery & Merrill being the same conveyed in the first part of this conveyance as soon as the same can be done and as fast as can be collected apply to the payment of the debts herein enumerated in the order in which they are stated together with the accruing interest & costs. The said Trustee is authorized in the event that any of the creditors above named are willing to take and receive note or accounts in satisfaction of their claims to deliver and transfer at sufficiency to them for that purpose not however paying any creditor out of the order in which they are herein directed to be paid unless the said Trustee shall be satisfied that in so doing the creditors before the one paid will not be endangered, the said Trustee is hereby directed to use all proper and expeditions means to collect and pay off the debts here secured, and when paid off in the order named if there shall then be a surplus in his hands he will pay the same over to the balance of the creditors of Montgomery & Merrill if any there be pro-rated. The books, notes, accounts and evidences of debt here conveyed are simultaneous with the execution of this conveyance delivered over to the said Trustee. Witness our hands this 26th March 1861. W. N. Crump, J. R. To M. J. Lucus - Mortgage

For the consideration of five dollars and the other considerations herein after named, I have this day sold and do hereby sell & convey unto M. J. Lucus & his heirs a negro boy by the name of Terrell about twenty two years old and I do hereby bind myself my heirs and assigns to warrant the title of said negro Terrell to the said M. J. Lucus his heirs & assigns against the lawful claims of all persons whomsoever. This conveyance is however made in trust for the following uses and purposes and no other that is to say I am indebted to Thomas Ross now in a judgment for about $120 upon which M. J. Lucus is stay security to Crump and Wallace by note for about $110 upon which M. J. Lucus is security due in January last, to M. J. Lucus by note for $125 due Jany. last likewise to said M. J. Locus by account now due in the sum of $150, likewise to McA. G. House by account for $30. And being desirous to secure and make certain the payment of all of the above described debts. Now if I shall pay off and discharge said debts on or before the 1st day of May 1862 then the above conveyance to be void otherwise the said M. J. Lucus as Trustee shall after giving twenty days notice in writing at three or more public places expose said negro Terrell to public sale at the Courthouse door in Gallatin and to sell him to the highest bidder for cash and apply the proceeds first to the payment of the costs of this Trust and then to the satisfaction of the debts above specified together with the interest and cost on the same and lastly to pay over the balance if any there be to me. State of Tennessee Sumner County - For the purpose of securing to J. D. Stalker a note of this date due for $75 & Bennett & Stubblefield a debt due by note and account for $175 and R. Averitt a debt by note for $175 due March 1862 and Goodall & Andrews a debt of about $125 upon which the said Goodall & Andrews have obtained a judgment upon which execution has been issued and by a Justice of the Peace and a debt due Gideon Gifford for about $54.00 upon which there is a judgment before a Justice of the Peace and execution issued and W. & J. Gifford in a debt of about $25.00 upon which there is a judgment before a Justice of the Peace and execution and S. W. Lesuer in a debt of about $35.00 due by account and W. F. Andrews a debt of about $18.00 upon which there is a judgment before a Justice of the Peace and execution issued and W. D. Austin in a debt of about $30.oo due by note, J. Forgason in a debt of about $33.00 upon which there is a judgment before a Justice of the Peace and execution issued. I hereby convey to R. C. Sanders in trust a certain lot of land lying in Sumner County State of Tennessee Dist. No. 1 containing by estimation one acre more or less bounded as follows; North and West by the lot of R. B. Allen now occupied by John Daly, East by the lands of John Hutchins now occupied by Robert Andrews, South by the Carthage and Hartsville Turnpike Road. The said lot seventy feet front and three hundred and sixteen feet back. If the aboved mentioned debts are not paid on or before the 9th day of April 1862, I hereby authorize R. C. Sanders to sell the property herein conveyed in the town of Hartsville after giving the notice required by law in the sale of land by execution or such notice as I may require of him to execute a deed to the purchaser to pay off the amount herein secured with interest & cost and to hold the remainder subject to my order. Glover, James To G. B. Guild - Bill of Sale

Whereas I have purchased of John S. Ward the Examiner office in Gallatin, Tennessee consisting of the printing press, types, furniture & appertaining to said office and being desirous to secure and make certain the payment of the purchase money for the same for which I have this day executed my two promissory notes to said John S. Ward one for $800 due October 1st 1861 and the other for $700 due on the 1st day of January 1863. Now in consideration of the above and for five dollars to me paid I do hereby transfer & convey said printing press or presser types furniture & appertaining & belonging to the Examiner office as aforesaid unto George B. Guild his heirs and assigns forever. I bind myself heirs and representatives to warrant & forever defend the title to the same against the lawful claims of all persons whatsoever. This deed however is made to secure
