And whereas S & Terminus Heermans is indebted to A. J. Duncan &
Co in four judgements & executions on same for the sum of about thirteen
hundred dollars, to Irby Morgan & Co by notes due for the sum of about
one thousand dollars, to Hall & Cunningham the sum of about one hundred
dollars balance, on note due to H. Campbell the sum of about fifty
dollars balance on note R. S. Hollins & Co. the sum of about three hundred
dollars by notes due to Trabue & Lucas the sum of about seventy five
dollars balance on note due. I am also indebted to D. P. Hart &
H. Kelley commissioners for the heirs of Nancy W. Colley the sum of about
two hundred and fifty dollars on some of the above recited debts I have given
security and on some no security has been given. I am desirous of securing
and making certain the payment of the above debt and therefore make this
deed. Now if I shall pay or cause to be paid said debts on or before
the 20th day of July 1863 then this deed to be void. But if I should
not then said Trustee after giving twenty days notice in writing at three
or more public places may sell the property herein conveyed to the highest
bidder for cash and apply the proceeds to the payment of costs of sale next
to the payment of the debts above recited should there be a deficiency of
means to pay all the aforesaid debts I desire said Trustee to pay my individual
debts first the balance to be equally paid in proportion to the debts lastly
if anything remains after satisfying said debts then said Trustee will pay
the same over to me. Said Trustee is authorized and empowered to sell
any of the property before specified at any time before the 20th day July
1863 upon my giving my written assent thereto and apply the proceeds to the
payment of the debts herein specified. Given under my hand & seal

Todd, H. B. to Catharine Carr - Marriage Agreement
This article of agreement made and executed this 22nd day of Jany A. D.
1862. Witnesseth that whereas H. B. Todd has made the engagement of
marriage with Catharine Carr of the county of Sumner and State of Tennessee
and whereas the rites of marriage are to be celebrated between then and before
the consumation thereof the said H. B. Todd of his own voluntary act and
on his own motion desiring to secure to the separate use and enjoyment of
the said Catharine Carr all the real & personal estate and slaves of
which she is now possessed. Now in consideration of the said marriage
and as part of the contract thereof and of all the premises herein set out
the said H. B. Todd doth by these presents settle on the said Catharine Carr
and to her separate use and enjoyment secure all the estate real & personal
of which she is now seized and possessed or may hereafter be to be free and
fully acquitted of and from his debts and liabilities either now existing
or which may hereafter exist, the same to be as free from charges on his
behalf and of his contracting as thought she continued to be and were a feme

Whereas I Alexander Brown have this day given & do hereby convey to

State of Tennessee. Beginning at a Rock on line of Green Street running
North 160 feet to the line of (left blank) lot Then on his line East 114
feet to the North West corner of Boyers lot Thence South with Boyers line

made for the benefit of my Daughter & her children and not to be subject

For and in consideration of the sum of five dollars to me paid & the other considerations hereinafter named I have this day bargained and sold and do hereby sell transfer & convey unto Jno F. Cage the following real and personal estate to wit the remainder interest in a tract of land lying & being in Sumner County Tennessee containing 34 1/4 acres being the same conveyed for life to my Mother & wife with remainder to me by John F. Sanderson & for the boundaries of which reference is here made to paid Sander's deed registered in the Registers office of Sumner County one other tract of land in said county containing by estimation 158 acres being the same land conveyed to me by S. D. Williams by Deed bearing date 6th day of July 1849 & registered in the Registers office of Sumner County for a more particular description of which land reference is here made to said deed, one negro woman named Rose aged about 10 years one named Adaline aged about 8 years one negro boy named Rufus aged about 18 months one negro woman named Margaret aged about 35 years one negro girl named Annett aged about 8 years one sorrel gelding one black gelding one brown gelding & sorrell mules one brown mare one black mare & colt two bay mares & two Jennetts. To have & to hold said land & negroes & other property to him the said Jno. F. Cage his heirs & assigns forever. And I covenant with the said Jno. F. Cage that I am lawfully seized of all of said property & have a good right to convey the same. And I further bind myself to forever warrant & defend the title of all said property to the said Jno. F. Cage his heirs & assigns forever against the lawful claims of all person whomsoever. This conveyance is made however in trust for the following uses & purposes & for no other purpose

that is to say I am indebted to John Armfield Agent or Trustee for James
C. Franklin now known by the name of Blanche C. Archer by note due 1st of
Jany 1861 for nine thousand five hundred dollars ($9,000) likewise to the
same by note due same time for five hundred & sixty seven dollars &
fifty cents likewise to Jo. D. Martin Guardian of J. R. Henley et al by note
due about February next for twenty five hundred dollars upon all of which
notes Jno. F. Cage is my security & being desirous to secure him &
save him harmless I do hereby authorize & empower my said Trustee in
the event that I shall within two years from this date or any time when said
are obliged to be paid fail to pay off any or all said notes with all accruing
interest on the same to expose any or all of said property to public sale
at such time & place as he shall designate giving twenty days public
notice & sell the same to the highest bidder either for cash or on a
credit as he shall deem most to the interest of all concerned & apply
the proceeds to the satisfaction of said notes so far as the same will go.
My said Trustee has full & ample power to make such disposition
of any or all said property at any time with my consent or without it in
the event of my death as well in his judgement best secure & indemnify
him on account of his securityship on the notes above specified. In

Johnson, Josiah to R. J. Defrees - Mortgage
State of Tennessee
Sumner County
I have this day sold my house of Tobacco to R. J. Defrees supposing to be
fifteen hundred pounds being in the County of Macon Tennessee also one lot
of Hogs five in number about one year old supposed to gross one hundred pounds
now for the sum of fifty eight dollars and forty seven cents to me in hand
paid this is to secure this debt in part pay to the said R. J. Defrees or
his representatives the sum of fifty eight dollars and forty seven cents
with interest on the note due to R. J. Defrees March the 17th eighteen hundred
and sixty one according to a note under seal this day executed by me to said
R. J. Defrees then this instrument to be void but not otherwise for the hogs
to remain in his possession till call for this the 22nd day of January eighteen
hundred an sixty too.
