Douglass, J. H. To Harriet T. Cage - Marriage Contract
This contract made this day between Jas. H. Douglas of the County Grason of Texas & Harriet T. Cage of the county of Sumner State of Tennessee Witnesseth that whereas a marriage is shortly intended to be had & solemnized between the said Jas. H. Douglas & the said Harriet T. Cage. now upon consideration of said contemplated marriage the said Harriet T. Cage now owning as her own certain personal & Real estate and it not being the intent of the parties to disturb the control of dissent of said property by the said contemplated marriage or any rights that the said James H. might acquire by virtue of the same. now in view of the premises & the contemplated Marriage It is expressly agreed bargained & contracted the title to all of the personal estate now in the possession of the said Harriet consisting of negroes notes money Stock & other personal property shall remain undisturbed that the same shall remain forever hers for her own separate use & control. It is further agreed between us that in no event shall the marital Rights attach to any part of said property but the said Harriet may devise or bequeath or deed the same of any part thereof to the said James H. Averitt, Rich’d To R. A. Bennett - Deed of Trust
I Richard Averitt have this day bargained & sold & do hereby convey to R. A. Bennett as trustee for the sum of five dollars to me in hand paid and other considerations hereafter to be mentioned. The tract of land lying on the waters of Little Goose creek adjoining lands of H. W. Neely, W. Hart, Thos. Stalker & others. Containing by estimation two hundred & fourteen acres also the tract know as Brown house tract on which I now live bounded by lands of Hart Gifford & others. Containing by estimation thirty six acres more or less. The above tracts lying in the county of Sumner & Distr. No 1. Also another tract in sd. County & District No 2 Bounded by lands of A. Chambers Boon & others the same purchased of Lilfords heirs Containing about sixty acres more or less also a tract in Macon County on which George Hutchins now lives being some one hundred & forty acres also another tract containing about fifty acres on which Lewis Valentine now lives also the balance of the tract known as the Stewart tract containing some two hundred acres all the above lying in Macon County. Also my interest in the houses & lots in the town of Hartsville known as the Averitt & Bennett now occupied by Bennett & Stubleford as a store. C. R. Barteau as printers office & the lot now occupied by C. D. Robison. Also fifty acres in Macon County known as the Stubleford tract. Also the following slaves to wit. George aged 60 yrs, Tom age 65 yrs., Linsey aged 55 yrs, Rob aged 24, Albert aged 18, Dore aged 12, Elsey aged 35 and her children Rufus aged 10, Mal aged 8, Harriet 6, Martha Ann aged 4, Peggy 2, Parthenis & her children Mary aged 9, Jim aged 6, Nancy aged 4, Kitty aged 2, Eliza aged 13, Lydia aged 3, Martha aged 21 & her child Zach aged 6 months, Sarah aged 20, Sam 26 yrs. Also all my household & kitchen furniture consisting of ten feather beds & steads & clothing, three bureaus two deeping tables two Dozen chairs, cooking stove also all my stock consisting of seven mules seven head of horses & colts 30 head of hogs & 30 head of sheep 11 head of cattle & one yoke of Oxen three wagons & one cart and buggy & harness & all the farming utensils now on my farms to have & to hold the same to the sd. R. A. Bennett & his heirs forever. I do covenant with the sd. R. A. Bennett that I am lawfully seized of the said land & others property & have a good right to convey the same. I do further covenant and bind myself & heirs to warrant & defend the title to sd. lands & others property & every part thereof to the sd. R. A. Bennett & his heirs against the claims of any persons whatever. But this deed is made for the following uses & trusts & for no other purpose that is to say I am indebted to the following persons viz Lewis G. Mills & B. W. Mills in one note in the sum of $800 one in the sum of $764 due the same persons with Thos. Stalker as security & another one in the sum of $600 to the same with interest. The $600 & $764 notes are signed by Averitt & Bennett but I am to pay the same the sd. Bennett not owing any part of them. One note due W. S. & R. B. Alexander for $1000 with interest amounting to some $1200 the same is signed by Averitt & Bennett but I am to pay the same H. C. Ellis being security also W. Hart one note for $2300 with interest the same signed by Averitt & Bennett which I am to pay J. D. Bennett being security on sd. note also another note & acct. of my own amounting to $450 also to R. Satterfield one note amounting to $300 J. D. Bennett security also a note due J. F. Stubleford $650 also a note due J. S. Dickerson for $600 also note & acct. due H. C. Ellis as stay security J. H. Bennett as Trustee is fully empowered by these presents to sell the sd. property & appropriate the proceeds first to necessary expenses & costs 2nd to the satisfaction to all of the above debts in the order in which they are mentioned and the balance if any to me. The Trustee is empowered to sell the negroes privately the balance of the property land etc to be sold after giving notice in 3 public places in the county publicly. Should I desire to sell any of the property before the separation of this deed the Trustee has power to do so with my consent and the proceeds to be applied to the payment of above debts Sd. Know all men by these presents that I Clarke R. Barteau of Sumner County Tennessee for the purpose of securing the following indebtedness have this day made the following conveyance in trust to Baxter Smith for the consideration of five dollars to me in hand paid the receipt whereof is hereby acknowledged. That is to say I am indebted to Robert A. Bennett three hundred dollars due November 1859 as is evidenced by my note of that date, to James J. Turner I am indebted in the sum of two hundred & twenty five dollars loaned money with R. A. Bennett security as is evidenced by my note due January or February 1860. to Dr. James L. Thompson I am indebted one hundred twenty five dollars with R. D. Bennett security due by note some four or five months ago, to S. B. Tinsley I owe one hundred & fifty one dollars & costs as is evidenced by judgement rendered by J. W. Leusseur Esq a justice of Sumner about March 15th 1860 to sd. Tinsley I am also indebted one hundred & twenty five dollars upon which judgement was rendered April 5th 1860 by J. W. Leusseur Esq. & to sd. Tinsley I also owe one hundred & twenty five dollars evidenced by judgement rendered by sd. Leusseur Decr 22nd 1859 executions upon all of which have been stayed. To Bennett & Stublefield of Hartsville I owe for goods five hundred dollars due by note & accounts to H. C. Ellis I owe sixty five dollars as is evidenced by judgement rendered Novem 28th 1859 execution upon which has been stayed. also by account about $40 to Joyner & Co. of Gallatin I owe thirty one dollars 41 cents judgement upon which was rendered Decr 16th 1859 execution upon which has been stayed - the last two mentioned judgements rendered by J. W. Leusseur Esq. to W. T. & S. D. Day & Co of Cincinnati. I am indebted by notes in the sum of five hundred & two dollars upon which Thomas Stalker is my security. To Thomas Joyner I owe sixty eight dollars 50 cts. due Feby 22nd 1860 to Reuben Clarke I am indebted for borrowed money a balance of some fifty seven dollars now due to Goodall & Co of Hartsville I owe one hundred & seventy five dollars as is evidenced by note due Jany 1st 1860. to A Towson I owe sixty five dollars evidenced by note due July 1859 with Thos L. Winston my security to Rufus Douglass I owe $200 evidenced by note January 1st 1860, to R. M. Potts I am indebted $325 due by notes for lot, to Knight Martin & Mills of Gallatin I owe $26.78 by note or account; to Thos Stalker I owe two hundred & sixty five dollars due by note about March 1st ’60 to J. H. Dickerson I am indebted one hundred & eight two dollars due by note & judgement rendered not stayed, to M. M. Newsom I am indebted by note $20 due, to B. S. Martin I owe by note $125 due Jany 1st 1861, to J. M. Brown I owe $40 due by note, to A. Allen $22 due by note, to G. H. B. $8.95 evidenced by judgement before J. W. Leusseur Jan 11th 1860 execution stayed, to W. T. Roscoe I am indebted $201.13 judgement rendered by sd Bennett Feby 1st 1860 upon which execution has been stayed by John Lowe to the Planters Bank of Tennessee. I am indebted $225 with D Burford as my security evidenced by note April 23rd 1860 and other debts amounting probably to $500. Now as before stated for the purpose of securing the above indebtedness and of indemnifying my securities upon such debts above mentioned as have security upon them, I convey in trust to the sd. Now if the above mentioned debts are not paid by the 1st June 1861 I hereby authorize Baxter Smith as my Trustee to sell the property for cash herein described & conveyed after giving twenty days notice in some newspaper at Gallatin and by printed hand bills to sell the slaves privately between now & June 1st 1861 & to execute bills of sale to the purchasers and apply the proceeds first if thought best by the consent of myself to the payment of the costs of this deed. Secondly to the payment of the debts mentioned in this deed in the order in which they are mentioned; and if there should be a surplus he will pay the same over to me or my order. Bennett & Mills To Ann A. Saunders - Bill of Sale
Whereas we have qualified as administrators with the will annexed of John Mills Deceased and under the decree of the Chancery Court at Gallatin after advertising thirty days proceeded to sell to the highest bidder all the slaves of said estate and Ann A. Saunders wife of Wm R. Saunders bought the following negroes at the following prices. George yellow complexion age 16 years at $1100. Harriet age about 35 years and her three children to wit Matilda age 7 yrs Louisa age 4 yrs Thelen age 2 yrs at $1600 Wiley age 17 years $1150 Peter age about 60 yrs at $350 making the sum of forty two hundred dollars for which said Ann A. Saunders has executed her note 12 months after date with security. Now we do by these presents transfer and convey unto the said Ann A. Saunders and her children forever to be her separate estate during life and at her death to her children all the right and title of John Mills Dec’d unto said slaves we do not warrant them sound and convey such title as we have under the will of said John Mills and the decree of the chancery court aforesaid. An article of agreement entered into this day & date above mentioned between J. M. Wilson of the first part & Elliott & Love of the second part. We have this day sold to J. M. Wilson of the first part our entire stock of goods & merchandise excepting one lot of whiskey & one lot of chairs for one hundred and seventy five dollars ($175) he agreeing to give them a credit on a judgement in favor of J. Barret against Winham & Love for which the said J. M. Wilson is assignee. the said Elliott & Love are stayors on the judgement. The above excepted articles are claimed by Thos. Woodard & J. H. Trigg all of the above we agree to in this sale except the excepted articles of whiskey & chairs mentioned.

Dinning I do hereby give and transfer to her for her sole and separate use and benefit not to be subject to the control and disposition or liable for the debts or contracts of her present or any future husband. a negro girl named Delia aged about 6 years of dark complexion. To have and to hold to the said Martha A. L. V. Dinning for her sole and separate use and benefit for and during life with remainder over in favor of her children the said girl Delia and I warrant the title of said girl against all claims set up to said girl by myself or by those claiming & by through or under me; but no further or otherwise. Whereas I J. S. W. Lesueur was originally found as surety for John H. Lesueur to W. & R. Alexander for some considerable amount John H. Lesueur to indemnify me conveyed to me a Negro by named Sam about 21 years of age; and thereupon I assumed the debt for which I was bound as surety and James D. Bennett & S. B. Tinsley became my sureties to W. & R. Alexander for the sum of fourteen hundred and eight dollars and ninety cents J. S. W. Lesueur to indemnify said James D. Bennett and S. B. Tinsley do hereby transfer and convey said Boy Sam to said James D. Bennett & S. B. Tinsley and their heirs forever and warrant the title to said boy and that he is sound sensible and slave for life. Know all men by these presents that I Isaac Groves of the town of Mitchelsville in the county of Sumner in the State of Tennessee of the first part for and in consideration of the sum of nine thousand nine hundred & fifty dollars lawful money of the United States to be paid by Wiley Groves & Jonathan W. Smart of the second part the receipt whereof is here acknowledged have bargained and sold and by these presents do grant and convey unto the said Wiley Groves and Jonathan W. Smart of the second part their executors, Administrators and assignees three negroes John aged twenty one years Caroline aged twenty two years John age twenty years one house & contents and lot containing three acres one house of Tobacco nine head of horses one buggy one wagon one thrasher two tobacco screws & thirty acres of wheat belonging to me & now in my possession at the place last aforesaid or all the goods whereas merchandise chattels and effects mentioned and described in the schedule hereunto annexed and marked Wiley Groves & Jonathan W. Bush, T. To M. H. Haggard - Deed of Gift
Know all men by these presents that I Thacker Bush of the county of Sumner State of Tennessee for and consideration of the natural love and affection I have and bear for my daughter Mary H. Haggard do give and forever transfer to her sole and separate use to be her sole and separate estate free from the debts liabilities and contracts of her husband a negro girl Mary Francis age 13 years yellow complexion the said negro girl I warrant to her to be sound sensible and a slave for life the said Negro is given by me to my daughter aforesaid to be her separate estate not to be liable for the debts and contracts of her present or any future husband the said Mary H. Haggard to have the right either to sell or dispose of her by will or otherwise. Witness my hand and seal this the 21st 1860.

Moss, T. G. To C. B. Malone - Deed of Trust
For and in consideration of five dollars to me paid I have this day sold & do hereby sell transfer and convey unto Charles B. Malone all the right title and interest I have in and to a certain House & lot in the Town of Gallatin including the dwelling house in which I at present reside and the Carriage Factory occupied by Knight Martin & Mills it being the same property bought by me from Williamson Adams & Co and I do likewise convey and sell to the said C. B. Malone all interest that I have in and to two partnerships negroes of the said C. B. Malone & myself viz John & Nancy likewise all interest that I have in any debts due the firm of Malone & Moss I do likewise sell & convey unto the said C. B. Malone the following personal property to wit. Four beds bedsteads and furniture, three Beaureaus one carpet & one Dozen chairs To have and to hold the said conveyed property and every part thereof to the said C. B. Malone his heirs & assignees & I bind myself to forever warrant and defend the title to the foregoing property to the said C. B. Malone his heirs and assignees forever. But this conveyance is made for the following uses and purposes and none other that is to say C. B. Malone and myself are jointly indebted to Eli Odom in the sum of six thousand dollars due on the 14th day of June next and being desirous to secure and make certain the payment of my half due when demanded after the same is due then my said Trustee the said C. B. Malone is required and authorized to expose all of said property or my interest in the same to public sale at the court house and sell the same for each first giving ten days public notice of the same and apply the proceeds first to the costs and expenses of carrying out this trust next to the satisfaction of my half of the said debt of six thousand dollars and lastly to pay over the balance to me if any. My said trustee shall have the power if at any time before the said 14th June next I should desire it to sell my or all of said property provided the proceeds is applied to the payment of said debt of six thousand dollars at private sale. In witness my hand and seal this 25th June 1860.
