Mills, B. W. & J. J. Wells - Agreement

Whereas on the 22nd of June 1859 B. W. Mills conveyed by Bill of Sale to her daughter Sarah Ann Mills the following slaves viz a boy Wiley aged 20 yrs. Caroline aged 18 years & her child, Bennett aged 13 yrs. Turner aged 14 yrs & Dibey aged 9 yrs. The intention of which said instrument was to convey to said daughter the said slaves to her sole and separate use and benefit free from the liabilities or control of any future husband and whereas there are some doubts as to whether said instrument does so convey said slaves and whereas said Sarah Ann Mills was married on the 28th June 1859 to H. J. Wells and whereas the said Wells is willing that said intention of said Mills aforesaid shall be fully carried out and perfected and whereas the said slaves have never been reduced into the possession or control of said Wells and he has not by possession control or ownership acquired any right to them and whereas he has never made any settlement upon his said wife Sarah Ann and the same is desirable so as to carry out the original intention of said instrument of June 22, 1859 and the same might be done by a Bill in Chancery to settle it on her to her sole and separate use. Therefore in consideration of the premises and of a valuable consideration moving from B. W. Mills to said Wells it is agreed upon that said Wells does hereby relinquish any and all rights in and to said slaves that he has or might require by reducing them into his possession and in settlement of the question of a settlement upon his said wife and the said Mills and Wells do hereby agree that the said slaves heretofore set out shall be held by said Sarah A. to her sole and separate use and benefit and free from the debts contracts or control of her present or any future husband.

And it is agreed that said B. W. Mills shall act as Trustee when it may be necessary for the probation and management of said property but the right and use and benefit of said slaves to be to said Sarah Ann as heretofore set out. In witness whereof we have set our hands & seals Augt 7th 1860.

Thompson, J. To H. Thompson - Deed of Trust

I James Thompson of the county of Sumner & State of Tennessee have this day bargained and sold and do hereby transfer & convey to Hardy Thompson for the consideration of five dollars to me paid & the further consideration hereinafter to be mentioned to wit one yoke of Oxen one sorrel yearling colt one clock To have and to hold to the said hardy Thompson his heirs & assignees forever. I covenant with the said Hardy Thompson to warrant & defend the title of said property against the claims of all persons whatever. But this conveyance is made for the following trusts & purposes & none other that is to say. Whereas I am indebted to one John Morris in the sum of fifty dollars due by account and whereas I am desirous to secure and make certain the payment of said debt. Now if I shall on or before the 1st day of September 1861 pay off and discharge said debt of fifty dollars and all interest thereon then the above conveyance to be void; But should I fail to pay off said debt as aforesaid then the said Hardy Thompson as Trustee after giving ten days notice in writing at three or more public places shall expose said property to public sale & sell the same to the highest bidder for cash and apply the proceeds first to the payment of the expenses incurred in the execution of this Trust; Secondly to the payment of the debt due the said John Morris together with the interest thereon; and thirdly to pay the balance if any there be to me. This 8th day of August 1860.

Know all men by these presents that I James L. Carson of the county of Sumner & State of Tennessee have this day assigned to Ezekiel Elkin in & for the consideration of his liability for me incurred by the endorsement as my security to a certain note executed by me and payable to E. T. Peary for twelve hundred & seventy two dollars date 25th May 1859 all the right title & interest I have in and to the following property to wit. Two negroes Lucinda aged about 35 years, Emma aged about 5 years, One Rockaway three head of cattle all my household & kitchen furniture except such as may be exempt by law from execution consisting of beds bedding clock beauro & 117 head hogs together with all my present crop of corn & oats except so much thereof as is necessary for the use & support of my family all of which is to be held by the said Ezekiel Elkin for the purpose above specified until he is released from his liability by the payment of said note after which the above obligation shall be null & void. Gaines, James A. To M. J. Lucus - Deed of Trust

I  James A. Gaines of the County of Sumner & State of Tennessee have this day bargained & sold & do hereby transfer & convey to M. J. Lucus of the county & State aforesaid for the consideration of five dollars to me paid and the further consideration hereinafter to be mentioned the following property to wit two sorrel horses, one bay horse mule, one gray horse four years old one buggy & harness, one gold watch patent lever. To have & to hold to the said M. J. Lucus the said property to him & his heirs forever. I covenant with the said M. J. Lucus to warrant & forever defend the title of said property against the claims of all persons whatever. But this conveyance is made upon the express condition & trust & none other. That is to say whereas I am indebted by note made payable W. Montgomery due about the first of September next for about two hundred & ten dollars upon which James H. Gaines is my security - also to Mr. R. Lindle by judgement before Thomas Boyers Esqr. For about two hundred dollars upon which James F. Gaines is my security and Alexander Barnes Stay security - also to Knight Martin & Miller by two judgements before Thomas Boyers for one hundred and fifty dollars each upon which James F. Gaines is my security, Alexander Barnes stay security - also to J. R. A. Tompkins & Son by note due Jany last for about one hundred & ten dollars upon which James F. Gaines is my security - Also to James F. Gaines by two notes now due one for four hundred dollars and the for three hundred & ninety dollars - also to Jno. W. Petit by note due 1st Jany next for $131 upon which Jas. H. Gaines and M. J. Lucus are my securities. And whereas I am desirous to secure and make certain the payment of said debts and all accruing interest thereon. Now if I should on or before the first day of November 1861 pay off and satisfy said debts and the interest thereon and save harmless my said securities endorsers & Stayors then the above conveyance to be void and of no effect. But should I fail to pay off said debts as before stated and save harmless my said securities then and in that event the said M. J. Lucus is authorized and directed as Trustee in the first place if any of my said securities should be forced to pay any of the debts for which they are bound before the first day of November 1861 he will sell such of the said property as will command the best price in the market and apply the proceeds to the relief of my said securities. In the second place if by this process all the debts are not paid off by the first of November 1861 then he will after giving ten days notice in writing at three or more

Public places expose whatever of said property may remain unsold and sell the same to the highest bidder for cash and apply the proceeds first to the payment of the debts above mentioned or any portion of them which may not have been paid or to the indemnification of any of my said securities endorsers or stayors who may have been forced to pay any of said debts and the same not having been refunded them as contemplated heretofore in this trust - Thirdly should there be balance to pay the same over to any debts which I may owe not embraced in this conveyance. I have this day sold my negro slave, Marg to T. L. S. Perdue for the sum of five dollars to me in hand paid & the other considerations herinafter mentioned. But this deed is made for the following uses & trusts & for no other purpose that is to say I am indebted to John B. Neal by note under seal sixty dollars due the 5th of Oct. 1859 and also to James L. Martin by note under seal for one hundred & thirteen dollars & 50 cents due the 24th of Decr 1859 and also to T. L. S. Perdue by note under seal ninety dollars due in June last and also Richard Jones two hundred dollars by note under seal due some time in March or April last and am desirous to secure and make certain the payment of the same now if I should pay the said debts by the 1st of Decr 1861 then this deed to be void, but if I should not then the said T. L. S. Perdue as Trustee after giving twenty days notice in writing at the election ground of the 17th Distc. Of Sumner County and three other places in the neighborhood may expose the said negro to public sale for cash to the highest bidder and appropriate the proceeds first to the payment of the necessary expenses & costs, Secondly to the satisfaction of said debts and thirdly to pay the balance if any there be to me this 19th of August 1860.   Executed and delivered in our presence this 10th of August 1860.

Shoulders, M. L. To Winchester & Bate - Bill of Sale

Know all men by these presents that I Margaret Shoulders for & in consideration of the sum of five dollars to me in hand paid & the considerations hereinafter mentioned have this day bargained & sold and do by these presents release & convey to W. B. Bate and Geo. W. Winchester the slaves Rhoady aged about 45 years & child and the girl Mandy and hereby covenant to warrant and defend the title to the said slaves to the said Bate & Winchester and their heirs forever. The consideration of the above obligation is such that whereas the said Bate & Winchester have this day become my security in a promissory note executed to W. H. Blackmore Clerk & Mater for the use etc. for the sum of twelve hundred & six dollars dated August 4th 1860 and due six months after date. Now if I should pay or cause to be paid said note at maturity then this instrument to be void otherwise to remain in full force & virtue. Whereas on the 9th day of November 1850 John W. Gaines conveyed all his right title and interest in & to certain slaves inherited from his grandmother Frances Henderson to George W. Petway and Geo. W. Winchester and whereas in the division of said slaves between the parties the slave John was set apart & allowed to the said John W. Gaines. Now therefore in consideration of the premises & of the sum of twelve hundred dollars to us in hand paid we have this day sold & do hereby convey to Francis A. Gaines forever all our right title & interest in and to the said slave John. To have and to hold said slave to the only proper use & benefit of him the said Francis A. Gaines his heirs and representatives forever. And the said John W. Gaines warrants the title to the said slave against all persons whatsoever. And that he is sound in body & mind and about 18 years old. But the said Petway & Winchester warrant the title against themselves and those claiming under them only & not otherwise. Hatton, Robt. Vs. Barry, Thos. - Transcript

State of Tennessee

Pleas at the Court house in the City of Nashville, County of Davidson, State aforesaid on the first monday being the third day of September in the year of our Lord one thousand eight hundred and sixty and in the eighty fifth year of American Independence Present the Honorable Nathaniel Baxter one of the Judges of the Circuit Courts of the State of Tennessee and appointed to hold the Circuit Courts of the Ninth Judicial Circuit in the said State.

Robert Hatton vs. Thomas Barry.

Judgement by motion. This day came the Plaintiff by his Attorney and moved the Court for Judgement against the Defendant and it appearing to the satisfaction of the Court that heretofore to wit; on the 31st day of May 1860 a Judgement was rendered in this Court in favor of W. W. Berry against said Robt. Hatton and Thomas Barry for the sum of $2,919.59 debt and damages $13.05 cost of suit; which Judgement was afterwards to wit; on the third day of September 1860 satisfied in full by the said Robt. Hatton by the payment of the same of $2990.48 debt damages and costs aforesaid with interest up to the time of said payment and it is stated to the Court that the said Robt. Hatton executed said bill single or writing obligatory as the accommodation endorses for the Defendant Thomas Barry but the fact not appearing to the satisfaction of the Court a Jury of good and lawful men is empanelled to wit; Robt. F. Page, D. D. Patrick, F. Harmon; A. C. Farris; J. A. Watson; John Reddick; J. G. Powell; J. M. Felts, E. W. Williams; George Spain; C. G. Scales; Thomas Hesson, who being elected tried and sworn well and truly to inquire of and ascertain that fact on their oaths do say that the said Robt. Hatton did execute said bill single or writing obligatory as the accommodation and endorses for the said Thomas Barry. It is therefore considered by the court that the said Robt. Hatton recover of the said $2,990.48 together with his costs in this by him about his motion and Judgements in this behalf expended and that he have his execution.

Whereas I Joseph W. Anthony a citizen of Sumner County Tenn. am indebted to James Bankhead & Co. of Nashville Tenn. And to Macgregor & Bankhead of New Orleans La and which indebtedness has been this day settled by the following notes executed to James Bankhead & Co. to wit: one note dated 14th June 1860 for three hundred and fifty two & 87/100 dolls. payable seven months after date - one note dated 14th June 1860 for three hundred and fifty seven 37/100 dolls. payable nine months after date - One note dated 14th June 1860 for three hundred and sixty one 87/100 dollars payable eleven months after date and one note dated 14th June 1860 for one thousand and sixty six 67/100 dolls. payable ten months after date and which last note will be entitled to a credit for whatever amount may be collected upon certain collaterals which I have this day placed in the hands of James Bankhead & Co. said collaterals amounting to about the sum of one thousand and seventy three dollars after deducting expenses for collection; and I am desirous of securing & making certain the collection of said notes I do therefore transfer and convey by way of Mortgage to the said James Bankhead & Co. and give them a lien to secure said payment; upon the following slaves; my property , to wit; Bert a negro man dark complexion about twenty five years of age ; and John a boy about eighteen years of age. Now if said notes shall be paid at maturity by me then this mortgage deed and this lien shall cease and be null and void; otherwise to remain in full force and virtue until said notes are paid - as witness my hand and seal this 3rd day of September 1860.

I bind myself to cut the said crops of tobacco, house cure strip & bulk the same in good order and condition by the first day of April next without any addition charge for said labor. I hereby convey to Baxter Smith the following property; ten cows and calves twenty six stock hogs one yoke steers one yearling mule one two horse wagon & gear & three plows now in my possession fifty acres of corn now growing on the place upon which I now live & the crop that I will raise on said farm for the year 1861. I also convey to sd. Smith the following tract of land containing sixty acres more or less lying in civil District No. ___ in Robertson County Tennessee on Sulphur fork adjoining Warren Dorris & Dorks; it being the same land conveyed to myself by Z. C. Utley on the 11th October 1859 and conveyed to him by Orville Harrison reference is made to sd. deeds on record in Robertson County for the boundaries of the sd. land: To have and to hold said land to the sd. Smith his heirs & assignees forever; I covenant that sd. land is unencumbered & that I have a right to convey the same. But this deed is made for the following purposes that is to say I am indebted to Guilds & Smith two hundred dollars due Novr. 1st 1861 by note this day executed and to James Welsh the sum of about seven hundred dollars dues for loaned money & labor performed. Now if I should pay off & discharge the above mentioned debts in the order in which they are mentioned by the 1st Novr. 1861 then this deed to be void but if I should fail to do so then the said Smith is authorized to sell the above mentioned property after giving legal notice & apply the proceeds

of sd. sale: first to the costs of this deed & secondly to the payment of the above mentioned debts in the order in which they are mentioned & pay the balance if any to me This 4th Septr. 1860.

Jackson, Wm. To J. W. Moore - Deed of Trust

I Wm. Jackson have this day sold and do hereby convey unto J. W. Moore his heirs & assigns forever the following property to wit: three one year old fillys, one bay, one sorrel, & one brown color, one bay mare, one sorrel mare, one red cow & calf, one yellow cow & calf, one muly cow yellowey white spots, & one white heifer two years old one 1 horse wagon one school wagon one wardrobe & press. This deed is made for the following purposes & no other to wit the said J. W. Moore is my security on two notes payable to L. A. Baker drawn August 1st 1860 one for three hundred & five 59/100 dollars the other for three hundred & three 59/100 dollars both notes due twelve months after date; and I am desirous to secure & make certain the payment of the same now if I should pay the said debt at the time required then this deed to be void but if I should not then the said J. W. Moore after giving legal notice in the county may expose the above named property to public sale for cash or credit as may be thought best and appropriate the proceeds to the payment of the above named notes and the remainder if any return to the said Jackson his heirs or assigns. Septr. 6th 1860.

This indenture made this 30 of April one thousand eight hundred & Sixty between Sam'l E. Patton of the county of Sumner & State of Tennessee of the one part and Margaret H. Patton of the county & State aforesaid of the other part witnesseth. That for and in consideration of the love and affection that I Sam'l E. Patton bear to my mother the said Margaret A. Patton (and for divers other causes and consideration) I have this day and do by these presents grant bargain and convey unto the said Margaret A. Patton all the right title claim and interest that I have in & unto these slaves namely: Fanny and her children Mary and her children and Hannibal the above named slaves being left to me jointly with my mother by my father John Patton Dec. in his last will and testament. I do by these presents give grant and convey
