LAST WILL AND TESTAMENT:  I, R. E. Durrett of Robertson County, Tennessee, being of sound mind and disposing memory, and realizing the uncertainty of this existence, do make, publish and declare this my last will and testament, hereby revoking and making void any and all other wills by me at any time heretofore made, with provisions as follows:

ITEM NO. 1--I direct that all my just debts be paid, and that all just claims due me be collected, all as soon as practicable after my demise, by my Executor hereinafter named.

ITEM NO. 2--I give and bequeath, in trust, to Forrest M. Durrett $8,000.00 in cash or securities in that amount, market value, to have and to hold to him for and during the natural life of my wife, Maude Durrett, with the free power in said Trustee to change investments at any time, without court decree, investing in such property as he deems best, and paying the income therefrom to said Maude Durrett.  Said Trustee will not make bond or report, or qualification, to or in court.  Upon the death of said Maude Durrett the corpus of said trust, together with accrued and undisposed of income, will go to said Forrest M. Durrett, individually and absolutely.

ITEM NO. 3--The balance of my personal property not embraced in Item No. 2 above, I give and bequeath unto my wife, Maude Durrett, absolutely.

ITEM NO. 4--I give and devise unto my wife, Maude Durrett, all the real estate including undivided interests, which I may own at the time of my demise, to have and to hold the same for and during the term of her natural life, and she is empowered to sell the fee of any part or all said real estate or undivided interest and convey good title thereto to purchaser or purchasers should the same be necessary for her support and maintenance.

At the death of my said wife, I give and devise said real estate or undivided interest remaining unsold at her death, as follows:

(a) To Kathleen Durrett Hale, for and during the term of her natural life with remainder over at her death to Forrest M. Durrett and Lola Durrett Williams, the 140-acre, more or less, farm which was conveyed to R. E. Durrett and Forrest M. Durrett by A. J. Erwin et ux., in a deed of record in the office of the Register aforesaid in Deed Book No. 101 at Page No. 76, to which records reference is here made for description of said farm or land.

(b)  To Lola Durrett Williams my old homeplace real estate located in the 15th. Civil District of Sumner County, Tennessee, consisting of about 1 1/2 acres, purchased by me from T. C. Chandler, to which deed recorded in the office of the Register of Sumner County, Tennessee, reference is here made for description of said property; To Lola Durrett Williams the 25.25-acre piece of land which was conveyed to R. E. Durrett by L. L. Shannon et ux., in a deed of record in the office of Register of Robertson County, Tennessee, in Deed Book No. 98 at Page No. 448, to which record reference is here made for description of said property; To Lola Durrett Williams the 91.2-acre tract of land which was conveyed to R. E. Durrett by J. W. Boyles et ux., in a deed of record in the office of the Register of Robertson County, Tennessee, in Deed Book No. 90 at Page No. 293, to which record reference is here made for description of said property.

(c)  To Forrest M. Durrett the undivided one-half interest of R. E. Durrett in the real estate located on Greenbrier Pike, which was conveyed to R. E. Durrett and Forrest M. Durrett by Rufus J. Haun et ux., in a deed of record in the office of the Register of Robertson County, Tennessee, in Deed Book No. 98 at Page No. 200, to which record reference is here made for description of said property.

(d)  To Forrest M. Durrett, Kathleen Durrett Hale and Lola Durrett Williams, share and share alike, all the rest and residue of my real estate.

LASTLY, I do nominate and appoint Forrest M. Durrett sole Executor of this last will and testament, and that he may serve as such without bond or report to court except a final settlement, to clear title to my real estate.

IN WITNESS WHEREOF, I have hereunto set my hand, this February 19, 1946, at Springfield, Tennessee.

Subscribed by the Testator in our presence and we have signed our own names hereto as witnesses, in the presence of each other and of the Testator, by and at his request, and he declared the foregoing instrument to be his last will and testament, all at the place and on the day above written.

*Will was probated 28 January 1947.  Robert Edwin "Bob" Durrett was the son of Francis E. Durrett and Ann Elizabeth Madeline Ackerman.  He was b 16 March 1875.  He married Maude Widick in Robertson County, Tn. on 5 May 1903.
