Warren Co., TN. was created in 1807 from the larger White Co. The County Seat is McMinnville, TN. 37110. It is located in the Central part of the State. Bounded by DeKalb & White Co's on the North; Van Buren Co. on the East; Grundy Co. on the South; wit Cannon Co. on the Northwest & Coffee Co. on the Southwest. "When one notes the appearance of James & Jacob SURRATT on the 1812 Tax list for Warren Co., TN, the question of identity arises. It does not appear this Jacob was James son (James, 4 did have a son named Jacob ..prs) because his son Jacob would have been to young to be taxed!."

As Noted in [REF:#90], Pg 177
" Alabama opened up to the white people at the end of the War of 1812, and the best land was the bottom land along the Tennessee, Alabama and the Tombighee Rivers. The good land around what is now Huntsville was being settled as early as 1805, and the SURRATT's were in Madison Co., and Morgan Co., AL. along the Tennessee River by 1815, and perhaps earlier."
Morgan Co., AL. was created in 1818, as "Cotaco" from the Cherokee "Turkytown" Cession. the names was changed in 1821 to Morgan Co. The County Seat is Decauter, AL 35601. It is located in the North Central part of the State; Bounded by Limestone & Madison Co's on the North; Marshall Co., on the East; Cullman Co. on the South; with Lawrence Co. on the West. (First Census was 1830, Pro judge has m. and pro rec from 1818.)

"Jacob1 & Lucinda (MORELAND) SURRATT, left Warren Co., TN, prior to 1813 (birth of first child in AL) and in 1822 he "deeded" some property as a "Gift" to his Nephew Riley T. SURRATT."
Possible Record Problem!
[Riley T., Surratt, was a on of Samuel,4 & Martha (RICE) SURRATT of Madison Co., AL. this was another brother of Jacob,1 SURRATT ..prs]
He may have left in 1813, but he did not dispose of his property until 1820. There's a record dated 1820, that Jacob,1 SERATT, a30y sold 100 acres of land in Warren Co., TN. to Felease RICHARDS.
No 1820 Census, was taken in Warren Co., TN. or Morgan Co., AL., so no 1820 record for Jacob,1 & wife is available. ..prs. Jacob,1 SURRATT, was 34 years old when his father died a77y in Sep. 1824, in the old Rowan Co., NC. No Will has ever been found and his mother's name was never mentioned in any of the several deed transactions. Jacob1 & wife Lucinda (MORELAND) SURRATT, can be found in the 1830 Census for Morgan Co., AL. With all of his 10 Children Identified living in the family household. "Jacob,1 SURRATT, a53y died bfr 08 Oct 1844 and he had a Will and a clear picture of his children emerges from the terms of his will. His son Melkijah SURRATT was the Executor. Later when his wife Lucinda, went to Court to carry out his wishes, the picture of his family is enlarged. " [No copy of will was presented nor source of record listed ..prs]
LAST WILL & TESTAMENT OF JACOB SURATT

January the 17th 1843. The State of Mississippi Tishomingo County. In the name of God Amen, I Jacob Suratt of the County and State aforesaid being weak in body tho of Sound mind make the following as my last will and testament
First, that my body shall be decently interred and that as much of my personal property be dispersed of as to pay off and satisfy all just debts.
Secondly, I bequeth unto my beloved wife Lucy the whole of my estate both real and personal and that she shall have entire control and management of the same during her natural life or widowhood Also that she may give unto each of my daughter(s) as they marry off the same amount or quanty of property that I have heretofore given unto those who have heretofore married off. Also that she may shool (sic schools) & educate my children who are not of age out of the proceeds of my estate in all the branches of the Common English Branches of Education.
I further bequeath and will that all the negroes belonging to my Estate at my death Shall be kept together and the proceeds of the labor be appropriated towards the suport of my wife and children who are not of age and twards the Education of my Children as above mentioned and in case my wife Lucy should die before my Children Shall be raised and educated then that my Executor who I shall hereafter appoint shall have the control and management of my negroes and property both real and personal just the same as my beloved wife for the purposes mentioned And that all my daughters who have never been marrried shall have and be entitled to a decent Support out of the proceeds of my plantation and labor of my negroes until my youngest child shall become of age and a final division of my property shall take place agreeable to this my last will and testament And when my youngest child shall become of age then my beloved wife Lucy if she may think proper may make an equal division of so much of the property belonging to my estate as she thinks proper amoung my lawful heirs agreeable to the term and meaning of this my last Will and Testament.
I futher bequeath unto my three sons:
William Wright,
John Morland, and
Samuel Bouel,
the following lands belonging to my Estate.
First, I bequeath uno my son William Wright the North East Quarter of Section Thirty lying and being in the County and State above mentioned of the Chickasaw Cesion that he shall take charge of the same when he becomes of age but shall not have power to sell or disperse of the same until my youngest child becomes of age and that my sons
John Moreland and Samuel Bouels Shall have the West half of Section Twenty-nine and the South East quarter of Section thrity being in the County & State aforesaid; that they may take charge of the same at the death of my wife Lucy by Supporting my unmarried, daughters, giving power unto my wife Lucy to grant them the privelege of cultivating the same land as they become of age and that each one of my daughters being the children of my wife Lucy shall at her death provided she lives until my youngest child becomes of age and in the event she dies before that time at the time my youngest child becomes of age - that they and the heirs born of their bodies shall have a grown negro woman of the value thereof out of my personal Estate provided there be that much.
And in Case I should not have that much personal property that all of my personal property shall be equaly divided amongst my daughters and in case as aforesaid giving unto them and the heirs born of their bodies and in case any of my daughters die without heirs born of their bodies then the property they should have received and its natural decease (in-case of negro property) shall be equally divided among my children who may be living or their children in case of their death shall inherit their part.
And when my daughters shall have received the value of a grown negro woman or the value thereof in case there shall be a remainder of property after then my three sons above mentioned and my Son Melkijah Suratt and my daughters and in case of their deaths then the heirs born of them shall inherit an equal division of my personal property belonging them and their Children as aforesaid.
I further apoint and castiteto my beloved Son Melkijah Surratt my lawful Executor & give him the power to act and carry into effect all the provisions and conditions of this my last Will & Testament. I further authorise and constitute him the guardian & agent for my two younger Gransons James Peterson Walker and John Alexander Walker sons of my daughter Sarah Moreland (Surratt) Walker dec'd formerly wife of John B. Walker and that he shall receive for them their Mothers portion of the estate and that they Shall receive one daughters portion of my Estate.
In testemony whereof I have hereunto Set my hand and afforised my Seal this the day of one Thousand Eight Hundrend and forth three.

The State of Mississippi Tishomingo County personally came before me Abram H. Weir Judge of the Probate Court for the County & State aforesaid C. W. Bell and W. R. Barnete who after being duly qualified upon oath say that they saw the Testator Jacob Suratt Sign Seal and acknowledge the above instrument as his last Will & Testament and that he was of sound and disposing mind and memory and that he called upon them to Witnes the same and that they signed and attested said Will in the presence of said Testator and likewise they saw James Bell sign the Same in presense of said Testator and at his request. Given under our hand and Seal Nov. 4th 1844.

Lucy SURATT vs.
A.J. DRIVER
This Indenture made and entered into this 2nd day of December A.D. 1858 between Lucy SURATT the widow of Jacob SURATT, dec'd of the first part and A.J. DRIVER and his wife Lucy E. DRIVER (formerly Lucy J. SURATT) of thesecond part. All of Tishomingo County, Mississippi that wherein by the Last Will and Testament of thesaid Jacob SURATT, dec'd died dated January 17th 1843 and was duly proven admitted to probate and ordered to be recorded on the 4th day of November 1844 by the Probate Court of Tishomingo County, Mississippi, of which Mr. SURATT, dec'd appointed the executor, the said Lucy SURATT was invested? with full power to make a division of Sa? much of this property, belonging to said estate as she might think proper. Soon as the youngest child became of age, this Indenture further witness that thesaid party of the first part this day under the provision of said Last Will & Testament hereby gives and delivers unto the parties of the second part a Negro girl named CLONA? of yellow complexion and aged about 16 years, value at Eleven Hundred [$1,100] dollars by James BOX, J.C. REED and E.C. GILLENWATERS? (approved dower by the Attorney At Law) the said parties of the first part pays back to Lucy SURATT the sum of Twenty [$20.00] Dollars being the amount over the average value of a Negro woman which amount is to stand charged against the said parties of the Second part and deducted from their share of said parties stated in a final division of the Same.
This Indenture is made in this confidence that is said that the same is to he duly recommended in the Probate Clerk's Office of the County and State aforesaid and that the same is to that agrees to the said "Negro" girl herein before declared in the said A.J. & Lucy J. DRIVER.

Melkijah SURRATT, reputedly graduated from College at North Bend, Indiana, and became a "Lawyer" but never practiced. Instead he became a successful merchant and planter in Booneville, Prentiss Co., MS.
He enlisted as a Private in Company A, 2nd Regiment "Tishomingo Rifles" of the MS. Infanrty during the Civil War in the Confederate Army and was promoted to "Captain" and became the "Regimental Quartermaster." After the War, Melkijah SURRATT was appointed "Agent" for the NOBILE & OHIO Railroad at Booneville, in Prentiss Co. MS. He was a "Representive" in the lower branch of the MS. State Legislature, and helped frame and pass a Bill signed by the MS. Governor on 14 Dec. 1859 to make a seat of Justice for the newley formed district at Cornith, in Alcorn Co., MS. He was on the "Board of School Commissioners" and was a "Justice of the Peace".

Samuel Boule SURRATT was born in 1832 in Alabama and died on 09 Jul. 1881 at the age of 49 in Mississippi. He is buried in the Henry Cemetery, Alcorn Co., MS. He married Pattie FLOURNEY of Tennessee and they had four children.
He became a Methodist Minister and worked in Louisiana where he was a Chaplain for the 19th Louisiana Confederate Infantry. He then removed to Tennessee and also worked in Paducah, McCracken Co., KY.
