His father was NOT listed, even though JACKSON HAGGARD did not die until some 3 years later? (Based on his Headstone Marker..prs) See: Mother's 1840 Census

The next year the 29 year old "Widow" Frances "Fannie/Fanny" (WATERS) HAGGARD; was married on the 22nd Oct. 1841; Officialated by Mr. Randal HILL, Esq. Which was was witness by Elijah BALLARD and Nancy (Waters) THOMAS (Fannie WATERS's sister and Brother-in-Law...prs) in Sevier Co., to the 22 year old James D. SARRETT (My Gr-Gr-Gr-Grandfather) and later had Five more children., two half-brothers William J. & Samuel H. SARRETT and three half-sisters Nancy, Elizabeth and Dellie SARRETT.

Ezekiel L. HAGGARD was 23 years old when the Civil War broke out. Both his two half-brothers were in the Civil War (Union). He was Private in the Confederate States of America, (CSA) "A" Company, 39th Tennessee Mounted Infantry (CSA). No Pension allowed. He was Mustered in on 20 Dec. 1861, in Sevier Co., TN., by J. W. CHAMBERS. Was in the battle at Vicksburg 25 Dec. 1862; Was Pardoned on 18 Jul. 1863

Ezekiel L. HAGGARD, was the Administratior of his Step- father James D. SARRETT Estate, who as a Civilian and was captured from his home in Sevier Co., TN by Confederate troops and taken to Andersonville Stockade in Georgia where he died on 04 Sep. 1864, at the age of 45 years, 6 Months and 21 days; He is buried in the Andersonville Prison Cemetery, Georgia, "Grave Marker No. 7923"; James D. SARRETT and FANNIE (WATERS) HAGGARD SARRETT had Five children, all born on their Kellum Creek farm of Sevier Co., TN., who were Half-Brothers & Sisters of Ezekiel L. HAGGARD.

THE CHILDREN:
Son: William J. SARRETT; was born in 1843, but died in the Civil War in January 1863, a Union soldier; 1st. Dau: Nancy ANN SARRETT; was born in 1844 and she was 20 years old when her father died, she later married twice, first in Dec. 1867 to J. "Absolen: McCARTER, then in 1895 to James BOHANAN; 3rd. Son: SAMUEL H. SARRETT; was born in 1846, he was 18 years old, a Union soldier and still in Andersonville Prison when his father died, he was not released until July 1865, he married in Nov. 1865 to MARTHA A. ATCHLEY and they had 11 Children, the only descendants of this family; 2nd. Dau: ELIZABETH JANE SARRETT; was born in 1849, was 15 years old when her father died, she later married Aug. 1866 to James M. HARDIN; 3rd. and youngest Daughter FRANCES "Dellie" SARRETT; was born in 1851, was 13 years old when her father died, she married twice, first in 1872, to William R. VARNELL, then in 1877 to McCAMPBELL MAPLES, she died young in 1889 at 37 years of age.

DEATH OF Step-Father James D. SARRETT:
James D. SARRETT died on the 4th of September in 1864, while in the Andersonville Prison. His family had been torn apart by the Civil War. His Step-Son Ezekiel L. HAGGARD had joined the Confederate "Tennessee 39th Mounted Infantry", his oldest son William J. SARRETT, a Union soldier, was shot and killed at the "Battle of Mufreesboro" in January 1863, his son SAMUEL H. SARRETT joined the Union in March of 1862, which he was captured by the Confederates on 19 Jan. 1864 and was confined at Andersonville Prison in Georgia (Samuel H. was not release until after the War on 24 Feb. 1865) It has been reported that James D. SARRETT, was a member of the Home Front, the Tennessee National Guard, in Sevierville. On or near the 25th. of Febuary of 1864, the 45 year old Crippled was captured by Rebel (Confederate) forces, and taken from his home to the most feared Confederate Prison Stockade at Andersonville, Sumter County, Georgia where his son SAMUEL H. was since January 1864. 6 months after James D. SARRETT, capture he died. The Hosptial records show he died of Dysentry on 04th September 1864. He has a Burial marker Number 7923, in the National Cemtery of Andersonville, located of of Highway 19, 60 miles South of Macon, Georgia.

Step-Son Ezekiel L. HAGGARD, had just been Paroled at Asheville, Buncombe, North Carolina on 26th of April 1865. (Confederate troops "Surrendered" to the Union Federals at the end of the War) He was 27 years old on 01 May 1865, the date he "Took it upon him self" and filed the Bond for the Administration and Executor of James D. SARRETT, dec'd Estate, by placing a $500 Bound with the Court. Good friend 27 year old William F. NICHOLS was his Security.

On the same day 01 May 1965, the County Court appointed neighbors James MAPLES, William R. ATCHLEY and JOSHUA ATCHLEY, Sr. to go out on the property and "Layoff and set apart" a years support to the Widow Frances (WATERS) HAGGARD SARRETT and family.

On 09th May 1865, Ezekiel L. HAGGARD submitted a "List of Personal Property" of the James D. SARRETT, dec'd. which consisted of $29.45 "cash on hand" and some 25 items, 2 cows, farm machinery misc tools, and kitchen ware. This "Inventory" was auction off on 26th May 1865, and the Estate collected $116.70. Its interesting to note that Frances (WATERS) HAGGARD SARRETT, bought back her own Milk Cow, Sugar Holders, Clock, Spinning Wheel, both one horse plows and a Grind Stone, all for $9.75. GIDEON MAPLES, James MAPLES and E. C. ALLESON all bought "a lot of Books" it would be interesting to know what the title of these books were, and who read them ?

On 02 October 1865, the Court appointed Frances (WATERS) HAGGARD, SARRETT, Guardian to the Minor Heirs of James D. SARRETT, dec'd. Who gave Bond in the sum of One Thousand Dollars ($1,000), with Son Ezekiel L. HAGGARD, age 27 and William F. NICHOLS, age 27 as Security. Which Bond was approved by the Court and she duly qualified. No "Heirs" were listed in this Minutes, but the Children at the 02 Oct. 1865 date where:

     Dau: ELIZABETH J. SARRETT; b. 1849, age 16 & Minor
     Dau: FRANCES D. SARRETT; b. 1851, age 14 & Minor

On 01st of Nov. 1865, Ezekiel L. HAGGARD came and filed this Petition, for the sale of the two (2) undivided interest in the lands of which the said James D. SARRETT, died seized and passed. The Court asked the Clerk & Masters Mr. M. A. RAWLINGS, to check out this Petition to see the following and report back to the Court.:
     1st What is the value of the two (2) undivided interest in Lands mentioned in the Petition, in this cause
     2nd Whether said Lands can be Petitioned among the Heirs without manifest injury to the Farm.
     3rd Whether it will not be to the interest of all concerned, to have the two (2) undivided interest sold, and the proceeds applied to the rest of said Minors, and that he respond to the next turn of the Court.

On 04 Dec. 1865, the Court Decreed to accept the Petition of Ezekiel L. HAGGARD, Admin. and ordered the Clerk & Masters to advertise and proceed to sell the two Kellum Creek property, to the highest bidder, at the Court House door, and that the two tracts of land are worth $100 each. SAMUEL H. SARRETT was the highest bidder on 28 Dec. 1865, and paid $25.00 deposit which covered the Cost of Sale of $25.60, leaving a 12 month credit of $175, with William R. ATCHLEY as his Surety.

SUMMARY OF SETTLEMENTS:
By Ezekiel L. HAGGARD. After the Sale of the Personal Property in May of 1865
      1st. Settlement was made on 21 Feb. 1866. The income of $116.70 sale was brought forward as only $87.60, apparently the Clerk & Master M. A. RAWLINGS made a mistake of $29.10. With the collection of some $199.99 of notes received the total Estate was worth $208.59 and after James D. SARRETT's and other Court Expenses were paid of $161.06 the balance of the Estate was $47.53.
      The 2nd. Settlement was on the 01st June 1867, which was a recap of Sale of the Kellum Creek 100 Acres as listed above.
      The 3rd. Settlement, was made on 04 July 1867 the only income into the Estate was $4.15 on the previous $47.50 balance and after paying Dr. J. M. HAMMER note of $32.00 and other Court cost the Estate had an $17.20 balance.
      The 4th. Settlement, was made on 25th Aug. 1867, with interest $.29 cents on the previous balance. The new Clerk & Master WILSON H.H. DUGGAN, charged the Estate with a $9.67 Fee for 5% on Money he collected and other Clerk Cost, left a $7.07, balance in the Estate.
      The 5th. Settlement, was made on 06th Dec. 1867. The new Clerk & Master WILSON H.H. DUGGAN, made a mistake and only brought forward $6.08 instead of the $7.07 balance of 25 Aug. 1867. After paying a Note from BEN? ATCHLEY of $5.00 and other Clerk Cost, left a $.47 cents, balance in the Estate.
      The 6th. and Final Settlement, was made on 22 Dec. 1868. No more notes were collected, and paying JOHN M. RAMBO a $8.33 Note; Son SAMUEL H. SARRETT, a 22 Aug. 1865 Note of $20.00 which was "Proven" Note Samuel H. was 19 years old and home from the War 1 month July 1865; paying former Clerk & Masters M. A. RAWLINGS $5.48; and a $11.05 "Judgment Cost" the BRABSON Brothers the Estate lacked the sum of $45.64 of paying all the Debts of the Estate. Ezekiel L. HAGGARD, Admin. asked the Court that each heir pay their proportional part.

In the 1865 Tax Polls, for Sevier Co., TN., we find Ezekiel L. HAGGARD, with the following:

(RANDOLPH) HAGGARD were three farms away (F.G. 160) who had just returned from Georgia in 1865
