Possible Record Problem! What is the "Middle" name of Samuel H. SARRETT? |
No where in the some 147 Source Documents was ever his middle name was spelled out only "H." was used. It has been told, to this writer, by his mysteries Grandfather, the 5th Son Hugh SARRETT, that he was named after his father's middle name Samuel "Hugh" SARRETT, but, in 1980 when I first met "Marie" (MATTHEW) OTTINGER [REF:#58], she believes his middle name was Samuel "Henderson" SARRETT. In the [REF:#22] 1850 Census F.G. 614 we find little Samuel H. SARRETT
at 4 years of age, living with his parents and some of the surrounding
farm children were:
RACHEL ATCHLEY age 7,
ELIZABETH ATCHLEY age 6, and
ROBERT ATCHLEY age 2,
These were the children of the (F.G. 612) Rev. ROBERT S. ATCHLEY & his first Wife LOUISA E. (CLARK) ATCHLEY Later he married his Niece Martha Ann (ATCHLEY) ATCHLEY, F.G. 613) John & Martha LEWALLEN, children WILLIAM age 2, and HILDA age 6 months. The ATCHLEY & SARAH HAGGARD's children WILLIAM age 17, ATCHLEY, Jr. age 6, John age 2, and LOUISA 5 months. Samuel H. SARRETT's early life was spent in securing the rudiments of an education, and in his "teens" he learned the "farmers" way of life in the Sevier County, TN. area from his father. In the [REF: #23 1860 Census for Sevier Co., TN. he was 14 years of age "Attending School" and helping his father work the farm. THE CIVIL WAR 1861-1865 2 years later, at an young age of 16 years, on 08th. March 1862, he left his fathers farm and joined the Federal (Union) Company "B", 6th. Reg't. Inf., East Tenn. Volunteers to fight in the "Civil War"; Was Captured by the Confederates when he was 17 years on 19 Jan. 1864 and placed in the most feared prison in the Civil War "Andersonville", where he remained some two years (released 24 Feb. 1865 and which latter was one of his cause of death. His father James D. SARRETT, was captured by the Confederate forces on or around the 25th. of Feb. 1864, at his home on Kellums Creek, Sevier Co., TN; He died in Andersonville Prison on or about the 4th. of Sep. 1864; The son Samuel H. SARRETT, survived Andersonville and returned home in July of 1865. See Appendix for Information on Samuel H. SARRETT in the Civil War: Samuel H. SARRETT, was still in Andersonville Prison, when his Step-brother EZEKIEL L. HAGGARD, filed his Administrator's and Executors Bond, over the JAMES D. SARRETT, dec'd Estate on 01st May 1865, also when the Estate Sale was conducted on the 26th. of May 1865. Their is a record, that on 22 Aug. 1865, EZEKIEL L. HAGGARD, Admin. paid Samuel H. SARRETT, $20, for a "Proven Account dated 22 Aug. 1865" (Settlement, 12 Dec. 1865, Page 177) Samuel H. SARRETT MARRIES Some four months after he returned from the Andersonville Prison in Georgia, the 19 year old Samuel H. SARRETT, was [REF: #35married on the 14th of Nov. 1865, Catlettsburg, TN. Officialated by the Justice of the Peace JESSIE HILL, of Seviervillee, TN. to the 17 years old Miss Martha Ann ATCHLEY, b. 21 Jun. 1848, near Catlettsburg, Sevier County, TN. d. 15 Dec. 1931, at the age of 83 years, 5 months and 24 days, both are buried in the Alder Branch Cemetery, Sevier Co., TN. She was the 8th born, 5th daughter of ISAAC ATCHLEY and his 2nd. Wife MARY (BOWERS) ATCHLEY, who had a farm near JAMES D. & FRANCIS "FAnnie" (WATERS) SARRETT where both families children were raised together. The Chancery Court of Sevier County, Decreed and appointed FRANCIS (WATERS) HAGGARD SARRETT, at the Guardian to the Minor Heirs of JAMES D. SARRETT, dec'd on 02nd. Oct. 1865, Son Samuel H. SARRETT, was married and 19 years of age. (Court Minutes, Book 1862-67, Page 218, Monday 02 Oct. 1865 On 01 Nov. 1865, the EZEKIEL L. HAGGARD, Admin., filed with the County Court, a Petition to Sell the Kellum Creek, property. A Deed was prepared on 20 Nov. 1865, 62 by the Widowed Mother FRANCIS (WATERS) HAGGARD SARRETT, to Son Samuel H. SARRETT, for $500.00, of 100 acres of his fathers Kellum Creek property, although this deed was never registered. On Dec. 04 1865, the Court Decreed to "Bid the Land" at the Court House door, with a $25 deposit and a 12 months Lien on the property, until its paid. On the 26th. of Dec. son Samuel H. SARRETT, was the highest "of $200" for this same property. On 21 Jan. 1866, 63 Samuel H. SARRETT, paid his sister NANCY A. SARRETT, $85.00 for her interestthe same two 50 acre tracts, plus the 100 acres of his fathers original "Land Grant of 1851" property.
On 22 Jul. 1882, Samuel H. SARRETT, at 37 years of age, appeared before
the County Clerk, of Sevier Co. of the "Chancery Court of Record"
to file a "Declaration for an Original Invalid Pension" application,
for his Civil War services. He signed this application "S. H.
SARRETT". He also had two witness with by the name of M. E. LRVE?
and D. STOFFORD. [REF: #32]
DECLARATION FOR AN That since leaving the service this applicant has resided in Sevier County, in the State of Tennessee and his occupation has been that of a Farmer. That prior to his entry into the service above named he was a man of good, sound, physical health. That he is now Seriously disabled from obtaining his subsistence by manual labor, by reason of his injuries above described, received in the service of United States, and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. He here by appoints W. T. FITZGERALD, of Washington, D. C., his true and lawful attorney to prosecute his claim. Catlettsburg, Sevier, Co., Tenn. Signature of Claimant LS\ S. H. ATCHLEY and Isaac A. ATCHLEY both of "Cove Springs", Greene County, Missouri, filed an "General Affidavit for any Purpose" which they swore ...they were acquainted with Samuel H. SARRETT, and new him before the War and since then, up to 1878....They lived near to him, from youth and up to the year 1878 when they removed to Greene Co., Mo., and were very often together..." [REF: #33 John O. & ISAAC ATCHLEY were brothers of Martha A. (ATCHLEY) SARRETT, ..prs No record found that Samuel H. SARRETT, was ever granted a "Disability Pension", their is a document dated 22 Oct. 1883, from the WAR DEPARTMENT, Adjutant General's Office, Washington D.C. to the "Commissioners of Pensions" Which listed his military service and stated he was "Captured on 19 Jan. 1864, near Strawberry Plains, TN. while he was "Absent with-out leave." They gave "No evidence of disability alleged". [REF: #34 On 3rd. Jul. 1883, Court Minutes, list that "It is ordered by the Court that Samuel H. SARRETT, be appointed as Overseer of the road, beginning near E. H. ROBERTS, property and intersect the Bryant Fery Road, near J. R. LECK's property; and he (Samuel H. SARRETT) required to keep the same in lawful repair as a 3rd. Class Road, with the hands on the farms of Samuel H. SASETT; JAMES ELLIS; GIEDON Mc MAPLES; Wm. D. ATCHLEY; G. A. ATCHLEY; and Wm. C. MURPHY'S farm where C. A. MURPHY lives. It is ordered by the Court that Samuel LEETH, be released from working on Public Road, on account of disability. (Sevier Co., TN. Record Book 4, Page 384
On the 7th of Jun. 1890, the Court decreed to Mrs. Samuel H. (ATCHLEY) SARRETT, a sum of $300, for her "years support" ....after having gone upon the premises of deceased; and after having been sworn, preceded to set aside and designate said support as follows: "Said family consists of said Widow and seven children and we regard an allowance of ($300) Three Hundred Dollars as a reasonable allowance and there being no Wheat, Corn or other grain, no Bacon, No Stock-hogs, nor any other provisions on hand, except what we allowed her, by the exemption laws and no money on hand." We therefore set apart to said Widow to her exclusive use with which to procure her support for the year, the following property to wit: 1.) Eleven head of young Cattle. 6, 2 year olds & 5 Yearlings, worth about $175.00) 2.) One Bay Mule. 1 years old past, worth about $ 65.00) 3.) One Gray Mare. (About 7 years old, worth about $ 60.00) The above in our judgment is a fair and reasonable allowance for said Widow and family. (ATCHLEY) SARRETT appeared before the Sevier County Clerk and filed an "Declaration for Widow's Pension" [REF: #35 She listed the following children who are under 16 years of age, and now are living with her with "no means of support" (ages are based on application date) Hugh E. Their is a "Special Schedules" of the 11th. Census - 1890. This has records Enumerating Union Veterans and Widows of Union Veterans of the Civil War. Martha A. (ATCHLEY) SARRETT, was listed in this "Special Census" as "Widow of Samuel H. SARRETT" it list's "Pvt. "B" Company, 8th. Inf., Enlisted Date March 1862; Date of Discharge Jul. 1865. See Appendix for more information on Samuel H. SARRETT and the Civil War. On 29 Jun. 1892, WILLIAM D. ATCHLEY, [REF: #36 appeared before the Clerk & Master, of the County of Sevier, Tenn. and filed an "Sworn Statement" regarding his Cousin (William D. Atchley's father William R. Atchley was Martha A. (Atchley) Sarrett's Half-Brother) Martha A. (ATCHLEY) SARRETT, application of "Civil War Widows Pension". makes oath in relation to the said claimant as follows: .....I am 54 years old, I knew Samuel H. SARRETT from boyhood, until his death. I lived near him.... I Served in the Army with him and in the same Regitment and Company. Was with him all the time except about 18 months that the soldier was in prison. I am well acquainted with Martha A. SARRETT, she has not married since the death of husband S. H. SARRETT. My Post Office is "Cattelsburg, Tenn. MAPLES, [REF: #37 appeared before the Clerk & Master, of the County of Sevier, Tenn. and filed an "Sworn Statement" regarding his sister-in-law Martha A. (ATCHLEY) SARRETT, Gideon Mc. Maples, was married as his 2nd. wife to Malissa C. (Atchley) Maples, sister of Martha A. (Atchley) Sarrett application of "Civil War Widows Pension". makes oath in relation to the said claimant as follows: ....I am 68 years old, I knew Samuel H. SARRETT from boyhood, until his death. I lived adjoining farm to him....I am well acquainted with Martha A. SARRETT, she has not married since the death of husband S. H. SARRETT. My Post Office is "Gattelsburg, Tenn. I have no interest in the prosecution of this claim.... He signed his name G. M. MAPLES, no witness to this statement. On 16th of Jan. 1893, widow Martha A. SARRETT, Peter W. SARRETT, WILLIAM P. ATCHLEY, R. "Chresty" SIMS and are held and firmly bound to the State of Tennessee, in the sum of One Thousand Dollars [$1,000]. The Condition of this Obligation is such, That whereas the above bound Martha A. ATCHLEY of the estate of Samuel H. SARRETT, dec'd. .....This cause came upon the Court this 16th day of January 1893, before the worshipful County Court, of Sevier County, on the Petition of Martha A. (ATCHLEY) SARRETT and noted served on debts which appears from the letters thereof on file is to be more than five days since the application of Petition was made; from which it appears that, Petitioner is the legal widow of Samuel H. SARRETT dec'd and as such is entitled to a "Homestead and Dower" out of the land of which her husband was seized and possessed at the date of his death which were three tracts of land located in the 7th Civil District of Sevier County Tennessee, as follows: TRACT I A tract of land known as the "Home Farm" where deceased died and where petitioner now resides adjoining lands of ANDREW HENDERSON and WILLIAM P. ATCHLEY on the East, GIDEON MAPLES, A. J. KYKER, and HOUS ROBERTS, on the South and South West and the French Broad River on the North; Containing 156 acres more or less. TRACT II A tract of land known as the Entry, adjoining land of THOMAS LOWE on the North; JOSEPH ATCHLEY on the North and East; ROBERT PARKER and MARY ROIMNES? on the South; On the West by said ROBERT PARKER and HOUS ROBERTS containing 61 acres more or less. SERRETT, dec'd a Homestead as follows: (HOMESTEAD TRACT) 156 Acres Beginning on a Stake in line of ANDREW HENDERSON next to old SARRETT line and a Corner to HOUS ROBERTS line. The said Creek Farm, adjoins the lands of J. E. TYSON; Samuel HUFFAKER; JAMES MAPLES; R. Chresty SIMS; R. E. PARKER and perhaps others and contains about 200 acres, about half being cleared and in cultivation. Complaint inherited one eights (1/8) undivided interest in said lands, but sometime about the year 1893 (02 Sep. 1892, WD Bk 1, Pg 3 & 4) sold and conveyed to Respondent Peter W. SARRETT his said interest. But, he is now the owner by purchase and decree of this Court at the October Term 1897 (26 Oct. 1897, Court Minutes, Bk. D, Pg. 379) of a one eight (1/8) undivided interest in said land, it being the share, owned by said John H. SARRETT. Said lands are now owned and held by the following parties as tenants in common, The "Homestead and Dower" tracts subject to the life estate of said widow; J. C. SARRETT 1/8; P. W. SARRETT 2/8; Hugh SARRETT 1/8; Bettie SARRETT 1/8; Enoch SARRETT 1/8; Dora SARRETT 1/8 and George SARRETT 1/8. Complaint owns that said land are so situated that they cAnnot be divided in kind among the present owners, thereof to advantage, but if will be to the manifest interest and for the best advantages of all said owners that said land be sold for partition among them. Said land is mostly upland, broken, parts of it not well watered and some of it with but little or no timber one it. Therefore in consideration of the premises, Complaint prays that those mentioned in the Caption hereof as debts, be made such by due service of process for residents and by order of publication for non-residents, that they be required to answer this Bill fully and truly but answer under oath is waved as to the adults; that said lands be sold for partition among the respective owners under proper decree of this Court on such terms as will be equitable and fair. LOVE, Clerk and Master as aforesaid, doth by these presents sell convey and transfer unto the said Peter W. SERRETT, his heirs and assigns the above described premises and all the right, title, interest and claim of all the parties to the said Suit in and to the same. SARRETT This cause being reached upon the regular call of the Docket came to be heard before the Honorable HAL H. HAYNES, Chancellor upon the entire record and argument of Counsel from all which the Court is of opinion that complainants Martha A. SARRETT and Dora SARRETT are not entitled to the relief sought for reasons set out in a written opinion filed, by the Court and ordered to be made a part of the record and Certified as such by the Clerk & Masters in case of an appeal on writ of error. It is therefore Ordered, Adjudged, and Decreed by the Court that complainants Bill be dismissed. Complainant Dora SARRETT and her Sureties on the Original prosecution here towit: Hugh SARRETT, J. Crockett SARRETT, and W. P. WITEHALL will pay One-Third (1/3rd) of the costs of this cause and Complainant Martha A. SARRETT and her Sureties on both Bonds towit: Hugh SARRETT, J. Crockett SARRETT, W. H. DOUGLASS, ROBERT M. DOUGLASS, Bettie R.? DOUGLASS and G. L. ATCHLEY will pay the remaining Two-Thirds (2/3rd) of the cost and instructions will accordingly issue. The solicitation for complainant moved the Court to so amend the pleadings so as to allow recovery and account against defendant (Peter W. Sarrett) for the Taxes on the "Homestead" and "Dower" tracts and the Court being of opinion that such prayer would be in conflict with the original prayer of the Bill as that it could not stand, disallows the amendment, and it is so provided that the dismissal of this suit will not in any mAnner preclude Complainant Martha A. SARRETT from suing for and recovering such taxes. On the trial of this cause the Complainant Martha A. SARRETT introduced as evidence the "Mortality Tables" on page 825 and "Annuity Tables" on page 826 of "Suits in Chancery" by GIBSON and DAVE will be included in the manuscript in case of appeal on the Original. May be used from the book, the same being a part of the evidence in the case. The Complainant made exceptions to certain evidence in the case which, with the Courts rulings thereon are filed in the cause and is made a part of the record and be included in the manuscript. From the foregoing Decree Complainants pray an appeal to the next Term of the Supreme Court which is granted upon Complainants executing prosecution Appeal Bond on otherwise complying with the law and 30 days from the rise of this Court is allowed by consent in which to perfect the appeal.

The present (1985) owners and directors are Jim, Albert, Harold, and Blane Atchley. The Atchley Funeral Home has been in business since 1920. Martha Ann (ATCHLEY) SARRETT was one of our strong pioneers that has made this country as strong as it is today. Born in the Sevier County, matured to adulthood during the hardships of the times. Married after the tremor of the War between the states, losing her husband at an early age, lost three of her children before her death, losing two at a young age after her death. The love and regard of her remaining children and appreciation of her neighbors and friends, testified to the high esteem in which she was held...prs Martha Ann (ATCHLEY) SARRETT - WILL Her Will Probated 20th. Dec. 1931 (14 days after her death). Martha A. (ATCHLEY) SARRETT, wrote a "hand written" Will and Testament, dated 25 Nov. 1927, (4 years and 20 days before her death) which is on file at the Sevier Count Court Records, Will Book No. 3, on pages 294 and 295. The "Original" Will is in the possession of 58. Mrs. NANA "Marie" (MATTHEWS) OTTINGER; Researcher and Granddaughter of Martha A. (ATCHLEY) SARRETT; She lives at 4916 Macmont Circle, Powell (Knox Co.) Tenn. 37849. LAST WILL of Martha A. SARRETT I Martha A. SARRETT, of Sevierville, Tenn. Route No. 2. do make and publish this my last will and testament hereby revoking and making void any and all other wills be me at anytime heretofore made. FIRSTLY, It is my will and I hereby bequest and desire to my son P. W. SARRETT and my daughter BETTY DOUGLASS all my estate and personal property of every kind and character and wherever situated. I make this desire to these in due consideration of the care an nursing and comfort they have given me for a considerable time in my old age and sickness. SECONDLY, It is my will and I hereby direct that out of the estate here devised to my said son and daughter they shall pay my debts and funeral expense and place at my grave suitable monument or tombstones - such as they may desire proper for my station in life. THIRDLY, I hereby appoint my son P. W. SARRETT Executor of this my last will and having full confidence in his integrity I excuse him from giving bond or otherwise qualifying as such Executor. RECTOR, County Court Clerk REMEMBRANCE OF Martha Ann (ATCHLEY) SARRETT The following was copied from JEAN ATCHLEY (GRAHAM) BROWN, of Englewood, Co., Page 6, Date Unknown:28 Martha Ann (ATCHLEY) SARRETT (1848-1931) AnnA MAY DOUGLAS states "I am the GrandDaughter of "Martha Ann (ATCHLEY) SARRETT", my GrandFather ROBERT SMITH ATCHLEY's was a half-brother, of Martha A. (ATCHLEY) SARRETT who was living with her daughter, Mrs. ELIZABETH (SARRETT) DOUGLAS, who was my (AnnA MAY' DOUGLAS) Mother. At that time a son, (This writers GrandFather) Hugh SARRETT, was living in Kansas City. What Aunt Martha Ann (ATCHLEY) SARRETT told me about her life was somewhat as follows: "My Grandfather was THOMAS ATCHLEY. ISAAC was my father. My father had three great big well-built log houses, as nice as any. My brother ROBERT had a big two-story log house. In those early days, each helped the other. All helped one and we had good times. When a man wanted to build a house or a barn, or to clear a field, on the day appointed the men came and had a "log- rolling." The women got meals and had "quilting bees." The young folks had good times, too. Indoor parties, out-of-door fun and games. In the springtime, trips into the beautiful rhododendron-covered hills where dogwood bushes and many other lovely wild flowers bloomed. In the fall we had nut-gathering parties. Wild grapes were plentiful. Sometimes they had "corn-shuckings" at the different homes, and "pea-hullings." Those were good times as well as busy times. Each helped the other. All helped by bearing one another's burdens in those days. Shoes where scarce, and we valued them. Sometimes in the summer, young folks would carry their new shoes as far as the branch near the church, then wash their feet and put on their shoes to go into the Church."
