 Possible Record Problem!
 What is the "Middle" name of Samuel H. SARRETT?
 No where in the some 147 Source Documents was ever his middle name was spelled out only "H." was used.
It has been told, to this writer, by his mysteries Grandfather, the 5th Son Hugh SARRETT, that he was named after his father's middle name Samuel "Hugh" SARRETT, but, in 1980 when I first met "Marie" (MATTHEW) OTTINGER [REF:#58], she believes his middle name was Samuel "Henderson" SARRETT. No official Court Documents have been found other than the "H." ..prsjr

In the [REF:#22] 1850 Census F.G. 614 we find little Samuel H. SARRETT at 4 years of age, living with his parents and some of the surrounding farm children were: RACHEL ATCHLEY age 7, ELIZABETH ATCHLEY age 6, and ROBERT ATCHLEY age 2,

These were the children of the (F.G. 612) Rev. ROBERT S. ATCHLEY & his first Wife LOUISA E. (CLARK) ATCHLEY Later he married his Niece Martha Ann (ATCHLEY) ATCHLEY, F.G. 613) John & Martha LEWALLEN, children WILLIAM age 2, and HILDA age 6 months. The ATCHLEY & SARAH HAGGARD's children WILLIAM age 17, ATCHLEY, Jr. age 6, John age 2, and LOUISA 5 months.

Samuel H. SARRETT's early life was spent in securing the rudiments of an education, and in his "teens" he learned the "farmers" way of life in the Sevier County, TN. area from his father. In the [REF: #23 1860 Census for Sevier Co., TN. he was 14 years of age "Attending School" and helping his father work the farm.

THE CIVIL WAR 1861-1865 2 years later, at an young age of 16 years, on 08th. March 1862, he left his fathers farm and joined the Federal (Union) Company "B", 6th. Reg't. Inf., East Tenn. Volunteers to fight in the "Civil War"; Was Captured by the Confederates when he was 17 years on 19 Jan. 1864 and placed in the most feared prison in the Civil War "Andersonville", where he remained some two years (released 24 Feb. 1865 and which latter was one of his cause of death. His father James D. SARRETT, was captured by the Confederate forces on or around the 25th. of Feb. 1864, at his home on Kellums Creek, Sevier Co., TN; He died in Andersonville Prison on or about the 4th. of Sep. 1864; The son Samuel H. SARRETT, survived Andersonville and returned home in July of 1865.

Samuel H. SARRETT, was still in Andersonville Prison, when his Step-brother EZEKIEL L. HAGGARD, filed his Administrator's and Executors Bond, over the JAMES D. SARRETT, dec'd Estate on 01st May 1865, also when the Estate Sale was conducted on the 26th. of May 1865.

Their is a record, that on 22 Aug. 1865, EZEKIEL L. HAGGARD, Admin. paid Samuel H. SARRETT, $20, for a "Proven Account dated 22 Aug. 1865" (Settlement, 12 Dec. 1865, Page 177)

Samuel H. SARRETT MARRIES Some four months after he returned from the Andersonville Prison in Georgia, the 19 year old Samuel H. SARRETT, was [REF: #35married on the 14th of Nov. 1865, Catlettsburg, TN. Officialated by the Justice of the Peace JESSIE HILL, of Seviervillee, TN. to the 17 years old Miss Martha Ann ATCHLEY, b. 21 Jun. 1848, near Catlettsburg, Sevier County, TN. d. 15 Dec. 1931, at the age of 83 years, 5 months and 24 days, both are buried in the Alder Branch Cemetery, Sevier Co., TN. She was the 8th born, 5th daughter of ISAAC ATCHLEY and his 2nd. Wife MARY (BOWERS) ATCHLEY, who had a farm near JAMES D. & FRANCIS "FAnnie" (WATERS) SARRETT where both families children were raised together.

The Chancery Court of Sevier County, Decreed and appointed FRANCIS (WATERS) HAGGARD SARRETT, at the Guardian to the Minor Heirs of JAMES D. SARRETT, dec'd on 02nd. Oct. 1865, Son Samuel H. SARRETT, was married and 19 years of age. (Court Minutes, Book 1862-67, Page 218, Monday 02 Oct. 1865

On 01 Nov. 1865, the EZEKIEL L. HAGGARD, Admin., filed with the County Court, a Petition to Sell the Kellum Creek, property.

A Deed was prepared on 20 Nov. 1865, 62 by the Widowed Mother FRANCIS (WATERS) HAGGARD SARRETT, to Son Samuel H. SARRETT, for $500.00, of 100 acres of his fathers Kellum Creek property, although this deed was never registered.

On Dec. 04 1865, the Court Decreed to "Bid the Land" at the Court House door, with a $25 deposit and a 12 months Lien on the property, until its paid. On the 26th. of Dec. son Samuel H. SARRETT, was the highest "of $200" for this same property. On 21 Jan. 1866, 63 Samuel H. SARRETT, paid his sister NANCY A. SARRETT, $85.00 for her interestthe same two 50 acre tracts, plus the 100 acres of his fathers original "Land Grant of 1851" property.

In the 24 1870 Census, taken on the 20th Aug. 1870, for the District No. 7, (Sevierville/Flat Creek Section) Sevier, Co., Tennessee, Post Office "Fair Garden" we find Samuel H. (age 24) and Martha A. (ATCHLEY) SARRETT (age 22) living in the "Big House" on the same farm his father had for so many years. The Real Estate Value was listed as $2,000 with $972 personal value. Their neighbors to the north were the young 22 yrs. old "Farm Hand" JAMES HUSTON of Georgia, and his wife ELIZABETH.
Samuel H. & Martha (ATCHLEY) SARRETT'S oldest daughter MARY F. SARRETT, who would have been 4 years old, had died at birth 22 Sep. 1866, was NOT listed. Their 2nd child and 1st. son was WILLIAM A. SARRETT, born 1867, d. 1868 and was Not listed in this Census. ..prs

On 22 Jul. 1882, Samuel H. SARRETT, at 37 years of age, appeared before the County Clerk, of Sevier Co. of the "Chancery Court of Record" to file a "Declaration for an Original Invalid Pension" application, for his Civil War services. He signed this application "S. H. SARRETT". He also had two witness with by the name of M. E. LRVE? and D. STOFFORD. [REF: #32] DECLARATION FOR AN

Personally appeared before me Clerk, of the Chancery Court of Record within and for the County and State aforesaid Samuel H. SARRETT, age 36 years, according to law, declares that he is the identical Samuel H. SARRETT, who was enrolled in "B" Co., of the 6th. Regiment of the Tenn. Infantry Vol. Commanded by Captain John M. ARMSTRONG. description as follows: Age 36 years (height, complection, hair and eyes was NOT marked) "That while a member of the organization aforesaid, in the service and in the line of duty at BELLE ISLAND in the State of Virginia on or about the 2nd. of February 1864 he contracted "NEURALGIA" (Severe sharp pain along the course of a nerve prs) of the head and shoulders which blind him. The cause of this by exposure and treatment he experienced in prison and aggravated in character by subsequent exposure in prisons at Andersonville, Georgia; and Florence, South Carolina. By reason of said diseases with which he had continually suffered more or less since occurrence he is disabled for manual labor."

That since leaving the service this applicant has resided in Sevier County, in the State of Tennessee and his occupation has been that of a Farmer. That prior to his entry into the service above named he was a man of good, sound, physical health. That he is now Seriously disabled from obtaining his subsistence by manual labor, by reason of his injuries above described, received in the service of United States, and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. Their is a record dated 31 Oct. 1882, from John O. ATCHLEY and Isaac A. ATCHLEY both of "Cove Springs", Greene County, Missouri, filed an "General Affidavit for any Purpose" which they swore ...they were acquainted with Samuel H. SARRETT, and new him before the War and since then, up to 1878....They lived near to him, from youth and up to the year 1878 when they removed to Greene Co., Mo., and were very often together..." No record found that Samuel H. SARRETT, was ever granted a "Disability Pension", their is a document dated 22 Oct. 1883, from the WAR DEPARTMENT, Adjutant General's Office, Washington D.C. to the "Commissioners of Pensions" Which listed his military service and stated he was "Captured on 19 Jan. 1864, near Strawberry Plains, TN. while he was "Absent with-out leave." They gave "No evidence of disability alleged". [REF: #34 On 3rd. Jul. 1883, Court Minutes, list that "It is ordered by the Court that Samuel H. SARRETT, be appointed as Overseer of the road, beginning near E. H. ROBERTS, property and intersect the Bryant Fery Road, near J. R. LECK's property; and he (Samuel H. SARRETT) required to keep the same in lawful repair as a 3rd. Class Road, with the hands on the farms of Samuel H. SASETT; JAMES ELLIS; GIEDON Mc MAPLES; Wm. D. ATCHLEY; G. A. ATCHLEY; and Wm. C. MURPHY'S farm where C. A. MURPHY lives. It is ordered by the Court that Samuel LEETH, be released from working on Public Road, on account of disability. (Sevier Co., TN. Record Book 4, Page 384

 Samuel H. SARRETT's Death:
 Grandpa Samuel H. SARRETT was a sickly man ever since he returned from prison at Andersonville, during the Civil War and he never recovered from the scars of War, and no record found he ever was compensated from his Government. He died on May 13, 1890 at the age of 44 years, 1 month, and 9 days. He died "Intestate", (No Will provided ..prs) Samuel H. SARRETT was truly a man of substantial character, and was honorable in all of his dealings with the entire community. He is buried at the ALDER BRANCH Cemetery in Sevierville, just off State Highway 66, between Catlettsburg, and Sevierville, Tennessee.

  Samuel H. Sarrett, 44, local farmer, Civil War Veteran, died here on 13 May, 1890. He was born in Sevier County, and spent his entire life here in the area. He was born to James D. Sarrett, who preceded him. His mother Francis (Waters) Sarrett, remains at 68 years of age in Sevierville, Tn. He leaves his wife Martha A. (Atchley) Sarrett, of Sevierville, two of his children precede him, Mary and William. He is survived by his wife & eight children: James C., Peter W., John H., Hugh E., Mary E. "Bettie" , I. On the 7th of Jun. 1890, the Court decreed to Mrs. Samuel H. (ATCHLEY) SARRETT, a sum of $300, for her "years support" ....after having gone upon the premises of deceased; and after having been sworn, preceded to set aside and designate said support as follows: "Said family consists of said Widow and seven children and we regard an allowance of ($300) Three Hundred Dollars as a reasonable allowance and there being no Wheat, Corn or other grain, no Bacon, No Stock-hogs, nor any other provisions on hand, except what we allowed her, by the exemption laws and no money on hand." We therefore set apart to said Widow to her exclusive use with which to procure her support for the year, the following property to wit: 1.) Eleven head of young Cattle. 6, 2 year olds & 5 Yearlings, worth about $175.00) 2.) One Bay Mule. 1 years old past, worth about $ 65.00) 3.) One Gray Mare. (About 7 years old, worth about $ 60.00)

Based on this Inventory of the Estate Samuel H. SARRETT, dec'd had an Accounts Receivable due him of $1,726.42 with an Account Payable of $137.82, being a balance of $1,588.60 for the Estate..prs [CHANCERY COURT MINUTES; SEVIER COUNTY, TENNESSEE; Record Book Page 416, 417; July 10, 1890]

4 months after her husbands death, on 12 Aug. 1890, Martha A. (ATCHLEY) SARRETT appeared before the Sevier County Clerk and filed an "Declaration for Widow's Pension" [REF: #35 She listed the following children who are under 16 years of age, and now are living with her with "no means of support" (ages are based on application date) Hugh E. SARRETT, age 16 yrs., 8 mth. 19 days, b. 23 Nov. 1874 MALISA E. SARRETT, age 13 yrs., 5 mth. 23 days, b. 19 Feb. 1877 ISAAC E. The [REF: #26 11th. Census 1890, were destroyed by fire in the Commerce Dept. Building in Jan. 1921. Their is a "Special Schedules" of the 11th. Census - 1890. This has records Enumerating Union Veterans and Widows of Union Veterans of the Civil War. Martha A. (ATCHLEY) SARRETT, was listed in this "Special Census" as "Widow of Samuel H. SARRETT" it list's "Pvt. "B" Company, 8th. Inf., Enlisted Date March 1862; Date of Discharge Jul. 1865.

On 29 Jun. 1892, WILLIAM D. ATCHLEY, [REF: #36 appeared before the Clerk & Master, of the County of Sevier, Tenn. and filed an "Sworn Statement" regarding his Cousin (William D. Atchley's father William R. Atchley was Martha A. (Atchley) Sarrett's Half-Brother) Martha A. (ATCHLEY) SARRETT, application of "Civil War Widows Pension". makes oath in relation to the said claimant as follows: .....I am 54 years old, I knew Samuel H. SARRETT from boyhood, until his death. I lived near him.... I Served in the Army with him and in the same Regitment and Company. Was with him all the time except about 18 months that the soldier was in prison. I am well acquainted with Martha A. SARRETT, she has not married since the death of husband S. H. SARRETT. My Post Office is "Cattelsburg, Tenn. I have no interest in the prosecution of this claim.... He signed his name WILLIAM D. ATCHLEY, no witness to this statement. Recorded by A. L . MARSHALL, Clerk & Master.

On 29 Jun. 1892, GIDEON M. MAPLES, [REF: #37 appeared before the Clerk & Master, of the County of Sevier, Tenn. and filed an "Sworn Statement" regarding his sister-in-law Martha A. (ATCHLEY) SARRETT, Gideon Mc. Maples, was married as his 2nd. wife to Malissa C. (Atchley) Maples, sister of Martha A. (Atchley) Sarrett application of "Civil War Widows Pension". makes oath in relation to the said claimant as follows: ....I am 68 years old, I knew Samuel H. SARRETT from boyhood, until his death. I lived adjoining farm to him....I am well acquainted with Martha A. SARRETT, she has not married since the death of husband S. H. SARRETT. My Post Office is "Gattelsburg, Tenn. I have no interest in the prosecution of this claim.... He signed his name G. M. MAPLES, no witness to this statement.

On 16th of Jan. 1893, widow Martha A. SARRETT, Peter W. SARRETT, WILLIAM P. ATCHLEY, R. "Chresty" SIMS and are held and firmly bound to the State of Tennessee, in the sum of One Thousand Dollars [$1,000]. The Condition of this Obligation is such, That whereas the above bound Martha A. SARRETT has been appointed Guardian of 1 John SARRETT, 2 Hugh SARRETT, 3 Bettie SARRETT, 4 Enoch SARRETT, 5 Dora SARRETT, and 6 George SARRETT minor heir of Samuel H. SARRETT, deceased. LS/ Martha A. On 16th of Jan. 1893 of the Chancery Court of Sevier County, Tenn. the widow Martha A. (ATCHLEY) SARRETT, filed a Petition for the Court to decree a "Homestead and Dower", from the late Samuel H. SARRETT, dec'd Estate. A "Bill" was filed by her son JAMES C. SARRETT for a equal share of this same Estate. The Court Commissioned JESSIE ATCHLEY, Surveyor to survey and set apart a "Homestead and Dower" for the Widowed Martha A. ATCHLEY of the estate of Samuel H. SARRETT, dec'd. .....This cause came upon the Court this 16th day of January 1893, before the worshipful County Court, of Sevier County, on the Petition of Martha A. (ATCHLEY) SARRETT and noted served on debts which appears from the letters thereof on file is to be more than five days since the application of Petition was made; from which it appears that, Petitioner is the legal widow of Samuel H. SARRETT dec'd and as such is entitled to a "Homestead and Dower" out of the land of which her husband was seized and possessed at the date of his death which were three tracts of land located in the 7th Civil District of Sevier County Tennessee, as follows:

TRACT I A tract of land known as the "Home Farm" where deceased died and where petitioner now resides adjoining lands of ANDREW HENDERSON and WILLIAM P. ATCHLEY on the East, GIDEON MAPLES, A. J. KYKER, and HOUS ROBERTS, on the South and South West and the French Broad River on the North; Containing 156 acres more or less.

TRACT II A tract of land known as the Entry, adjoining land of THOMAS LOWE on the North; JOSEPH ATCHLEY on the North and East; ROBERT PARKER and MARY ROIMNES? on the South; On the West by said ROBERT PARKER and HOUS ROBERTS containing 61 acres more or less.

TRACT III A tract known as the Kehm Creek Farm Where FRANK HANCOCK now lives; adjoining lands of on the North. Samuel HUFFAKER, R. "Chresty" SIMS, WILLIAM D. ATCHLEY HOUS ROBERTS On the East by ROBERT PARKER; On the South by John TYSON and WILLIAM A. BIRD; On the West by JAMES MAPLES and the ANDES boys containing 217 acres more or less.

The Court there upon motion of Petitioner by Atty. is pleased to appoint W. S. TRUNDLE, Surveyor; J. A. HOUSHOLDEU?, & R. C. SIMS all citizens and residents of Sevier County, unconnected to the parties in interest and otherwise qualified as Commissioners, who shall go upon the premises aforesaid and assign said Petitioner, First: a "Homestead" to the value of One Thousand Dollars [$1,000] Second: a One third (1/3) part in value of the remainder as a "Dower." Said Commissioners will make their report in writing and show the lands so assigned by maps and plots. They will make their report as early as convenient to the Court. On 21st. Feb. 1893, the Surveyer, JESSE ATCHLEY [REF: #64 submitted to the Court. ....We your Commissioners appointed at the January term of your Court. Make the following report. We went upon the land of Samuel H. SERRETT, dec'd and after being sworn proceeded to set apart to Martha A. SERRETT, widow of said S. H. SERRETT, dec'd a Homestead as follows:

(HOMESTEAD TRACT) 156 Acres Beginning on a Stake in line of ANDREW HENDERSON next to old SARRETT line and a Corner to HOUS ROBERTS line. We set a part a DOWER the following described tracts, One (1) and Two (2) as shown on the plat. (DOWER FIRST TRACT) ___ Acres Beginning on a Stake in line of ANDREW J. KYKER'S,, property, adjoining the bank of (Kellums) river, thence up the same North to a Creek at Mouth of Ditch, then up said Creek. (DOWER SECOND TRACT) 61 Acres Beginning on HUFF'S line. SARRETT, Civil War Widows Pension. MELISSA C. (ATCHLEY) MAPLES, stated she was 54 years old, lived "Cattetts Burgh", Tenn. She swore .... she "was very well personally acquainted with the claimant and her husband from childhood and to the present time. I was present and witnessed the births of the following children, ISAAC Enoch SARRETT, b. 1879, RACHEL Dora SARRETT, b. 1885, and Samuel George SARRETT, b. 1887. On 6th of March, 1893, the Court "Decreed" .... This cause came on to be furthers heard before the worshipful County Court on this 06th day of March, 1893 upon the Petitioners Application for "Homestead and Dower". And said "Report" being unaccepted to, is in all things confirmed. It is therefore ordered adjudged and decreed that the forgoing describes tracts of land included in said plots and set apart to petitioner as "Homestead and Dower", be and the same is hereby vested in her as a life estate, to used by her for her own use and that of her children, who may make their home with her and at the death of said "Petitioner" the life tenant in said land shall vest in those entitled thereto under the laws of this State. It appears that JESSE ATCHLEY acted as Surveyor instead of W. S. TRUNDLE named in the order of Appointment (16 Jan. 1893), he being sick and unable to serve, And any and all objections to said JESSE ATCHLEY serving as such is expressly waived by the parties. On 17 May, 1893, FRANCIS "FAnnie" (WATERS) HAGGARD SARRETT, [REF: #39 made an "Sworn Statement" regarding the application of her Daughter-in-law Martha A. (ATCHLEY) SARRETT's husband (her Son) Samuel H. SARRETT, Civil War Widows Pension. stated .... she was 81 years old, lived "Cattetts Burgh", Tenn. she "was very well personally acquainted with the claimant and her husband from childhood and to the present time. I was present and witnessed the births of the following children, Hugh E. SARRETT, b. 1874, <--- My Grand-Father! ISAAC Enoch SARRETT, b. 1879, RACHEL Dora SARRETT, b. 1885, and Samuel George SARRETT, b. 1887. I know the above dates are correct because personally was present when they were born and assisted the Doctor at the births of said children except the last two named, I saw them very soon after their birth, and saw the claimant nurse them. I have got no interest in the prosecution of this claim.... She signed her name with a "X" (which is another indication she could not read or write.) SARRETT, Civil War Widows Pension. stated. .... she was 44 years old, lived "Cattetts Burgh", Tenn. she as very well personally acquainted with the claimant and her husband from childhood and to the present time. I was present and witnessed the births of the following children, ISAAC Enoch SARRETT, b. 1879, RACHEL Dora SARRETT, b. 1885, and Samuel George SARRETT, b. 1887. I know the above dates are correct because personally present when they were born and assisted the Doctor at the births of said children and I have lived in the same neighborhood with claimant and her family for the last 35 years past. On 17 May, 1893, Mr. R. "Chresty" SIMS, [RES: #41 neighbor and good friend, made an "Sworn Statement" regarding the application of Martha A. (ATCHLEY) SARRETT's husband Samuel H. SARRETT, Civil War Widows Pension. he stated. ... he was 51 years old, lived "Cattetts Burgh", Tenn. He was acquainted with the claimant and her husband for about 14 or 15 years and to the present time. I from personal knowledge that the following children, Hugh E. SARRETT, b. 1874, <--- My Grandfather prs ISAAC Enoch SARRETT, b. 1879, RACHEL Dora SARRETT, b. 1885, and Samuel George SARRETT, b. 1887, are still living. I know the above is correct because I have lived within one mile of the Soldier and the claimant for about 14 or 15 years and during that time worked on the farm for and with the Soldier for about 4 years, until his death..... SARRETT, etal Defendant, the Court Ordered ....This cause came on to be heard on this 29th day of April, 1897 before Honorable H. B. LINDSAY, Chancellor, on the Bill of Complaint and the *Demurren filled thereto by respts and the Court is of the opinion that the first ground of Demurren assigned in each of said separate Demurrens is well taken and sustains the same, the Court construing said assignment of personality in the Exhibit to the Original Bill as a Mortgage and NOT as an absolute sale. The other grounds of said Demurrens the Court adjudges as not well taken and over rules the same. Thereupon motion of Complaint by his Counsel he is allowed to amend his Bill by making John H. PENLAND, this day presented his petition with the Exhibit thereto to the Court praying that the interests in the lands sold in this cause for $250 to Peter W. SARRETT and reported by the masters to this Term, be set aside and the Biddings on said interest in said land be opened and duly appearing from said petition and exhibit thereto that J. Crockett SARRETT has filed a written offer to Bid $275 on said 1/8th interest in said tracts of land and that he has tendered good and sufficient security for his bid, and it also duly appearing that due notice has been given to said Peter W. SARRETT that said petition would this day be presented to the Court for his action thereon. Therefore in consideration of the premises, it is ordered by the Court that the said sale to Peter W. SARRETT, be set aside and the biddings on said interest (being a 1/8th undivided interest) in said land be opened and kept open until 1 o'clock, P.M. on the 26th. day of October, 1897, until which time he will receive bids on said interest in said lands on the terms prescribed in the Decree of Sale, beginning with the said bid of J. SARRETT, etal This cause came on to be further heard on this 26th day of October, 1897, before Honorable H. B. LINDSAY, Chancellor, upon the Bill and Exhibits thereto and the entire record in the cause and particularly upon the Masters report of sale made to the present Term under decree entered at the present Term ordering the Biddings to be opened on said land sold in this cause, which report is in the words and figures following towit: In Chancery Court, Sevierville, Tennessee. In this cause the undersigned respectfully reports the he, pursuant to an order made herein on the 25th day of October, 1897, opening the biddings upon the property sold herein on the 2nd day of August 1897 and directed same to stand open until Tuesday the 26th day of October 1897 at 1 o'clock P.M., kept open the biddings until the time directed, when they were closed and J. Crockett SARRETT being the highest, best and last bidder became the purchaser of a one eight (1/8th) undivided interest in the following tracts of land lying in the 7th. Civil District of Sevier County, Tennessee towit: One tract lying in the 7th. Civil District of Sevier County, Tenn., on Kellains Creek containing near 200 acres more or less and adjoining lands of BIRD, TYSON? and others. It is therefore Ordered, Adjudged and Decreed that all the right, title and interest that the respt. John H. SARRETT has in and to the lands herein sold, be devisted and out of him vested in said J. Crockett SARRETT in fee, subject only to the purchase money lien retained thereon. And it further appearing that the said J. Crockett SARRETT, the purchaser, hereto fore recovered judgment in this cause against the defendant John H. SARRETT in the sum of $770.38 and costs and that the amount of the purchase price of said land after deducting costs will be due said purchaser, the Masters will collect a sufficient amount only to pay costs and the balance he will apply as a credit on said judgment, and to the cancellation of his purchase money note given in this cause. Your Complaint would respectfully show to the Hon. Court that Samuel H. SARRETT died "Intestate" (Not having provide a Will) in Sevier County, Tenn., or on about the 13th day of May 1890, leaving Respondent Martha A. (ATCHLEY) SARRETT, as his widow and the following children as his only heirs at law, to wit: (1) Complaint; J. C. SARRETT (2) P. W. SARRETT; (3) John H. SARRETT; (4) Hugh SARRETT; (5) Bettie SARRETT; (6) Enoch SARRETT; (7) Dora SARRETT; (8) George SARRETT; The last five are minors with Respondent ANDREW J. KYKER as their regular Guardian. Complaint was duly appointed and qualified as the Administer of said deceased and collected and paid off all the indebtedness of said estate. There was more than enough personal property to pay all debts and expenses of Administer. At the date of said Samuel H. SARRETT'S death he was owner in fee of certain valuable real estate located in the 7th Civil District of Sevier County, Tenn. It lay in two bodies, the first known as the "House Tract" on which he lived containing 175 acres more or less. The Second known as the "Creek Farm" and contains 200 acres more or less.

All of said land descended to said children and heirs at the death of said Samuel H. SARRETT Out of the First or "House Tract", Homestead and Dower was duly assigned to Respected Martha A. SARRETT by Commissioners appointed by the County Court of Sevier County. Said Homestead Tract is described as follows:

Said Widow now lives on and occupies said "Homestead & Dower" Tracts. There are about 50 acres of said "House Tract" not included in said "Homestead & Dower" Tracts all of which is cleared and in cultivation. It adjoins said "Homestead & Dower" Tracts, the lands of ANDREW HENDERSON and ANDREW J. KYKER and full and specific description will be furnished on the hearing if required.

The said Creek Farm, adjoins the lands of J. E. TYSON; Samuel HUFFAKER; JAMES MAPLES; R. Chresty SIMS; R. E. PARKER and perhaps others and contains about 200 acres, about half being cleared and in cultivation.

Complaint inherited one eights (1/8) undivided interest in said lands, but sometime about the year 1893 (02 Sep. 1892, WD Bk 1, Pg 3 & 4) sold and conveyed to Respondent Peter W. SARRETT his said interest. But, he is now the owner by purchase and decree of this Court at the October Term 1897 (26 Oct. 1897, Court Minutes, Bk. D, Pg. 379) of a one eight (1/8) undivided interest in said land, it being the share, owned by said John H. SARRETT. Said lands are now owned and held by the following parties as tenants in common, The "Homestead and Dower" tracts subject to the life estate of said widow; J. C. SARRETT 1/8; P. W. SARRETT 2/8; Hugh SARRETT 1/8; Bettie SARRETT 1/8; Enoch SARRETT 1/8; Dora SARRETT 1/8 and George SARRETT 1/8.

Complaint owns that said land are so situated that they cAnnot be divided in kind among the present owners, thereof to advantage, but if will be to the manifest interest and for the best advantages of all said owners that said land be sold for partition among them. Said land is mostly upland, broken, parts of it not well watered and some of it with but little or no timber one it.

Therefore in consideration of the premises, Complaint prays that those mentioned in the Caption hereof as debts, be made such by due service of process for residents and by order of publication for non-residents, that they be required to answer this Bill fully and truly but answer under oath is waved as to the adults; that said lands be sold for partition among the respective owners under proper decree of this Court on such terms as will be equitable and fair.   This cause came to be heard before the Honorable John P. SMITH, Chancellor on the 24th day of April, 1900, upon the record in the cause and especially upon the report of the Masters on file, which report is as follows: Report of Clerk and Masters on order of reference in obedience to an order made and entered in above styled cause at the October term 1898 regarding me to hear proof and report on what amount is yet due to Peter W. SARRETT from ROBERT A. LOWE on purchase price of land sold by said SARRETT to said LOWE as shown by notes and Deed executed, I report the following:

  I. There is due on Three Notes for $100.00, $125.00 and $125.00 due respectively Jan. 01, 1898, Jan. 01, 1899 and Jan. 01 1900 computing interest at Annual rests to April 23, 1900 (After allowing a credit of $10.00 Jan. 10, 1898 and $18.34 March 10, 1898) the sum of $380.57.
  II. There are Two Notes for $150.00 each which are not due until Jan. 01, 1901 and Jan. 01, 1902, respectively, but the said Notes with interest computed on same at Annual rests up to April 23, 1900. Amounts to $373.08. Adding the amounts of the Three Notes past due, towit $380.52 to the amount of the Two Notes not yet due, towit $373.08, it makes the Five Notes given for said land amount to the sum of $753.60, computing interest at Annual rests up to April 23, 1900, it being the first day of the next Term of the Chancery Court. All of which is respectfully submitted to the Court April 16, 1900.

LOWE, the Clerk and Master will pay same to Peter W. SARRETT on the purchase price of the interest sold to said LOWE by said SARRETT. It appearing that the funds to come into Court due to respondent ROBERT A. LOWE will not be sufficient to discharge his obligations to Peter W. SARRETT, the Masters will pay off the Two Notes, not due, as soon as funds sufficient are in his hands after paying the Two Note past and costs will be paid as heretofore adjudged. Crockett SARRETT which is in the words and figures following towit: This indenture this by Masters that Enoch SARRETT, of Coleman County, Texas and J. Crockett SARRETT of Knoxville, Tennessee, witness that said Enoch I. SARRETT has this day sold and assigned and does hereby sell and assign unto said J. Crockett SARRETT all of his share of interest in the proceeds of the lands of Samuel H. SARRETT, deceased, which were heretofore sold under the Order of the Chancery Court of Sevier County at Sevierville, Tennessee in the cause of J. Crockett SARRETT Vs. Martha A. SARRETT, etal his share being an undivided One Eight (1/8th) interest of said proceeds, is an heir of said Samuel H. SARRETT, deceased. The said Enoch I. SARRETT, has hereby constitute and appoint said J. Whereas the Clerk and Masters of said Court after first compiled with the provisions of said decree and advertised according to law, proceeded on the 18th Day of July, 1898 to sell said before described premises, and at said sale, P. W. SERRETT, became the purchaser of said premises at and for the sum of Twelve Hundred and Sixty-Five Dollars ($1,265.00), and whereas the Clerk and Masters reported said sale to said Court. Which report of sale was by said court at the October Term 1898, thereof in all things confirmed and the Title (Can NOT reed the last line, this last line of page 2 did not Copy..prs) issued out of the parts to the suit, and vested in said purchaser, Peter W. SERRETT, and the Clerk and Master directed to execute to the said purchaser a "Deed" for the same.

Now, Therefore, in Consideration of the purchase and further consideration of Two Dollars ($2.00), all of which has been fully paid, the said A. H. LOVE, Clerk and Master as aforesaid, doth by these presents sell convey and transfer unto the said Peter W. SERRETT, his heirs and assigns the above described premises and all the right, title, interest and claim of all the parties to the said Suit in and to the same. To have and hold unto the said Peter W. SERRETT, his heirs and assigns as an inheritance in fee simple; and the said A. H. LOVE, Clerk and Master as aforesaid further convents and agrees with said Peter W. SERRETT, that he will forever warrant and defend the title to said premises unto the said Peter W. SERRETT, his heirs and assigns, against the claims of all parties in as full and ample a mAnner as he, as Clerk and Masters, can or ought to Warrant, the same, but no further or otherwise.

(ATCHLEY) SARRETT, age 31; Sister RACHEL Dora SARRETT age 15; Brother Samuel George age 13; (Samuel George died the next year at the age of 14 years, 0 months, and 8 days.) Widow Martha Ann (ATCHLEY) SARRETT listed as having only 9 children and 3 had died before this 1900 census. (Child d. 1) MARY FAnnY SARRETT, d. 1866, buried in Adler Branch (Child d. 2.) This cause being reached upon the regular call of the Docket came to be heard before the Honorable HAL H. HAYNES, Chancellor upon the entire record and argument of Counsel from all which the Court is of opinion that complainants Martha A. SARRETT and Dora SARRETT are not entitled to the relief sought for reasons set out in a written opinion filed, by the Court and ordered to be made a part of the record and Certified as such by the Clerk & Masters in case of an appeal on writ of error.

It is therefore Ordered, Adjudged, and Decreed by the Court that complainants Bill be dismissed. Complainant Dora SARRETT and her Sureties on the Original prosecution here towit: Hugh SARRETT, J. Crockett SARRETT, and W. P. WITEHALL will pay One-Third (1/3rd) of the costs of this cause and Complainant Martha A. SARRETT and her Sureties on both Bonds towit: Hugh SARRETT, J. Crockett SARRETT, W. H. DOUGLASS, ROBERT M. DOUGLASS, Bettie R.? DOUGLASS and G. L. ATCHLEY will pay the remaining Two-Thirds (2/3rd) of the cost and instructions will accordingly issue. The solicitation for complainant moved the Court to so amend the pleadings so as to allow recovery and account against defendant (Peter W. Sarrett) for the Taxes on the "Homestead" and "Dower" tracts and the Court being of opinion that such prayer would be in conflict with the original prayer of the Bill as that it could not stand, disallows the amendment, and it is so provided that the dismissal of this suit will not in any mAnner preclude Complainant Martha A. SARRETT from suing for and recovering such taxes.

On the trial of this cause the Complainant Martha A. SARRETT introduced as evidence the "Mortality Tables" on page 825 and "Annuity Tables" on page 826 of "Suits in Chancery" by GIBSON and DAVE will be included in the manuscript in case of appeal on the Original. May be used from the book, the same being a part of the evidence in the case. The Complainant made exceptions to certain evidence in the case which, with the Courts rulings thereon are filed in the cause and is made a part of the record and be included in the manuscript.

From the foregoing Decree Complainants pray an appeal to the next Term of the Supreme Court which is granted upon Complainants executing prosecution Appeal Bond on otherwise complying with the law and 30 days from the rise of this Court is allowed by consent in which to perfect the appeal.

And therefore Court adjourned until Court in Course.

Martha Ann (ATCHLEY) SARRETT's death:
Martha Ann (ATCHLEY) SARRETT was a widow for 41 years and lived the rest of her life with various children and Grandchildren in Sevier county. Martha Ann died on December 15, 1931 at the age of 83 years, 5 months, and 24 days, she was laid to rest along side of her husband Samuel H. SARRETT of 35 years in the ALDER BRANCH BAPTIST CEMETERY, Sevierville Tennessee. (To locate the ALDER BRANCH Cemetery from Sevierville; Turn onto State Hwy 66 toward (West) "Douglas Dam" 2.8 Miles. Turn Right, on Alder Branch Road drive 1.7 miles. Turn left .06 miles. the Church and Cemetery are on the right.)

Samuel H. and Martha A. (ATCHLEY) SARRETT were southern BAPTIST of long standing and members at the Alder Branch Baptist Church, located on Alder Branch Road, in Sevierville, Tennessee, 37862 Phone number 615/453-4594.

The Funeral Services was conducted by the ATCHLEY FUNERAL HOME, located at 118 E. Main St., Sevierville, Tennessee 37862 Phone number 615/453-2835. The present (1985) owners and directors are Jim, Albert, Harold, and Blane Atchley. The Atchley Funeral Home has been in business since 1920.

Martha Ann (ATCHLEY) SARRETT was one of our strong pioneers that has made this country as strong as it is today. Born in the Sevier County, matured to adulthood during the hardships of the times. Married after the tremor of the War between the states, losing her husband at an early age, lost three of her children before her death, losing two at a young age after her death. The love and regard of her remaining children and appreciation of her neighbors and friends, testified to the high esteem in which she was held...prs

Martha Ann (ATCHLEY) SARRETT - WILL Her Will Probated 20th. Dec. 1931 (14 days after her death). Martha A. (ATCHLEY) SARRETT, wrote a "hand written" Will and Testament, dated 25 Nov. 1927, (4 years and 20 days before her death) which is on file at the Sevier Count Court Records, Will Book No. 3, on pages 294 and 295. The "Original" Will is in the possession of 58. Mrs. NANA "Marie" (MATTHEWS) OTTINGER; Researcher and Granddaughter of Martha A. (ATCHLEY) SARRETT; She lives at 4916 Macmont Circle, Powell (Knox Co.) Tenn. 37849.

LAST WILL of Martha A. SARRETT I Martha A. SARRETT, of Sevierville, Tenn. Route No. 2. do make and publish this my last will and testament hereby revoking and making void any and all other wills be me at anytime heretofore made. FIRSTLY, It is my will and I hereby bequest and desire to my son P. W. SARRETT and my daughter BETTY DOUGLASS all my estate and personal property of every kind and character and wherever situated. I make this desire to these in due consideration of the care an nursing and comfort they have given me for a considerable time in my old age and sickness. SECONDLY, It is my will and I hereby direct that out of the estate here devised to my said son and daughter they shall pay my debts and funeral expense and place at my grave suitable monument or tombstones - such as they may desire proper for my station in life. THIRDLY, I hereby appoint my son P. W. SARRETT Executor of this my last will and having full confidence in his integrity I excuse him from giving bond or otherwise qualifying as such Executor. REMEMBRANCE OF Martha Ann (ATCHLEY) SARRETT The following was copied from JEAN ATCHLEY (GRAHAM) BROWN, of Englewood, Co., Page 6, Date Unknown:28 Martha Ann (ATCHLEY) SARRETT (1848-1931) AnnA MAY DOUGLAS states "I am the GrandDaughter of "Martha Ann (ATCHLEY) SARRETT", my GrandFather ROBERT SMITH ATCHLEY's was a half-brother, of Martha A. (ATCHLEY) SARRETT who was living with her daughter, Mrs. ELIZABETH (SARRETT) DOUGLAS, who was my (AnnA MAY' DOUGLAS) Mother. At that time a son, (This writers GrandFather) Hugh SARRETT, was living in Kansas City. What Aunt Martha Ann (ATCHLEY) SARRETT told me about her life was somewhat as follows:

"My Grandfather was THOMAS ATCHLEY. ISAAC was my father. My father had three great big well-built log houses, as nice as any. My brother ROBERT had a big two-story log house. In those early days, each helped the other. All helped one and we had good times. When a man wanted to build a house or a barn, or to clear a field, on the day appointed the men came and had a "log- rolling." The women got meals and had "quilting bees." The young folks had good times, too. Indoor parties, out-of-door fun and games. In the springtime, trips into the beautiful rhododendron-covered hills where dogwood bushes and many other lovely wild flowers bloomed. In the fall we had nut-gathering parties. Wild grapes were plentiful. Sometimes they had "corn-shuckings" at the different homes, and "pea-hullings." Those were good times as well as busy times. Each helped the other. All helped by bearing one another's burdens in those days. Shoes where scarce, and we valued them. Sometimes in the summer, young folks would carry their new shoes as far as the branch near the church, then wash their feet and put on their shoes to go into the Church."
