James and Julia Ann Durham's birth and death dates were taken from their tombstones, copied by Alva Sanders, now deceased, in the early 1960s, and also by Erick D. Montgomery. By 1982 when we visited the cemetery, the gravestones were covered with debris from wood cutting done on the property. Alva Sanders reported as many as fifty headstones in the cemetery at that time. A copy of Alva's transcriptions does not seem to have survived.
James Durham Last Will and Testament Warren Co. TN Will Book 3, Page 246-247
I, James Durham of the County of Warren and State of Tennessee, Planter do make and publish this my Last Will and Testament hereby revoking and making void all former wills by me at any time heretofore made; And first I direct that my body be decently interred at the Graveyard on my Land in the above named county in a manner Suitable to my condition in life and as to such worldly Estate as it has pleased God to entrust me with I dispose of the same as follows: First, I direct that all my debts and funeral expenses be paid as soon after my decease as possible out of my money I may die possessed of or may first come into the hands of my Executor from any portion of my Estate Real or Personal. Secondly: I will and bequeath unto my son Cyril one hundred dollars in property. Also I will and bequeath unto my Daughter Juliann my entire tract of land amounting to four hundred and thirty five acres on conditions that her Husband, James Sanders, makes my Daughter Elizabeth a good and sufficient title to a certain tract or parcel of land containing fifty acres whereon she now lives. I also will and bequeath unto the Legal Heirs and Representatives of my daughter Caroline Kerby one dollar as their portion of my Estate. I also will and bequeath unto my Granddaughter Mary Matilda Kerby a good Feather bedstead and furniture. The balance of my property after the above conditions of my will complied with I want equally divided between my three children to wit: Cyril, Juliann & Elizabeth for the purpose of carrying into effect this my will I do hereby make ordain and appoint James Sanders, Executor of this my Last Will and Testament In Witness hereof I, James Durham the said Testator have to this my written on a sheath of paper set my hand and Seal this 31st day of January, 1852.
