WILL OF BENJAMIN WILLIAMS (1825) Randolph County Will Book 5, Page 175

In the name of God Amen I Benjamin WILLIAMS of the County of Randolph and State of North Carolina Fanner, being weak in Body, but in perfect mind and memory, thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed for all men to die, do make and ordain this my last Will and Testament, that is to say principally and first of all, I give and recommend my Soul into the hands of Almighty God that gave it, and my Body I recommend to the Earth to be buried in a decent Christian burial at the discretion of my Executors nothing doubting but that at the General Resurrection I shall receive the same again by the mighty power of God, and as touching the worldly Estate wherewith it has pleased God to bless me within this life, I give devise and dispose of the same in the manner and form following - First I give and bequeath to Hannah my dear beloved Wife, the Dwelling House I now live in, and privilege of the Water and Wood for her use, and two Beds and Furniture, One Chest, and one Case of Drawers, and One Clock, and as much household flirniture as shall be thought Sufficient for her, by my Executors, Also I give to my Wife Sixty Dollars principle, which I leave in the hands of my Executors for that purpose for her use during her Widowhood and no longer - I also give and bequeath to my Daughter Mary and her heirs her eldest son Barnabas excepted Two Hundred Acres of Land on the West side of Deep River adjoining the Foushee GARNER old place or Tract of Land. I also give to my Daughter Marys Two Boys that she has had since she has married Isaac BREADY their names Isaac and John Five Hundred Dollars to equally (1,e) divided between them. I also give One Hundred Dollars to my Daughter Marys Daughter Hannah - I also give three Hundred Dollars to my Daughter Marys Daughter Elizabeth - (These two girls and Barnabas were the children of James GARDNER, who died in 1810, a son of James GARDNER.). My Son James has had One Thousand Dollars of his Legacy - My Son John has had One Thousand Dollars of his Legacy - My Son Benjamin has had One Thousand Dollars of his Legacy - I also give my Daughter Hannah Three Hundred and fifty acres of Land lying in Chatham County on Fall Creek part of Three Tracts, the POWERS, FARMER and BEESON Tracts price One Thousand (His wife Hannah McMANUS had inherited this land from her father Lawrence McMANUS.) - My Son Nathan has had One Thousand Dollars of his Legacy - I give to my Son Henry Seventy Seven Acres of Land on the East side of Brush Creek formerly belonging to James RUSHTON also one other Tract on Flat Creek in Randolph County joining my son John WILLIAMS, containing one hundred and Twelve and a half Acres of Land the price of Land and Money that he has had One Thousand Dollars - My Son Henrys Wife not to come in for any part of my Estate - I also give to my Daughter Caty one Tract lying on the West side of Deep River known by the name of Foushee GARNER Tract Containing Two Hundred and fifty Acres price One Thousand Dollars - I also give to my Daughter Lotty the Tract of Land I now live on being on the West side of Brush Creek, containing three Hundred and fifty Acres more or less, and as much other property as make her share equal with her other Sisters - If my Son Henry deceases before he receives his Share its my desire that his Share be equally divided among the rest of my Children, and all the rest of my property to be equally divided among all my Children, My Son Samuel WILLIAMS children to become as One heir, and all the money that I have on Interest amounting Six Thousand Six Hundred Dollars, excluding the Thousand Dollars left in my Executors hands for my wifes support during her widowhood or life is to be equally Divided among my children, my Son James WILLIAMS Children to receive One Share amoungst them - I also appoint my Son John WILLIAMS and Dolphin GARNER Executors to this my last Will and Testament, and I do hereby utterly disallow, revoke, and dis... all and every other former Testament, Wills, Legacys, Bequests and Executors by me in any wise before named Willed and bequeathed ratified and confirmed this and no other to be my last Will and Testament, In Witness whereof I have hereunto set my hand and seal this Sixteenth Eighteen hundred and Twenty four. Signed sealed and published pronounced and declared by the said Benjamin Williams as his last Will and Testament, and in the presence of us who in his presence and in the presence of each other have hereunto Subscribed our names.
